Executive Instructions for the Regulation on Fundraising for Charitable Purposes

Chapter 1: Preliminary Provisions

Article 3

1- The practice of the activity is limited to Saudi establishments after obtaining the License or permit.
2- Individuals who are Saudi may practice the activity after obtaining the License, with an exception from the Council.
 

Chapter 2: License

Article 4

  • First: The following conditions must be met for the establishment to obtain a license to engage in fundraising activities:

    • 1- Fulfillment of the following justifications:

      • a- An application submitted through the approved channels of the center.

      • b- Certificate of registration of the establishment.

      • c- An approved bank account number for the purpose of collecting the donation.

    • 2- A work plan for the fundraising project, approved by the center, detailing the following:

      • a- The purpose of collecting the donation in accordance with the establishment's objectives, its method, and its duration.

      • b- The beneficiary group of the donation.

      • c- The target amount of the donation.

      • d- The method of calculating the cost of managing the donation.

      • e- The mechanism for refunding the donation to the donor.

      • f- The plan for disbursing the donation, its duration, and the mechanism for verifying that the donation reaches the final beneficiary.

      • g- The means of announcing the donation and its cost.

      • h- The policy for redirecting the donation amount to another project.

      • i- Approval from the technical supervising authority for the program or activity for which the fundraising is intended, if required.

  • Second: Individuals must fulfill the conditions stated in item (First) to obtain a license, except for paragraph (1/b), after obtaining the council's approval.

  • Third: The center shall decide on the license application within (30) days in normal cases, and within (15) days in the case of urgent aid. In all cases, the specified period above is calculated from the date of fulfilling the licensing conditions stated in item (First). If the specified period expires without the center expressing its opinion, this shall be considered as approval, and the individual license application mentioned in item (Second) shall be subject to the council's approval.
     

Article 6

In accordance with the provisions of Article (4), the license shall be renewed upon the request of the licensee for a similar duration, provided that the request is submitted at least thirty (30) days prior to the expiration date of the license, and all conditions stipulated therein are fulfilled.
 

Article 8

The entity that is permitted by its system or regulations to receive donations must submit a request to the center for a permit that specifies (the donor entity/person, the value of the donation - if possible-).
