1- The words and phrases defined in Article (1) of the Law on Communications and Information Technology shall have the same meanings as specified in the law when used in this Regulation.
2- The following words and phrases - wherever they appear in this Regulation - shall have the meanings indicated next to each, unless the context requires otherwise:
A- The Governor: The Governor of the Communications, Space, and Technology Authority.
B- Harmful Wireless Interference: The harmful effect of electromagnetic energy emitted from any thermal emission, radiation, or electrical induction, or transmission that adversely affects the use, effectiveness, or operation of wireless communication devices, or harms wireless communication systems, or equipment sensitive to wireless waves.
C- Reference Offer: A document prepared by the dominant service provider outlining its requirements for the standard terms and conditions for interconnection or access with another service provider.
D- The Registrant: The natural or legal person who records their information with the Authority, in accordance with its provisions.
E- Telemarketing: The use of the communications network for advertising and promoting the use of a product or service, including messages and automated calls or calls made by a natural person.
F- Universal Service Policy: The policy adopted by the Ministry to ensure the availability and development of universal service and the right to universal access.
G- Saudi Domain Names: Any domain name that falls within the Saudi top-level domains (commonly referred to as a domain name).
H- National Frequency Spectrum Register: The register prepared by the Authority based on Article (14) of the Law.
I- Collective Complaint: A complaint submitted by a person acting as an agent for a group of users, in accordance with the provisions set forth in this Regulation.
J- Price Tariff (Tariff): The fee imposed by the service provider for providing telecommunications and information technology services or related telecommunications facilities to the user, in accordance with the features, terms, and conditions associated with it.
K- Preferential Tariff: The tariff designated for entities specified by the Authority, distinguished by prices and services that are superior to their counterparts.
L- General Class License Authorization: The service authorization issued by the Authority to allow the provision of specific telecommunications and information technology services under the general class license.
The Authority may request the service provider to provide its electronic systems or terminal devices for the sites, systems, and devices specified by the Authority, and to connect them in the manner and for the durations determined by the Authority.
1- The regulatory decisions referred to in the law are those issued by the Authority that include rules, provisions, requirements, conditions, procedures, controls, or standards, which are issued by the Council or by those authorized by it, or directive decisions or binding orders regarding a dispute, situation, or incident; with the aim of complying with the practice of a specific activity or refraining from it, or any regulatory decisions, or organizational policies, or any other regulatory framework issued by the Authority that has binding rules; with the aim of organizing a matter related to it.
2- The Authority takes into account the objectives of the law and its executive regulations when issuing regulatory decisions and exercising its regulatory and supervisory powers.
Without prejudice to the relevant regulations and decisions - in cases where there is no specific text that defines a certain means of publication - the decisions issued by the authority that require publication are considered published in any of the following cases:
1- Publication on the authority's website on the internet.
2- Publication in the Official Gazette.
1- The Council classifies licenses, registrations, and permits related to the telecommunications and information technology sector, and establishes the terms and conditions specific to each category, taking into account clarity and comprehensiveness, and ensuring that the classification includes the following:
A- Identifying the telecommunications and information technology markets available for each classification in the sector.
B- The conditions and requirements for obtaining a license, registration, permit, or any other regulatory tools.
2- The Council may set a maximum limit on the number of licenses, registrations, or permits issued by the Authority in specific markets within the sector.
Cases in which the authority may refuse the application for the renewal of the License, registration, permit, or any other regulatory instruments, or cancel, suspend, or amend any of them include the following:
1- Breach of any condition of the License, registration, permit, or any other regulatory instruments.
2- Failure to pay the financial fee for the License, registration, permit, or any other regulatory instruments, based on the provisions of the Law.
3- Not engaging in the activity for a period of (12) twelve months - or more - continuously or intermittently, without a justification accepted by the authority.
4- Engaging in activities that pose a danger to security, the Public interest, or public health.
5- Waiving the License, registration, permit, or any other regulatory instruments, without the authority's approval.
1- The Authority shall consider, when issuing its Decision - based on Article (4) of the Regulation - that it has a positive impact on the telecommunications and information technology sector, without prejudice to what is required by the Public interest and the organization and supervision of the sector.
2- Before issuing the Decision based on Article (4) of the Regulation regarding the service provider, it must be notified in writing of the draft Decision to be taken and its justifications, and granted a period of no less than (15) fifteen days and no more than (30) thirty days from the date of sending the Notice to express its views regarding the Procedure.
3- The Authority shall take the necessary measures to ensure the continuity of service when needed.
