Regulation of the General Transport Center in the City of Makkah Al-Mukarramah and the Holy Sites

Article 1

  • The terms and phrases listed below - wherever they appear in this Regulation - shall have the meanings specified next to each of them unless the context of the text requires otherwise:

    • The Authority: Royal Commission for Makkah City and Holy Sites.

    • The Center: The General Center for Transport in Makkah City and Holy Sites.

    • The Geographical Scope of the Authority: Makkah City and Holy Sites, and any locations outside of these boundaries as determined by the Board of Directors of the Authority that are related to the Authority's objectives, competencies, missions, and the services provided to the guests of Allah, including pilgrims and Umrah performers.

    • The Regulation: The Organizational Regulation of the Center.

    • The Board of Directors: The Board of Directors of the Authority.

    • The Executive Committee: The Executive Committee of the Center.

    • The Chair of the Committee: The Chair of the Executive Committee.

    • Transport: Transport of passengers - including pilgrims and Umrah performers - and goods by various means of transport, excluding air transport, within the geographical scope of the Authority.

    • Means of Transport: All means of transporting passengers and goods, whether motorized such as vehicles, trucks, buses, trains, and metros, or non-motorized such as bicycles and small transport means, as well as any new, smart, or experimental means of transport that may develop the transport system.

    • Transport Routes: All routes used in means of transport, including asphalt roads, railways, mobility paths, and pedestrian walkways and sidewalks for individuals.

    • Transport Facilities: All facilities related to transport routes, such as parking lots, stations, electric charging service locations, and other service locations.

Article 2

  • 1- The center enjoys legal personality and is organizationally linked to the Board of Directors.

  • 2- The administrative and financial regulations, as well as other applicable regulations of the authority, apply to the center.

  • 3- The center performs its duties within the geographical scope of the authority.

Article 3

  • The center aims to enhance the operations and services related to the Transfer, develop its means, mediums, and facilities, and act as a unified umbrella to ensure alignment within the geographical scope of the authority and to coordinate the efforts of the entities operating within it. It also seeks to unify the plans related to various Transfer projects to secure the maximum possible capacity and achieve integration in the sector.

Article 4

  • For the Center to achieve its objectives, it may exercise the following tasks and competencies:

    • 1- Preparing transportation strategies, plans, studies, executive programs, and initiatives related to the competencies and tasks of the Center, implementing them, reviewing what ministries and government agencies prepare in this regard, and evaluating their expected impact on the transport sector within the geographical scope of the General Panel, in a manner that does not conflict with the strategies and plans prepared for transportation at the national level.

    • 2- Defining strategies, business models, and partnerships with the private and non-profit sectors in the field of transportation.

    • 3- Determining the network of internal public transport lines, their routes, and the locations of transport facilities, in agreement with the Transport General Authority and in coordination with the relevant authorities.

    • 4- Specifying the technical specifications, conditions, and safety standards necessary for transport vehicles and means, monitoring them, and obtaining approval from the relevant authorities.

    • 5- Preparing the conditions and procedures for transport activities and means, in agreement with the relevant authorities.

    • 6- Identifying the assets and lands belonging to public transport within the geographical scope, and submitting a request for their allocation according to the procedures approved by the Authority.

    • 7- Determining the financial compensation that the Center receives for the licenses, permits, services it issues, and the mechanisms for its collection after agreement with the Non-Oil Revenues Development Center and the relevant authorities, and submitting to the Board of Directors in the absence of a relevant authority.

    • 8- Determining public transport fares within the geographical scope of the Authority and the mechanisms for their collection in agreement with the Transport General Authority.

    • 9- Coordinating the efforts of the entities concerned with the transport sector by defining roles and responsibilities and directly supervising the implementation of programs and projects related to transport - including programs and projects prior to the establishment of the Center -.

    • 10- Coordinating with the authorities supervising the transport sector outside the geographical scope of the Center regarding the implementation of transportation strategies and plans extending beyond its scope.

    • 11- Supervising the companies and individuals licensed to provide transport services, and working to ensure they provide the best levels of service.

    • 12- Supervising the establishment and maintenance of future transport means located within the geographical scope carried out by the relevant authorities.

    • 13- Developing the necessary programs, mechanisms, and procedures, as well as the motivating ways for private sector participation in achieving the Center's objectives, and providing services and projects and supervising them after their approval by the Authority.

    • 14- Studying and analyzing the impediments facing the services provided in the transport sector, proposing solutions, and supplying them to the relevant authorities.

    • 15- Any tasks and competencies assigned to it by the Board of Directors.

Article 5

  • 1. The center shall have an executive committee chaired by the Chief Executive Officer of the Authority, with representatives from each of the following: Ministry of Interior, Ministry of Hajj and Umrah, Ministry of Transport and Logistic Services, Emirate of the Makkah Region, Transport General Authority, Secretariat of the Holy Capital, Guests of the Rahman Program, and the Chief Executive Officer of the center, provided that the rank of each member is not less than (fourteenth) or its equivalent, and the membership term for the members shall be three years, renewable.

