Rules for the Transfer of Judges

A single transfer application is submitted each year using the approved form, and it remains valid until the beginning of the application period for the following year. Transfer applications are reviewed in an annual session designated for this purpose.

The application of the five-year period mentioned in paragraph (2/A/5) is limited to judges of the Administrative Courts.

The claim is submitted to the President of the Court at least (40) days before the start of the end-of-year vacation.

Requests from the judges of the court, with complete data, shall be sent in one batch to the General Secretariat of the Administrative Judicial Council at least (30) days before the end-of-year vacation.

A student requesting a transfer may withdraw their request no later than five days before the start of the end-of-year vacation.

The Secretariat presents the claims that meet the aforementioned criteria to the Committee for Reviewing Transfer Claims, accompanied by the needs assessment prepared by the relevant department, as well as a statement of those excluded and the reasons for their exclusion, at least ten working days prior to the Council session designated for transfers.

Previous Amendments

The preference for transfer shall be based on seniority in the court from which the transfer is requested, followed by the degree of competence in the last two reports, then the judicial seniority in the bureau, followed by the judicial rank, then the seniority therein, and finally, the age of the individual.

The Secretariat presents to the Council what it receives from the Committee reviewing transfer requests, including the final report prepared by the Committee regarding those excluded and the reasons for their exclusion.

  • Without prejudice to the provisions stated in paragraphs (2/A/4, 3, 2, 1) and (2/B), transfer may be granted due to emergency circumstances if the following conditions are met:

    • A - The circumstance occurs after the commencement of work in the court from which the transfer is requested, and there is no expectation of its cessation.

    • B - It is not possible to address the issue in the area where the court from which the transfer is requested is located.

    • C - The circumstance is related to the judge personally, or to those who are dependent on him if there is no other provider.
