Fundraising Law

Article 1

For the purposes of this Law, the following words and phrases shall have the meanings assigned thereto:

Law: Fundraising Law.

Regulations: Implementing Regulations of the Law.

Center: National Center for Non-Profit Sector.

Fundraising: Receiving cash or in-kind donations through fundraising solicitation or fundraising campaigns.

Fundraising Solicitation: Encouraging natural or legal persons to donate to a specified entity for a particular purpose at a specified time and in accordance with a specified mechanism.

Fundraising Campaign: An organized activity through which solicitation of donations is made.

Licensing Entity: The Center and other agencies entrusted by law with the issuance of fundraising licenses.

Licensed Entity: Civil society associations and organizations and other non-profit entities which are permitted to raise funds by their laws or regulations and are licensed by a licensing entity to do so.

Donor: A natural or legal person that contributes cash or in-kind donations to any licensed entity.

Article 2

1. Fundraising shall be restricted to licensed entities.

2. Persons in charge of raising and disbursing donations at the licensed entity must be of Saudi nationality.

Article 3

A licensed entity may not raise funds except pursuant to the objectives specified in its law or regulations. Donations shall be collected through the following means:

1. The entity’s approved bank accounts, in accordance with the instructions of the Saudi Central Bank.

2. Money transfers through electronic channels and other similar means specified by the Regulations.

3. Checks, provided they are deposited into the entity’s approved bank accounts.

Article 4

A licensed entity may receive in-kind donations through its head office, branches, or other locations where it is licensed to raise funds, provided that donations are documented with receipts with serial numbers, and a copy thereof is delivered to the donor.

Article 5

A licensed entity may not:

1. receive cash donations except through direct deposit into its approved accounts with banks and their branches; and

2. receive donations from outside the Kingdom without the approval of the licensing entity. The Regulations shall determine the mechanism for coordination between the licensing entity and relevant entities in this regard.

Article 6

1. The licensed entity shall, prior to conducting a fundraising campaign, submit an application to the licensing entity which includes the purpose, start date, and duration of the campaign, and the amounts to be raised. The licensing entity shall decide on said application within thirty days from the date of submission thereof.

2. A fundraising campaign shall end upon the expiration of its specified duration or upon raising the target funds, whichever comes first.

Article 7

A licensed entity may not print or publish any materials for the purpose of fundraising solicitation, unless permitted by its law or regulations.

Article 8

A fundraising solicitation shall be made through the following means:

1. Local media outlets.

2. Local telecommunications companies, in accordance with relevant instructions.

3. Advertising signs and utility bills.

4. Publications prepared by the licensed entity, in accordance with its law or regulations.

5. Social media platforms and Internet websites. 6. Any other means specified by the Regulations.

Article 9

A licensed entity shall, when soliciting donations through any of the means provided for in Article 8 of this Law, include in its solicitation the following information:

1. License number.

2. Its approved bank accounts.

3. Address of its head office or branches, and its telephone numbers.

4. The purpose of the fundraising.

Article 10

A licensed entity shall, within fifteen days from the date on which the fundraising campaign ends, provide the licensing entity with a bank statement and a detailed financial report indicating the collected in-kind and cash donations.