  • 2. The executive committee shall have direct supervision over the works and projects of the center related to its competencies and work to achieve its objectives and perform its tasks as stipulated in Article Four of this Regulation, particularly the following:

    • أ. Approval of strategies, plans, recommendations, programs, and initiatives related to the competencies and tasks of the center, in alignment with the strategies approved by the Authority.

    • ب. Approval and amendment of governance models for the entities related to transport by defining roles and responsibilities to achieve the center's targets.

    • ج. Determining the financial fees that the center charges for the licenses, permits, and services it provides, and the mechanisms for their collection, after agreement with the Non-Oil Revenues Development Center and the relevant authorities.

    • د. Determining public transport fares within the geographical scope of the Authority and the mechanisms for their collection, in agreement with the relevant authorities.

    • ه. Authorizing transport service providers to operate within the center's scope after obtaining the necessary licenses from the Transport General Authority.

    • و. Approval of the internal public transport network lines, their routes, and the locations of transport facilities, and their adoption by the relevant authorities.

    • ز. Approval of projects for the establishment and maintenance of all future transport modes located within the geographical scope.

    • ح. Approval of strategies, business models, and partnerships with the private and non-profit sectors in the field of transport.

    • ط. Approval of the policies and procedures specific to the center and submitting them to the Authority for completion of the approval procedures.

    • ي. Approval of the annual budget project for the center and submitting it to the Authority for completion of the approval procedures.

    • ك. Reviewing the periodic reports submitted by the Chief Executive Officer of the center regarding the progress of the center's work, approving them, and submitting them to the Board of Directors of the Authority.

  • For the purpose of achieving the center's objectives, the executive committee may delegate some of its competencies to the Chief Executive Officer of the center in accordance with the approved procedures and authorities, and it may also form committees or working groups from among its members or others to carry out the tasks assigned to them in the decision of their formation.

Article 6

  • The Executive Committee shall meet at least once every three months, and whenever necessary as determined by the Chair of the Committee, or if requested by at least three of its members. The Chair of the Committee may delegate any member of the Executive Committee to preside over the meetings in their absence. For the meeting to be valid, a majority of the members must be present, including the Chair or their delegate. Decisions shall be made by a majority of the votes of those present, and in the event of a tie, the side that the Chair of the meeting voted for shall prevail.

Article 7

  • The Executive Committee shall have a Secretary, appointed by a decision of the Chairman of the Committee, who shall be responsible for preparing the Committee's meetings, notifying its members of the dates, and preparing its minutes and decisions, in addition to any other tasks assigned to him by the Committee.

Article 8

  • The center shall have a Chief Executive Officer, appointed in accordance with the internal regulations of the authority, who shall be the executive responsible for managing the affairs of the center and shall perform his duties as stipulated in this Regulation. He shall specifically undertake the following tasks, powers, and responsibilities:

    • 1- Reviewing the plans, studies, schemes, and executive programs related to the work of the center prepared by ministries and government agencies within the geographical scope, and assessing their expected impact on the transport sector in the geographical scope, and reporting this to the Executive Committee.

    • 2- Establishing procedures that enable the center to cooperate with research centers, institutions, and specialized consulting firms at both local and international levels, contributing to achieving the objectives for which the center was established.

    • 3- Submitting proposals to the Executive Committee regarding topics and matters within the center's jurisdiction.

    • 4- Following up on the implementation of decisions issued by the Executive Committee, according to the powers assigned to each of them.

    • 5- Supervising the implementation of the center's projects in coordination with all sectors of the authority and all entities operating within the geographical scope.

    • 6- Preparing administrative, financial, and technical policies and procedures specific to the center and submitting them to the Executive Committee.

    • 7- Preparing the annual budget project for the center, which should include project costs in addition to the operational budget and human resources, and submitting it to the Executive Committee.

    • 8- Managing the administrative, financial, and technical affairs of the center and appointing employees and supervising them, in accordance with the regulations set by the authority.

    • 9- Preparing periodic reports related to the workflow in the center and its activities, and the achievements that have been accomplished in accordance with its objectives.

    • 10- Undertaking any other tasks assigned to him by the Executive Committee, according to the powers assigned to each of them.

Article 9

  • The financial resources of the center consist of the following:

    • 1. What is allocated to it in the authority's budget.

    • 2. The financial compensation that the center receives in return for the services it provides after agreement with the Non-Oil Revenue Center.

    • 3. The financial compensation that the center receives in return for the permits and licenses it issues after agreement with the Non-Oil Revenue Center.

    • 4. Any other resource approved by the Board of Directors, provided it does not conflict with the regulations and instructions.

Article 10

  • This regulation shall be published in the official gazette and shall come into effect as of the date of its approval.
