The words and phrases - wherever mentioned in the Regulation - shall have the meanings specified in Article (1) of the Law, and the following words and phrases shall also have the meanings set forth next to them:
1. Electronic platform: The social support and protection platform.
2. Office: The social security office in the region, governorate, or center.
3. Fund: Human Resources Development Fund (HRDF).
4. Social researcher: The ministry representative responsible for conducting home visits to collect information and verify the data provided by the applicant and the beneficiary.
5. Adult dependent: A person aged eighteen years or older, who succeeds the guardian in guardianship.
6. Orphan: Any male or female whose father has died and has not reached the age of eighteen, and an orphan is also considered to be one whose parents are unknown.
7. Earned income: The income obtained by the independent or family members as a result of effort exerted, such as work or registered business activity.
8. Unearned income: Income derived from sources - other than work or registered business activity - such as properties and their returns, and social or governmental assistance received by the independent or family members.
9. Permanent residence in shelter and treatment centers: Residence for a period exceeding two months in shelter and treatment centers.
10. Committee: The committee formed in accordance with the provisions of Article (22) of the Law.
1. The Ministry, upon receiving the claim for pension, shall do the following:
A- Verify the completeness and accuracy of the submitted data and documents.
B- Verify the eligibility of the applicant and whether they meet the conditions.
C- Enter the applicant's data into the electronic platform if the claim was submitted through the office or by phone.
2. The eligibility of the applicant and the fulfillment of the entitlement conditions are verified through the following:
A. The official data and documents submitted by the applicant.
B. The data obtained by the Ministry, and the additional data held by relevant governmental and private entities.
C. The information and data collected by the social researcher during the home visit.
1. The Ministry shall notify the applicant of its decision within (twenty) days from the date of submitting the claim, stating the reasons in the event of rejection. If this period elapses without a decision from the Ministry regarding the claim, or if a decision is issued rejecting it, the applicant has the right to appeal before the Committee within a period not exceeding (thirty) days from the expiration of the specified period for issuing the decision or from the date of the Ministry's decision to reject the claim.
2. In the event of a decision to accept the claim without the Ministry conducting a visitation to the residence for reasons unrelated to the beneficiary, a date shall be set for the visitation and verification of the accuracy of the data. If it is found after conducting the visitation that the beneficiary is not entitled, he has the right to retain what has been disbursed to him prior to the date of the visitation. Without prejudice to the provisions of Article (twenty-five) of these regulations, he is obligated to return what has been disbursed if it is proven that he provided false data and information with the aim of obtaining the pension.
The Saudi pension is available to residents who have permanent residency in the Kingdom and meet the eligibility criteria. Those who do not exceed three consecutive or separate months outside the Kingdom during the year preceding the date of pension disbursement are also considered permanent residents. The nationality requirement is waived for the following individuals:
1. The wife of a Saudi national, as well as his divorced or widowed spouses who have Saudi children, provided that the following conditions are met:
A. The woman and her children must have permanent residency in the Kingdom.
B. The woman must have a valid residency permit.
C. Submission of proof of status.
2. The children of a Saudi widow or divorcee from a non-Saudi husband, provided that the following conditions are met:
A. Their residency must be permanent in the Kingdom.
B. Proof of the woman's marriage to a non-Saudi husband must be provided through an official document.
C. The children must have valid residency permits.
3. Persons with disabilities, orphans, and widows with orphans who possess mobility cards, provided that the following conditions are met:
A. The mobility cards must be valid.
B. Submission of proof of disability.
1. If the breadwinner has more than one family residing in a single dwelling, he and all those under his care, responsibility, and support in that dwelling shall be considered as one family for the purposes of applying the Law and this Regulation.
2. If the breadwinner has more than one family and each family resides in a separate dwelling, each family shall be considered independent for the purposes of applying the Law and this Regulation, and the monthly income shall be calculated and the entitlements of each family he supports shall be divided separately.
3. A full-time student who has not exceeded the age of twenty-five and resides in a separate dwelling from his family or in another city for the purpose of studying shall be considered a dependent.
4. In the event of a dispute regarding the dependency of the ward to any family, the determining factor shall be what is stated in the custody verification document. If there is no document, the ward shall be considered dependent on the family whose dwelling is closest to his school, unless the social researcher deems otherwise based on other considerations that will be clarified in the home visit report.
