Organizational Arrangements of the National Center for Transport Safety

Article 1

  • The words and phrases listed below - wherever they appear in these arrangements - shall have the meanings specified next to each of them,

  • unless the context requires otherwise:

    • The Center: The National Center for Transportation Safety.

    • The Arrangements: The organizational arrangements of the Center.

    • The Minister: The Minister of Transport and Logistics Services.

    • The Chief Executive Officer: The Chief Executive Officer of the Center.

    • The Council: The Board of Directors of the Center.

    • The President: The President of the Council.

    • Means of Transport: Vehicles, trucks, buses, aircraft, trains, and marine vessels; of various types, for non-military or security use.

    • Serious Incidents: Incidents and events related to the operation of means of transport that result in loss of life, serious injuries, or cause significant damage to infrastructure or affect transportation safety.

    • Investigative Analysis: A process conducted to prevent the recurrence of serious incidents, which includes gathering information, analyzing it, and drawing conclusions, including identifying causes and contributing factors and reaching appropriate recommendations to be submitted to other relevant authorities.

Article 2

  • The center enjoys public legal personality, financial and administrative independence, and is organizationally linked to the Minister. Its main headquarters is located in the city of Riyadh, and it may, by a decision of the Council, establish branches or offices within the Kingdom as needed.

Article 3

  • The center aims to enhance the level of safety in the transportation system in all its forms, by raising awareness and promoting a culture of safety among beneficiaries both within and outside the system, and providing guiding recommendations based on investigative analysis, best practices, and relevant international experiences to other related entities.

Article 4

  • For the center to achieve its objectives - without prejudice to the competencies of other relevant authorities, and without prejudice to the Kingdom's obligations under international agreements to which it is a party - it may undertake the following:

    • 1- Develop policies, plans, programs, and initiatives related to transportation safety, in coordination with other relevant authorities.

    • 2- Conduct investigative analysis of all serious incidents that occur in transportation means, which are as follows:

      • A- Incidents involving vehicles, trucks, and buses within the Kingdom's territory.

      • B- Incidents involving civil aircraft within the Kingdom's territory, and Saudi aircraft or those operated by individuals holding Saudi nationality over international waters or over territories not owned by any state, and Saudi aircraft or those operated by individuals holding Saudi nationality in the territories of other states.

      • C- Incidents involving maritime vessels within the Kingdom's territory, maritime vessels in international waters if they fly the Kingdom's flag, and maritime vessels flying the Kingdom's flag in the territories of other states.

      • D- Incidents involving trains within the Kingdom's territory.

    • 3- Establish a database and information system that includes all matters related to serious incidents, their statistics, and what is necessary to conduct investigative analysis in the Kingdom in coordination with other relevant authorities.

    • 4- Facilitate access to data and information related to serious incidents and related matters to other relevant authorities.

    • 5- Provide services and consultations related to its work to government authorities and others inside and outside the Kingdom.

    • 6- Conduct studies and research, and prepare reports and indicators related to transportation safety and its enhancement; and share them with other relevant authorities.

    • 7- Utilize technological means in carrying out its tasks in a manner that reflects on the results aimed at maintaining transportation safety.

    • 8- Benefit from local and international practices and experiences that contribute to enhancing transportation safety.

    • 9- Cooperate with academic institutions and local and international research organizations relevant to its work.

    • 10- Organize and hold seminars, courses, and training workshops related to transportation safety for its personnel or other relevant authorities or beneficiaries of its services; contributing to raising awareness of the center's roles and promoting a culture of transportation safety.

    • 11- Organize and hold exhibitions and conferences related to transportation safety and participate in them; in accordance with the applicable legal procedures.

    • 12- Represent the Kingdom in local and international bodies, organizations, forums, and conferences related to its roles; in accordance with the applicable legal procedures and in coordination with other relevant authorities.

    • 13- Any other task assigned to it under the laws and regulations.

Article 5

Previous Amendments
  • The center shall have a Board of Directors chaired by the Minister, and membership shall include:

    • 1- The Chief Executive Officer.

    • 2- A representative from the Ministry of Interior.

    • 3- A representative from the Ministry of Health.

    • 4- A representative from the Ministry of Transport and Logistic Services.

    • 5- A representative from the Ministry of Municipal and Rural Affairs and Housing.

    • 6- A representative from the General Authority of Civil Aviation.

    • 7- A representative from the Transport General Authority.

    • 8- A representative from the General Authority for Roads.

    • 9- A representative from the Saudi Ports Authority.

    • 10- A representative from the Saudi Standards, Metrology and Quality Organization.

    • 11- A representative from the Ministerial Committee for Traffic Safety.

    • 12- Three representatives from the private sector specialized in transport safety, appointed by an order from the Council of Ministers based on a nomination from the Minister, with their membership lasting for three (3) years, renewable once.

  • The rank of representatives of government agencies shall not be less than the fourteenth rank or its equivalent.

Article 6

  • The Council is the highest authority of the center and is responsible for supervising it and managing its affairs. It has the authority to exercise all powers and make all necessary decisions to achieve its objectives, within the limits of the provisions of the arrangements and powers granted to it under the relevant laws. In particular, it has the following responsibilities:

    • 1- Approving the policies, plans, programs, and initiatives related to the center, reviewing them, and following up on their implementation.

