Implementing Regulation for Electronic Publishing Activity

Article 1: Definitions

The following terms, wherever mentioned in this Regulation, shall have the meanings indicated next to them:
1. Electronic Publishing: The use of modern technological means to broadcast, send, receive, transfer, or store written, visual, and audio materials; whether static or moving, for the purpose of public circulation.
2. Electronic Content: Textual, audio, and visual materials, whether static or moving and of any kind, that are prepared and produced or previously prepared, updated, and circulated or transferred through electronic means, or any type of the aforementioned materials that have been converted electronically and are published and accessed through the Internet or various communication networks.
3. Electronic Application: A program that can be accessed and used via the Internet to create, copy, display, and process electronic data.
4. Social Media: A collection of internet applications through which content of all forms can be created and exchanged.
5. Electronic Newspaper: An electronic site with a fixed address that provides journalistic publishing services on the network (sites that publish news, reports, investigations, articles, etc.) issued at regular or irregular intervals.
6. Responsible Manager: The natural person appointed by the site owner who is responsible for the site's content before judicial and administrative authorities.
7. Forum: An electronic site with a fixed address that allows its members to raise various topics and interact with each other through procedures defined by the person responsible for it.
8. Blog: An internet application consisting of memos, articles, diaries, personal experiences, or descriptions of events, etc., through text, audio, or image, with the possibility of interaction through comments.
9. Electronic Advertisement: Providing advertising publishing services through various electronic means.

10. Broadcasting via mobile phone or other electronic means (messages, news, advertisements, images, etc.) and broadcasting on mobile phones for short messages via the (SMS) and (MMS) services and others, whether they are news, advertisements, images, or otherwise.
11. Personal Website: A site created by an individual to display their biography, interests, and to enable them to communicate with friends and those with shared interests.
12. Mailing Lists: A site that provides communication services via email among a group of individuals; aimed at disseminating information and interacting among them.
13. Electronic Archive: Sites that provide documentary information.
14. Chat Rooms: An internet application that allows communication between two or more people via text, audio, image, or all of them together.
15. Person: Any user with a natural or legal status.
16. Electronic Address: The letters, numbers, and symbols used to indicate a location on the Internet, enabling the browser to access it.
17. Electronic News Agency: An electronic site with a fixed address that provides readable, audible, and visual journalistic publishing services on the network, dedicating all or some of its pages to subscribing institutions and individuals for a specified monthly or annual fee, without allowing non-subscribers to view the same pages designated for subscribers.
18. Electronic Publishing House: An entity that undertakes the issuance of any scientific, cultural, or artistic production in electronic format for the purpose of circulation.
19. License: Permission granted by the Ministry of Media to engage in electronic publishing activities.
20. Registration: The entry of electronic publishing activities in a special register of the Ministry of Media.
21. Blocking: The partial or total closure of the electronic site link.
22. Stopping Messages: Temporary or permanent suspension of the short message service.
23. Committees: The primary committees to consider violations of the Printing and Publishing Law, and the Appeals Committee.
24. Relevant Administration: The Electronic Publishing Administration in Internal Media.
25. Law: The Printing and Publishing Law.
26. Regulation: The Electronic Publishing Regulation.
27. Ministry: The Ministry of Media.
28. Minister: The Minister of Media.

Article 2: Objectives of the Regulation

The objectives of this Regulation are as follows:
1. To support purposeful electronic media by instilling professional values.
2. To regulate the practice of electronic publishing in the Kingdom.
3. To protect the community from incorrect practices in electronic publishing.
4. To clarify the rights and duties of employees in electronic publishing.
5. To safeguard the rights of individuals in creating and registering any form of electronic publishing.
6. To protect the rights of individuals to file a lawsuit with the relevant administration in case of a complaint.
7. To support and sponsor the Ministry for websites and their employees by providing facilities that assist them in performing their work.
8. To promote a culture of dialogue and diversity, and to entrench a culture of human rights; represented in the freedom of expression guaranteed to all in accordance with the provisions of the law.
9. To disseminate the culture of new media and its means within the community.

