Implementing Regulation for Human Resources in the Civil Service

  • Ministerial Decision No. (1550) dated 1440/6/9 AH

  • The Minister of Civil Service.

  • Based on the powers vested in him by the Council of Ministers Decision No. (75) dated 1440/1/29 AH, which stipulates in item (First) the formation of a committee chaired by the Minister of Civil Service and including representatives - none of whom shall be below the fifteenth rank or its equivalent - from the Ministries of: (Civil Service, and Finance) and from the Bureau of Experts at the Council of Ministers, tasked with deciding on the executive regulations of the Civil Service Law and the related rules and provisions..., and the aforementioned regulations in this item shall be issued by a decision of the Minister of Civil Service.

  • After reviewingthe Civil Service Lawissued by Royal Decree No. (M/49) dated 1397/7/10 AH and its executive regulations, organizational statutes, rules, and related controls.

  • After reviewing the minutes of the Committee for Deciding on the Executive Regulations of the Civil Service Law No. (1440/2) dated 1440/6/9 AH, which includes the approval of the Executive Regulation for Human Resources in the Civil Service.

  • It is decided as follows:

    • First: Approval of the Executive Regulation for Human Resources in the Civil Service in the form attached to this decision.

    • Second: This regulation shall replace the following:

      • 1- The Executive Regulation of the Civil Service Law issued by the Civil Service Council Decision No. (1) dated 1397/7/27 AH

      • 2- The Regulation for Appointment to Public Positions issued by the Civil Service Council Decision No. (921/1) dated 1424/9/7 AH

      • 3- The Promotion Regulation issued by the Civil Service Council Decision No. (686/1) dated 1421/3/15 AH

      • 4- The Transfer Regulation issued by the Civil Service Council Decision No. (929/1) dated 1424/10/19 AH

      • 5- The Assignment Regulation issued by the Civil Service Council Decision No. (596/1) dated 1420/1/18 AH

      • 6- The Secondment Regulation issued by the Civil Service Council Decision No. (749/1) dated 1422/2/4 AH

      • 7- The Regulation for Employing Non-Saudis in Public Positions issued by the Civil Service Council Decision No. (45) dated 1398/8/1 AH

      • 8- The Job Duties Regulation issued by the Minister of Civil Service Decision No. (703/10800) dated 1427/10/30 AH

      • 19- The Controls for Disbursing Treatment Expenses for Employees Seconded Outside the Kingdom issued by Council of Ministers Decision No. (1696) dated 1394/9/24 AH

      • 20- The Methods for Proving Employee’s Medical Incapacity to Work issued by the Ministry of Civil Service Circular No. (14466) dated 1437/5/29 AH

      • 21- The Rules for Contracting with Retirees issued by the Civil Service Council Decision No. (605/1) dated 1420/2/17 AH

      • 22- The Determination of Official Working Hours issued by Council of Ministers Decision No. (187) dated 1408/7/26 AH

      • 23- The Determination of Working Hours for Employees in Government Agencies Requiring Continuity of Work Beyond Official Working Hours issued by Council of Ministers Decision No. (198) dated 1406/11/7 AH.

    • Third: This regulation cancels all that contradicts its provisions.

    • Fourth: This regulation shall be effective ninety (90) days after the date of issuance of this decision.

    • Fifth: This regulation shall be communicated to all ministries and relevant government agencies to implement accordingly.

    • Sixth: All ministries and government agencies shall calculate the financial impact resulting from the application of this regulation within the distribution of appropriations for the relevant items and according to the ceilings set during the budget discussions with the Ministry of Finance for the upcoming year (1442/1441 AH).

    • Seventh: All ministries and relevant government agencies shall consider the approved amounts for the relevant items when applying this regulation during the fiscal year (1441/1440 AH), in accordance with the Royal Decree and the implementing instructions of the State General Budget.

Chapter 1: Definitions and General Provisions

Article 1

Previous Amendments
  • Competent Minister: The minister responsible for his ministry, or the head of the independent agency, as applicable.

  • Government Agency: Any ministry or independent agency whose employees are subject to the provisions of the Civil Service Law and its implementing regulations.

  • Regulation: The implementing regulation for human resources in the civil service.

  • Employee: Anyone who holds a public civil position in the state or performs its tasks, regardless of the nature of their work or job title, whether through appointment or contract on a permanent or temporary basis.

  • Position: The civil tasks and responsibilities performed by the employee for public service, subject to the supervisory authority in the administrative organization.

  • Classification of Positions in the Civil Service: The process by which similar duties and responsibilities are grouped into positions, assigning each position to the appropriate category according to the degree of difficulty and responsibility, then grouping similar categories into qualitative groups and then general groups, and setting minimum limits for knowledge, abilities, skills, academic qualifications, practical experiences, and necessary technical and behavioral competencies to perform the tasks of the positions.

  • Organizational Framework: A set of detailed rules and procedures for specific provisions stated in the regulation issued by the Ministry of Human Resources and Social Development.

  • Salary: The basic salary.

  • Wage: The actual wage.

  • Contract: A document that regulates the contractual relationship between the contractor and the government agency.

  • Human Resources Management: The administrative unit responsible for managing human resources in the government agency.

  • Year: Twelve Hijri months.

  • Month: Thirty days.

  • Relatives up to the fourth degree are:

    • First degree: Parents, grandparents, and great-grandparents, regardless of their lineage.

    • Second degree: Children, their children, and descendants.

    • Third degree: Full siblings, half-siblings (by father or mother), their children, and grandchildren.

    • Fourth degree: Uncles, aunts, their children, maternal uncles, and aunts, and their children.

  • Job Succession: A process aimed at establishing and implementing the necessary plans to meet the ongoing needs of the government agency for leaders and specialists, ensuring the continuity of operations, as well as the necessary plans for their development and preparation for that.

  • Disaster: An unexpected public incident resulting from natural causes or human actions, leading to loss of life and/or destruction of property.

  • Official Task: General civil tasks and responsibilities that do not have a position within the administrative formations of the government agency, performed by the employee temporarily and subject to the supervisory authority in the administrative organization.

  • Code of Conduct: A code of rules for professional conduct and ethics in public service.

  • Remote Work: The performance of the employee's duties and responsibilities outside the government workplace using electronic systems.

  • Smart and Electronic Systems: The systems, applications, and information technology tools used in remote work.

  • Remote Work Committee: A committee formed in the Ministry of Human Resources and Social Development that addresses all matters related to remote work in the government agency, submitting its recommendations to the Minister of Human Resources and Social Development, with its formation and working mechanism determined by a decision from him.

Article 4

Previous Amendments

The government agency shall provide all data requested by the Ministry of Human Resources and Social Development and facilitate access to the information and data required for the exercise of the Ministry's competencies, and respond to the Ministry in any matters related to civil service within the period specified.