    • 2- Approving the financial compensation for the services and consultations provided by the center or any work for which the Council deems it appropriate to obtain financial compensation.

    • 3- Approving the administrative and financial regulations, provided that the approval of the administrative regulations is in agreement with the Ministry of Human Resources and Social Development, and that the approval of the financial regulations and the provisions with financial implications in the administrative regulations is in agreement with the Ministry of Finance.

    • 4- Approving the necessary regulations to facilitate its operations.

    • 5- Approving the conclusion of agreements, memoranda of understanding, and contracts, in accordance with the applicable legal procedures.

    • 6- Reviewing the periodic reports submitted regarding the progress of work in the center and its financial status.

    • 7- Approving the organizational structure of the center and its guide.

    • 8- Approving the establishment of branches and offices for the center.

    • 9- Approving the center's budget, its annual report, its final accounts, and the auditor's report, and submitting them in accordance with the applicable legal procedures.

    • 10- Accepting gifts, grants, donations, bequests, and endowments, in accordance with the governing provisions.

    • 11- Appointing an external auditor for the center and an internal financial controller.

  • The Council may delegate some of its powers to its president or to any member or employee of the center as it sees fit. The Council may also form permanent or temporary committees from among its members or others, assigning them tasks it deems appropriate, specifying in the decision to form each committee its president, members, and responsibilities, and allowing them to seek assistance from whomever they deem necessary to perform the assigned tasks.

Article 7

  • 1- The Council meetings are held at the headquarters of the center, chaired by the President or a member appointed by him from representatives of government entities. Meetings may also be held at another location within the Kingdom if necessary.

  • 2- The Council holds its meetings periodically (at least four) times a year. The President may call for a meeting whenever necessary, or upon the request of at least one-third of the members. The invitation must be sent at least seven days prior to the meeting, accompanied by the agenda.

  • 3- A meeting is valid if attended by the majority of the members, including the President or his appointee, and decisions are made by a majority of the votes of those present. In the event of a tie, the side that the President of the meeting voted for shall prevail.

  • 4- A member of the Council may not abstain from voting nor delegate another member to vote on their behalf in their absence. An objecting member has the right to record their objection and the reasons for it in the minutes of the meeting.

  • 5- The deliberations and decisions of the Council are documented in minutes signed by the President of the meeting and the attending members.

  • 6- If necessary, in emergency cases, and as deemed appropriate by the President, meetings may be held and voted on remotely using technological means. Decisions may be made by circulation among the members, and signed to indicate that all members have been informed of them. Decisions made in this manner are not considered valid unless they are circulated to all members, voted on by all members, and receive a majority of their votes.

  • 7- The Council shall have a Secretary from among the center's staff, chosen by the President based on the nomination of the CEO, who will be responsible for the Council's secretariat, preparing for meetings, recording the minutes, deliberations, and decisions, and attending Council meetings without the right to vote.

  • 8- The Council may invite specialists and consultants to attend its meetings, without them having the right to vote.

Article 8

  • The center shall have an Executive Director, who is appointed and relieved from his position by a Decision from the Council, which specifies his salary and other financial benefits. He shall be responsible for managing the center and conducting its affairs, and his responsibilities and powers are concentrated within the limits set by the arrangements and what the Council decides. He shall, in particular, exercise the following powers:

    • 1- Proposing policies, plans, programs, and initiatives and submitting them to the Council for approval.

    • 2- Proposing the financial compensation for the services, consultations, and works provided by the center, and submitting them to the Council for approval.

    • 3- Supervising the preparation of the organizational structure of the center, its guide, and its administrative and financial regulations, as well as the necessary regulations to conduct its work; and submitting them to the Council for approval.

    • 4- Signing agreements, memoranda of understanding, and contracts, after obtaining the Council's approval.

    • 5- Supervising the workflow in the center and submitting periodic reports to the Council.

    • 6- Following up on the implementation of the Decisions issued by the Council and the Decisions related to the center's work.

    • 7- Supervising the preparation of the center's budget project, the annual report, and the final account project; and submitting them to the Council for approval.

    • 8- Disbursing from the approved budget and taking financial actions, in accordance with the established systems and regulations and the powers delegated to him by the Council.

    • 9- Representing the center before judicial, administrative, and other authorities inside and outside the Kingdom, and he may delegate others to do so.

    • 10- Contracting with employees of the center, experts, consultants, and consulting firms from inside or outside the Kingdom in accordance with the established systems and regulations and the powers delegated to him by the Council.

    • 11- Issuing the necessary Decisions to implement the provisions of the arrangements and regulations issued based on them and the approved rules and procedures; according to the powers granted to him.

    • 12- Any other task assigned to him by the Council.

    • The Executive Director may delegate any of his competencies to other members of the center.

Article 9

  • The personnel of the center are subject to the provisions of the Labor Law and the Social Insurance Law.

Article 10

  • 1- The center shall have an independent annual budget.

  • 2- The financial year of the center is the same as the financial year of the state.
