The following terms are defined as follows:
President: President of the Administrative Judicial Council.
Council: Administrative Judicial Council.
Head of Administration: Head of the General Administration for Judicial Inspection.
Administration: General Administration for Judicial Inspection.
Authority: Judicial Inspection Authority.
Inspector: The judge appointed by the council to perform the tasks assigned to the administration.
Investigator: The judge assigned to investigate another judge.
Judges/Judge: The one whose work is inspected, or against whom a complaint is examined, or who is investigated, or evaluated during the probation period.
The administration shall consist of a body led by its chairperson and their assistant, along with all full-time inspectors. It shall convene under the chairperson or their assistant in their absence, with the presence of at least two-thirds of the members. Decisions shall be made by a majority of those present, and in the event of a tie, the side with the chairperson's vote shall prevail. This shall be recorded in minutes signed by those present.
The Authority is responsible for the following:
1- Approving the work plans of the administration and their amendments.
2- Approving the elements of inspection on the Administrative Appeal Courts and Administrative Courts, and their judges, and evaluating them during the probation period.
3- Determining the necessary data for the inspection of the Administrative Appeal Courts and Administrative Courts, and their judges, and evaluating them during the probation period.
4- Deciding on requests for the recusal of inspectors and investigators.
5- Preparing a Judicial Inspection Code at the end of the implementation of each inspection plan on the work of judges, which is approved by the Council.
6- Any matters referred to it by the head of the administration.
A committee is formed to examine the inspection reports on the work of the Administrative Appeal Courts and the Administrative Courts, and their judges. Its members are appointed by a decision from the head of the administration. The committee convenes under the chairmanship of the head of the administration or his assistant, with the membership of four judicial inspectors, including the author of the report. The committee issues its decisions by majority vote, which is recorded in the minutes of the meeting.
There shall be a file in the administration for each judge, in which decisions related to their formation, inspection of their work, complaints, and investigations shall be deposited, unless they are concluded with a dismissal. Additionally, any warnings or disciplinary decisions issued against them shall also be included. Each court shall also have a file in which reports and decisions related to it are deposited.
The activities of inspection, investigation, evaluation, and their files and records are confidential, and may be accessed in cases of necessity with the approval of the head of the department.
The work of the judges of the Administrative Appeals Courts and the Administrative Courts is inspected according to an annual plan, or if the order requires it.