Article 3: Forms of Electronic Publication

The forms of electronic publishing subject to the provisions of the Law and this Regulation include the following:
1. Electronic journalism.
2. Electronic news agency.
3. Electronic publishing house.
4. Social media.
5. Electronic application.
6. Forums.
7. Blogs.
8. Electronic advertisements.
9. Broadcasting via mobile phone or other electronic means (messages - news - advertisements - images, etc.).
10. Personal websites.
11. Mailing lists.
12. Electronic archive.
13. Chat rooms.
14. Any new form of electronic publishing that the Ministry deems appropriate to add.

Article 4

The activity of electronic publishing in all its current or newly developed forms is subject to the provisions of the Printing and Publishing System and this Regulation.

Article 5: Forms of Electronic Publication that are Authorized

1. Electronic Press.
2. Electronic News Agency.
3. Electronic Publishing House.
4. Broadcasting via mobile phone or other electronic means (messages - news - advertisements - images, etc.).

Article 6: Forms of Electronic Publication That Can Be Registered

1. Forums.
2. Social media sites.
3. Blogs.
4. Electronic announcements.
5. Personal websites.
6. Mailing lists.
7. Electronic archives.
8. Chat rooms.
9. Websites of government entities, educational institutions, research institutions, scientific associations, and literary, cultural, and sports clubs.

Article 7: License

First: License Conditions
Subject to the requirements of the laws and agreements, it is required that a person or more wishing to obtain a License to practice electronic publishing activities mentioned in Article Five of this Regulation must meet the following conditions:
1. Must be a Saudi national.
2. Must be at least 25 years old.
3. Must not be a government employee.
4. Must have a good reputation and conduct.
5. Must hold a university degree or its equivalent.
6. In the case of companies, the above conditions apply to their representatives.
7. Attach the company's articles of incorporation.
Second: Conditions for the Editor-in-Chief
Electronic newspapers, when applying for a license, define the responsible editor-in-chief and provide three names to the Ministry according to the following conditions:
1. Must be a Saudi national.
2. Must be at least 30 years old.
3. Must have a good reputation and conduct.
4. Must hold a university degree or its equivalent or have diverse media experience of no less than (5) years.
5. News agencies and electronic publishing houses must specify the responsible manager for the activity when applying for the license.
6. The Minister has the right to exempt from these conditions for justifiable reasons he deems appropriate.

Third: Upon the Ministry's approval of the application, the applicant is granted a preliminary approval to complete the licensing procedures, taking into account the following:
1. Attach a commercial registration for the electronic activity.
2. Attach a municipal license.
3. Attach a lease contract for the activity location.
4. Specify his national address (Wasel) and mobile number.
5. Provide proof of ownership of the domain for the electronic activity.
Fourth: License Duration and Renewal Period:
1. The duration of the License to practice electronic publishing activities mentioned in Article Five of this Regulation is one year, and the renewal is for a similar period or periods according to the conditions stated in the Law and this Regulation.
2. License holders must initiate the renewal process at least three months before its expiration, and they are not entitled to practice the activity from the date of expiration of the License without renewal.
Fifth: Licenses to practice electronic publishing activities mentioned in Article Five of this Regulation are issued by the Electronic Publishing Administration at the Ministry.

Article 8: Registration

First: Registration Conditions
The following conditions must be met by anyone wishing to register their website as stated in Article Six of this Regulation:
1. Must be a Saudi national or a resident in the Kingdom in a legal manner.
2. Must hold a high school diploma or its equivalent.
3. Must be at least 25 years old.
4. The applicant for registration must have a specific email address that matches the domain name.
Second: Registration Duration and Renewal Period
The registration period for engaging in electronic publishing activities mentioned in Article Six of this Regulation is one year, and the renewal shall be for a similar duration or durations in accordance with the conditions stated in the Law and this Regulation.
Third: Electronic publishing sites mentioned in Article Six of this Regulation are registered with the Electronic Publishing Administration at the Ministry.

Article 9

The license holder, or the person who registered their website, is obligated to update their information with the relevant administration within a maximum period of one month in the event of suspending their activity, merging, adding a new activity, changing their address, changing the name of their website, or updating the host's data, if any changes occur, or changing the editor-in-chief, their deputy, or the content manager.

Article 10: Waiver of License or Registration

The person granted the license or registration may transfer it to another, subject to the following conditions:
1. Submission of a request to the ministry.
2. Completion of the specific forms for this purpose with the relevant administration.
3. The fulfillment of the license or registration conditions stated in Article Seven and Article Eight of this regulation by the transferee.
