To approve life-saving appliances authorized for survey and maintenance the following shall be available:
1. The life-saving appliances required by this regulation shall be approved by the competent authority and in conformity with the provisions of the Convention and the Code, as well as the safety regulations for non-conventional ships. In order to do so, the marine surveyor shall test the rescue equipment to ensure compliance with the requirements of the relevant regulations.
2. Ensuring the continuity of the efficiency of the life-saving appliances approved during the accreditation period.
3. All repairs and maintenance of life-saving appliances shall be carried out in accordance with the manufacturer's instructions, the requirements of the Convention, the Code and the relevant resolutions of the Organization. In case of emergency, repairs may be carried out aboard the ship.
1. A request submitted by the establishment to obtain the License according to the approved form, whether in paper or electronically on the specified website.
2. The License is issued to the establishment based on the type of activity requested after following the legal procedures.
3. A request is submitted by the establishment for the License along with the following documents:
A- A copy of the Commercial Register.
B- A License from the Investment Authority in coordination with the Public Transport Authority (Maritime Transport Sector).
C- A statement of the names of the specialized technical employees and their number.
D- A statement of the technical employees (surveyors) in the establishment, their qualifications, certification, and previous experience in factories producing rescue equipment related to the activity, along with their accreditation certificates from the manufacturing factory of the device.
E- A copy of the certificates for the technical employees (marine surveyors), whether academic or qualification certificates, or any other experience certificates after verifying their conformity with the original.
F- Any other documents required by the competent authority.
4. A liability insurance certificate or a guarantee letter as stipulated in Article Eleven of the Regulation.
5. After verifying that the request meets the required documents, the administration must do the following:
A- Inspect the establishment's premises and verify the presence of the necessary tools and equipment to practice the activity and meet the requirements according to the provisions of this Regulation and the recommendations and publications issued by the organization (IMO) regarding those requirements.
B- Verify that the equipment and facilities in the establishment comply with the requirements and instructions of the manufacturers of those devices.
C- Verify that quality requirements are met in the establishment.
D- Without prejudice to the conditions and specifications of the approved activity centers by the city municipalities or their branches and the Public Transport Authority (Maritime Transport Sector), the activity must be practiced through a premises that includes the technical requirements and equipment that must be available in the activity premises, and any violation of these will result in the suspension of the License.
6. The License is issued in Arabic according to the prepared form after paying the prescribed fees and settling any financial penalties - if any - and adding the activity to the Commercial Register, and it shall be:
A- In the name of the establishment and limited to it.
B- An English definition may be issued in the name of the establishment, which must only correspond to the name of the establishment in English as approved in the Commercial Register or official entities in the Kingdom, and the License applicant must provide supporting documents for that.
C- If the establishment has one or more branches, a branch License shall be issued for each branch according to the type of activity for which the License is requested.
D- The duration of the License is five years.
If the establishment wishes to make an amendment to its legal entity and continues to carry out the activity, it shall obtain the approval of the competent authority.
The licence shall be terminated upon the expiration of its term.
1. The establishment may not carry out the activity after the expiry of the licence period until it is renewed.
2. The application of the establishment to renew the licence after its expiry date shall not be accepted thirty (30) days elapse after its expiry. The competent authority may grant the establishment a new license in accordance with the provisions of this regulation.
3. The licence may be renewed for a similar period or periodsin accordance to the evaluation of the competent authority or the public interest after taking the following actions:
a. Submitting the renewal request from the establishment according to the approved form.
b. Submitting the renewal application within (60) sixty days prior to the date of expiry of its validity.
c. Fulfilling the requirements of this regulation.
d. Payment of the amounts of penalties and fines of the enterprise.
e. Payment of fees due.
The establishment may assign the licence to third parties provided that:
1. Taking the consent of the competent authority prior to the assignment.
2. The assignee shall meet all the conditions that shall be met for those authorized to practice the activity.
3. Payment of the financial penalties owed by the establishment and providing proof of payment.
4. The entity's responsibility for the activity and its employees shall continue and fulfill its obligations towards - third parties until completion of the transfer of the licence to the assignee.
5. The licence shall be valid when applying the application of the assignment.
6. All equipment transfer procedures for the activity from the establishment assigning the licence shall be completed by the assigning establishment within a maximum period of two months from the date of the approval of the competent authority for the assignment.
The maritime authority may cancel the licence if it finds the following:
1. The licence conditions mentioned in this regulation are required to be in force and if any of these conditions are met, the licence shall be suspended until the completion or rectification of this condition. If the condition is not completed or not corrected within fifteen days from the date of the suspension of the licence the competent Authority may cancel the licence
2. Expiration of the commercial registration of the establishment or its cancellation at the request of the licensee.
3. If the establishment is bankrupt or declared bankrupt or ordered to be under sequestration or dissolved or liquidated for any reason.
4. the assignment of licence without the consent of the competent authority.
5. A decision issued by the competent authority on the basis of what is required by the public interest to cancel the activity.
6. Modification of the establishment entity without the prior consent of the competent Authority
