Rules for Judges' Leave for Study - Administrative Judicial Council

The discharge is for obtaining diploma, master's, and doctoral degrees.

Previous Amendments
  • The following conditions must be met by the applicant for leave of absence:

  • 1- Obtaining acceptance for a specified duration of study in scientific fields that the Council deems necessary for work from one of the accredited universities, colleges, or institutes approved by the Council.

  • 2- Having spent at least three years in work for a doctoral degree, and two years in other cases.

  • 3- His performance rating in the last two inspection reports must not be less than (above average), and the suitability of the individual undergoing the trial period must be proven.

  • 4- The applicant for leave of absence must agree to be transferred to another Court after completing or finishing his studies, according to the need.

  • 5- Approval from the President of the Court in which he works, taking into consideration the following:

    • 1- There are no pending cases awaiting judgment with him or delayed due to his actions.

    • 2- No impact on work.

    • 3- The number of judges on leave in the Court should not exceed (10%).

A request for leave of absence that meets the requirements shall be submitted by the President of the Court to the Secretariat.

  • The Secretariat submits the claims after the following:

  • 1- Verifying the availability of the conditions therein.

  • 2- Determining the necessary period of leave.

  • 3- The arrangement of claims for each academic degree shall be as follows:

    • 1- Seniority in the judicial system.

    • 2- The most competent based on the latest inspection reports.

    • 3- The grade in the last qualification obtained by the applicant for leave.

The study is extended, concluded, postponed, and the specialization is changed by a decision of the Council.

The Secretariat is responsible for monitoring the study of the vacant position and submitting a semi-annual report on it to the Council.

The discharged individual is required to submit the results of their studies at the end of each academic semester. In the event of a delay in submitting the results for two consecutive semesters, their discharge will be terminated, and they will return to their original position.

If the results of the evaluation indicate difficulty in completing the studies, the council has the authority to terminate the evaluation.
