Executive Rules for the Regulation of Social Care Homes

Article 1

In the application of the provisions of these rules, the following phrases or terms shall have the meanings indicated next to each, unless the context requires otherwise:
Ministry: Ministry of Social Affairs.
Minister: Minister of Social Affairs.
Agency: Ministry Agency for Social and Family Care.
Agent: Ministry Agent for Social and Family Care.
Home: Social Care Home.
Resident: A person who meets the admission criteria and resides in the home, whether male or female.
Social Care: A set of services, programs, and activities provided to the resident that ensure comprehensive care in health, psychological, physical, and recreational aspects.
Social Protection: A set of procedures that ensure the safety of the resident from physical, psychological, and financial trespassing and provide support and assistance when subjected to any assault inside or outside the home by the staff of the home or others.

Article 2

The House: A social institution established by the Ministry, which supervises it to provide social services to needy groups, whether male or female, in accordance with what is stipulated in the Regulation and the executive rules.

Article 3

In consideration of what is stipulated in (Article Three) of the Regulation, the centers aim to provide social, psychological, health, living, and recreational care for their residents, and to strive to develop appropriate rehabilitation programs for them, integrate them into the external environment, strengthen the connection between them and their families, and provide care, rehabilitation, and treatment for the elderly in various types of permanent or temporary accommodation.
They also aim to provide social protection from various forms of physical and moral harm, and to offer support and assistance when needed.

Article 4

The following conditions must be met for acceptance into the home:
1. The applicant must be a Saudi national.
2. The applicant must be sixty years of age or older, and must be incapacitated by old age from working or managing their own affairs. Acceptance may be granted to those under sixty if a social investigation proves the need for them to be included in the services of the home.
3. A medical examination must confirm that the applicant is free from contagious, infectious, psychological, or mental diseases that pose a threat to their safety or a risk to other residents.
4. There must be no family available, or the family must be unable to provide the necessary services.
5. An exception to the application of paragraphs (1) and (2) of this article may be made in accordance with the provisions of Article Five and Article Six of these regulations for a period of two months, provided that accommodation beyond this period is only permitted with the Minister's approval, and as required by the interest.
6. A claim must be submitted in the name of the Director of the home, indicating the desire of the applicant or their guardian to benefit from the services of the home.
7. Completion of the enrollment form is required.

Article 5

In consideration of what is stipulated in (Article Four) of the Regulation, the Director of the house has the right, in cases of extreme necessity and after direct coordination with the Agent, to accept a non-Saudi according to the following conditions:
1 - He must be from a Saudi mother.
2 - He must have a valid and current residency permit.
3 - The case must be humanitarian or urgent, and shall not exceed three cases.
4 - He must prove through a medical examination that he is free from infectious, contagious, psychological, or mental diseases that pose a threat to his safety or a risk to other residents.
5 - The social research must demonstrate the need for him to be included in the services of the house.
6 - There must be a vacancy in the house, taking into account that the acceptance does not affect the services provided to the residents of the house.
7 - There should be no pending applications for Saudis under review.
8 - The duration of accommodation must be (60) days.

Article 6

In consideration of what is stipulated in (Article Four) of the Regulation, the Director of the institution has the right, in cases of extreme necessity and after direct coordination with the Agent, to accept individuals under the age of sixty according to the following conditions:
1- Must be a Saudi national.
2- Must prove through a social research that his family is unable to provide him with economic or social care or that there is no one to take care of him.
3- Must prove through a medical examination that he is free from contagious, infectious, psychological, or mental diseases that pose a threat to his safety or a risk to other residents.

Article 7

In consideration of what is stipulated in (Article Five) of the Regulation:
1- The institution shall preserve the dignity of the resident as stipulated by Islamic law.
2- The institution shall work on educating and training the family on how to deal with the elderly and conduct lectures, seminars, and field meetings that highlight the importance of caring for the elderly within their family.
3- The institution, in coordination with the medical authority, shall prepare an internal regulation for the personal hygiene of the residents, such as bathing schedules, laundry and bedding washing schedules, while ensuring the cleanliness of the institution, especially the tools and equipment used by the residents.
4- The director of the institution must work in coordination with the National Center for Social Studies to facilitate the participation of the institution's employees in training courses on first aid methods, especially (cardiopulmonary resuscitation).
5- Intergenerational communication with the residents should be effective, ensuring a supportive environment that increases community members' interest in the residents.
6- Providing opportunities for engaging in some manual work and professional hobbies to occupy their free time and maintain their abilities.
7- Qualifying and training the institution's employees to provide first aid such as cardiopulmonary resuscitation.
8- Working to support communication between the resident and their relatives and friends.
9- Organizing recreational trips and participating in events, exhibitions, parties, and national occasions, as well as organizing trips for Hajj and Umrah, and other activities as permitted by the financial appropriation allocated for the institution.

Article 8

A special record is opened for the resident, in which all information related to the case is documented, and it specifically includes the following documents:
1- A copy of the national identity card.
2- The social, health, psychological, and mental assessment of the resident.
3- All correspondences and communications related to the resident.
4- Phone numbers and addresses of the resident's relatives and friends.
5- Collecting information about the applicant and a copy of their national identity card.

Article 9

The establishment must maintain a record of internal and external visits, documenting the information and data that indicate the extent of communication with the resident by their relatives and friends, and work to encourage community members to communicate with the residents.

Article 10

If one of the residents is infected with a contagious or infectious disease, the director of the facility must take the necessary procedures immediately, including:
1- Isolating the patient from the other residents.
2- Informing their relatives.
3- Notifying the medical services at the Ministry and the General Administration of Social Affairs in the region.
4- Conducting a medical examination and determining the duration of treatment.
