onpromotionandreciprocalprotectionofinvestments

TheGovernmentoftheKingdomofSaudiArabiaandtheGovernmentof
theRepublicofBelarushereinafterreferredtoastheContractingParties,
desiringtointensifyeconomiccooperationbetweenbothstates,
intendingtocreatefavourableconditionsforinvestmentsmadebyinvestors
oftheStateofoneContractingPartyintheterritoryoftheStateoftheother
ContractingParty,
recognizingthatthereciprocalpromotionandprotectionofsuchinvestments
areapttostimulatebusinessinitiativeandtoincreasetheprosperityofboth
nations,
haveagreedasfollows:

Article1
ForthepurposesofthisAgreement:
1.Theterm"investment"meanseverykindofasset,ownedorcontrolledby
aninvestorofaContractingPartyintheterritoryoftheStateoftheother
ContractingPartyaccordingtoitslegislationandinparticular,butnotexclusively
includes:
a)movableandimmovablepropertyaswellasanyrights,suchas
mortgages,leases,liensandpledgesandothersimilarrights;
b)shares,stocksanddebenturesofcompaniesandotherkindsofrightsor
interestsincompaniesaswellassecuritiesissuedbyaContractingPartyoranyof
itsinvestors;
c)claimstomoneysuchasloansortoanyperformancehavinganeconomic
value,associatedwithaninvestment;

d)intellectualpropertyrights,includingbutnotlimitedtocopyrights,:
patents,industrialdesigns,know-how,trademarks,tradeandbusinesssecrets,trade
names,good-will;
e)anyrightconferredbylaworunderpubliccontractoranylicenses

permitsorconcessionsissuedaccordingtolaw.
Anyalterationoftheforminwhichassetsareinvestedorreinvestedshall
notaffecttheirclassificationasinvestment,providedthatsuchalterationisnotin
conflictwiththelegislationoftheStateoftheContractingPartyintheterritoryof
whichtheinvestmentismade.
2.Theterm"returns"mcanstheamountsyieldedbyaninvestmentin
particular,butnotexclusivelyincludes,profit,dividends,royalties,capitalgainsor
anysimilarpayments.
3.Theterm"investor"means:
a)inrespectoftheKingdomofSaudiArabia:
I)naturalpersonspossessingthenationalityoftheKingdomofSaudiArabia
inaccordancewiththelawoftheKingdomofSaudiArabia;
II)anyentityhavingorhavingnolegalpersonalityandconstitutedin
accordancewiththelawsoftheKingdomofSaudiArabiaandhavingitshead
officeinitsterritorysuchascorporations,enterprises,cooperatives,companies,
partnerships,offices,establishments,funds,organizations,businessassociations
andothersimilarentitiesirrespectiveofwhetherornottheyareoflimitedliability;
II)theGovernmentoftheKingdomofSaudiArabiaanditsfinancial
institutionsandauthoritiessuchastheSaudiArabianMonetaryAgency,public
fundsandothersimilargovernmentalinstitutionsexistinginSaudiArabia.
b)inrespectoftheRepublicofBelarus:
I)naturalpersonshavingthenationalityoftheRepublicofBelarusin
accordancewiththerespectivelawsoftheRepublicofBelarus;
Il)anylegalperson,includingcompanies,businessassociations,
partnerships,stateinstitutionsandotherorganizationsestablishedunderthelawsof
theRepublicofBelarus.

landboundaries,themarineandsubmarinezonesoverwhichtheContracting|§
Partiesexercisesovereigntyandsovereignorjurisdictionalrightsunder
internationallaw.
Article2
(1)EachContractingPartyshallinitsterritorypromoteasfaraspossible
investmentsbyinvestorsoftheotherContractingPartyandadmitsuch
investmentsinaccordancewithitslegislation.Itshallinanycaseaccordsuch
investmentsfairandequitabletreatment.
:(2)InvestmentsbyinvestorsofeitherContractingPartyshallatalltimes
:enjoyfullprotectionandsecurityintheterritoryoftheotherContractingParty.
(3)NeitherContractingPartyshallinanycaseinitsterritoryimpairby
arbitraryordiscriminatorymeasuresthemanagement,maintenance,use,
enjoymentordisposalofinvestmentsofinvestorsoftheotherContractingParty.

(1)EachContractingPartyshallgrantinvestmentsonceadmittedand
investmentreturnsoftheinvestorsoftheotherContractingPartyatreatmentnot
lessfavourablethanthataccordedtoinvestmentsandinvestmentreturnsof
investorsofanythirdstatc.

(2)Inaccordancewithitslawsandregulations,eachContractingPartyshall
grantinvestmentsonceadmittedandinvestmentreturnsoftheinvestorsofthe
‘otherContractingPartyatreatmentnotlessfavorablethanthataccordedto
investmentsandinvestmentreturnsofitsinvestors.
(3)EachContractingPartyshallaccordtheinvestorsoftheother
