Regulations for the Practice of Maritime Transport

Chapter 1: Preliminary Provisions

Article (2) Purpose of the Regulation

  • This regulation aims at laying down the regulatory framework for issuing licenses to practice maritime transport activity, renewing it, assigning it, suspending it and canceling it, as well as determining the obligations of the establishment arising from the license, and controlling the maritime transport activities.

Article (3) Application

  • Without prejudice to the laws and agreements in force in the Kingdom, the provisions of this regulation shall apply to the maritime transport business and ships practicing the activity regardless of their nationality, this regulation are considered complementary and it interprets the provisions of the law

Chapter 2: License

Article (4)

  • Maritime transport business shall be carried out after obtaining a license from the maritime authority in accordance with the provisions of this regulation.

Article (6): Issuance of the License

  • After verifying that the application fulfills the licensing conditions:

  1. The Maritime Authority shall issue the license according to the form prepared for a period of three (3) years, after inspecting the establishment location and verifying the existence of the equipment necessary to practice the activity. Any additional documents may be requested.

  2. The Maritime Authority shall inspect the establishment after six (6) months to verify the status and implementation of the quality system.

Article (7) : Suspension of the License

  • The conditions of the license are included in its validity, and in the event of a breach of any of these conditions, the maritime authority may suspend the license, provided that the establishment does not practice the activity until the condition is fulfilled, and if the condition is not fulfilled within a maximum period of sixty (60) days from the date on which the license is suspended. The license is canceled without prejudice to the penalties mentioned in this regulation.

Article (8) License Renewal

  1. Subject to the conditions of the License and the obligations of the establishment mentioned in this regulation, the license shall be renewed at the request of the establishment according to the following conditions:

    1. The establishment shall submit a request to renew the License thirty (30) days before its expiry

    2. Payment of the amounts of penalties (if any)

    3. Payment of the fees due

  2. The activity may not be practiced after the License expiration date.

  3. The license shall be deemed null after ninety (90) days from its expiry date without being renewed.
