Rules for the Selection of Judges in the Board of Grievances

Article 1

The selection of those appointed to the judiciary shall be from graduates of one of the Sharia colleges who are nominated by universities in the Kingdom and the Institute of Public Administration, or from those who apply to the Diwan, provided that they meet the legal requirements stipulated in the Law of the Judiciary.

Article 2

Applications for admission are received by the Secretariat of the Administrative Judicial Council, after the applicant fills out the required forms and attaches a copy of the qualifications required for appointment, along with at least three recommendations from well-known scholars, judges, or those who taught him at the college or at the High Judicial Institute or the Institute of Public Administration. Additionally, a certificate from the College of Sharia in which he graduated is required, detailing his performance in all levels in the subjects of jurisprudence and its principles, each with a score and grade separately, as well as the result of the general cognitive ability test, along with the original documents for verification and the national identity card.

Article 3

  • 1- The President of the Council shall form one or more sub-committees, as needed, to review the files of applicants, interview those who meet the legal requirements, and submit their recommendations to the Secretariat of the Council.

  • 2- The Council shall form a preparatory committee called (the Preparatory Committee for Interviewing Candidates for the Judicial Position at the Board of Grievances), chaired by a member of the Council. This committee is responsible for interviewing those recommended by the sub-committee, and it may, when necessary, interview those not recommended by the sub-committee for reasons deemed appropriate by the Chair of the committee. It is also responsible for deciding on requests for re-interviews.

Article 4

The Secretariat of the Council registers the claims and refers those that meet the requirements set forth in these rules—after classifying them according to qualifications—to the Subcommittee within the timeframe determined by the Chairman of the Council. The Secretariat of the Council may also communicate with the relevant authorities—after obtaining the Chairman's approval—to ensure that the legal conditions are met by the applicant.

Article 6

The subcommittee conducts an assessment to measure the capabilities of the applicants, and it may seek assistance from specialized centers in this regard.

Article 7

The committees conduct interviews with those who have passed the measurement test, in accordance with the elements outlined in the interview card approved by the Council.

Article 8

The recommendation for selecting the candidate for appointment in the judiciary shall be based on the criteria of merit and competence, and in accordance with the principle of equal opportunities.

Article 9

The preparatory committee, after the completion of the interviews, prepares quarterly lists of those it recommended for appointment, as well as those it recommended against appointing, and ranks them according to these rules. It then submits these lists along with the appointment justifications and interview cards to the Secretariat of the Council.

Article 10

The selection and appointment of judges shall be based on the score obtained by the applicant during the interview. In the event of a tie, preference shall be given to the candidate with the higher qualification, followed by the candidate with the higher score in the qualification, then the candidate with the higher score in the General Cognitive Ability Test, and finally, the oldest candidate.
