Implementing Regulation of the Law of Printed Materials and Publication

Article 1: Definitions

The following words and phrases, wherever they appear in the provisions of the Regulation, indicate the meanings specified alongside them:
1. Circulation: Making printed information materials accessible to a number of individuals by distributing them, offering them for sale, posting them on walls, displaying them in shop windows, or on electronic billboards, or road signs. Audio or visual recordings, or loading compact discs or electronic chips with information are considered methods of circulation.
2. The Printer: The person responsible for the printing press, whether the owner or a representative.
3. Computer Programs: All information storage devices loaded with information, whether they are programs, chips, games, memory, or similar items, and their contents are displayed through an electronic device that reads information.
4. Information Materials: All forms of printed materials, whether written (books and newspapers), audio, films, images, artworks, computer programs, audio and visual compact discs, microfilm, e-books, and other current or newly developed information storage devices.
5. The Director: Any person appointed by the owner of the establishment and approved by the Ministry to serve as its director.
6. The Producer: Refers to the licensed individual for producing audio recordings, audiovisual recordings, or computer programs and games.
7. Ministry Inspectors: Ministry inspectors assigned to conduct inspection tours of media establishments wherever these establishments are found, and they possess cards that authorize them to carry out these tasks.
8. The Committee: A specialized committee to consider violations of the Law and this Regulation.
9. The Law: The Law on Printing and Publishing.
10. The Regulation: The Implementing Regulation of the Law on Printing and Publishing.
11. The General Directorate of Printing: The department within the Ministry responsible for overseeing the implementation of the Law and this Regulation on media activities and monitoring publications, with branches in major cities and all entrances to the Kingdom.

Chapter 1: Conditions and Regulations for Media Licenses

Article 2: Description of the activities subject to the provisions of the Law and this Regulation.

Article Two of the Law specifies the activities for which the Ministry grants the necessary license for each, detailed as follows:
1- Publications: Any intellectual output in the literary, scientific, and artistic fields, regardless of the method or form of expression, and presented for circulation in written form (newspapers, magazines, or books) or drawn, illustrated, or in audio or visual materials, films, computer programs, or other information carriers.
2- Pre-printing preparation services: Engaging in services related to typesetting, color separation, design, or layout for materials prepared for printing.
3- Printing presses: This includes engaging in printing in one of the following activities:
 A. Mechanical printing of words, images, and drawings on paper, fabric, or similar materials.
B. Printing of audio recordings, video tapes, and films.
C. Printing of discs and loading them with materials.
4- Libraries: Engaging in the activity of displaying and selling or renting newspapers, magazines, books, and educational aids.
5- Drawing and handwriting: Engaging in activities related to writing in various styles, whether ordinary or neon, and writing and manufacturing advertising and promotional boards, as well as engaging in drawing, displaying, and selling artworks in all their forms, with the preparation of seals subject to a special license from the Ministry.
6- Photography: Engaging in activities related to regular or colored photography and developing and printing films on paper, fabric, or similar materials.
7- Importing films and video tapes or renting them, which includes:
 A. Importing films and video tapes: Engaging in the activity of importing audiovisual works of various types loaded on any form of carriers.
B. Shops for selling and renting films and video tapes: Engaging in the activity of selling and renting films and video tapes or discs loaded with religious, cultural, artistic, theatrical, series, musical, or sports materials, or children's programs (cartoons) and others of various types, whether these recordings are imported from abroad or produced domestically.
8- Audio recordings and discs: Engaging in one of the activities related to selling cassette tapes and audio discs as follows:
 A. Selling cassette tapes and discs recorded with religious, cultural, or scientific materials.
B. Selling cassette tapes and discs recorded with artistic or musical materials.
9- Artistic production for radio, television, cinema, or theater: Engaging in the activity of producing audio or audiovisual materials of various types, including dubbing or translation, and loading them onto audio or visual carriers and preparing them for circulation.
10- Television and radio studios: Engaging in the activity of executing radio and television works in places prepared according to technical specifications, whether these places are fixed or mobile.
11- Offices of foreign media and their correspondents: Engaging in the activity of providing foreign media - written, audio, or visual - with news, investigations, media comments, and images through offices or correspondents accredited by the Ministry.
12- Advertising and promotion: Engaging in activities related to designing and executing commercial, editorial, illustrated, drawn, and spoken advertisements, issuing calendars, planners, commercial and economic guides, service and gift guides, and similar items, as well as preparing and executing marketing campaigns related to goods and services.
13- Public relations: Introducing and promoting the establishment, preparing research, reports, and studies to develop the work of any establishment and improve its image among the public, designing campaigns for that purpose, selecting appropriate phrases for use in advertising and promotion, and engaging in administrative and technical work and providing services to public and private institutions regarding the preparation and qualification of their employees to keep pace with the campaign, and providing services for organizing seminars, conferences, and exhibitions and supervising them in terms of handling any matters related to receiving and bidding farewell to guests, providing accommodation and transportation, accompanying guests, and creating commercial occasions to stimulate marketing such as festivals and temporary exhibitions and preparing invitations for participation in them.
14- Publishing: Engaging in activities related to issuing, preparing, and financing any written production, whether scientific, cultural, or artistic for the purpose of circulation, as well as participating in book fairs.
15- Distribution: Marketing publications of all types, both domestic and foreign, at various distribution points, and participating in book fairs.
16- Press services:
- Acting as a cooperating agent with domestic and foreign media, preparing press releases and providing them.
- Preparing and compiling supporting materials for journalistic investigations from images, data, and documents.
- Preparing files and documentary press reports as special press services.
- Contributing to the preparation, production, classification, design, and editing of newspapers and periodicals issued by public or private institutions or individuals licensed to publish within the Kingdom, or newspapers and periodicals permitted to be printed within the Kingdom.
- Compiling previously published articles or political, economic, religious, or cultural news analyses in newspapers, magazines, and periodicals within the Kingdom and printing them, while respecting the rights related to them for their owners, and distributing them to subscribers.
17- Producing computer programs or selling or renting them:
- Engaging in the preparation, design, and issuance of computer programs and games in all their forms and preparing them for printing.
- Engaging in the display and sale of local and foreign computer programs and renting them under special licenses from the producers of those programs.
18- Media consulting studies:
Engaging in conducting feasibility studies for media activities and projects, providing media consultations to media outlets regarding their impacts and activities, and assessing their effects through field studies and public opinion surveys, as well as preparing studies and research for media campaigns, drawing appropriate plans for them, following up, and evaluating their results.
19- Copying and reproduction:
- Copying: Engaging in the activity of reproducing documents and papers for commercial use.
- Reproduction: Engaging in the activity of reproducing more than one copy of readable publications or images for circulation.

Article 3: Designations of Activities in the Media License

Previous Amendments

The media activities specified in Article (2) of the Law in the License are defined as follows:
 A. Pre-press preparation services: The activity is defined in the license as (Pre-press services activities).
B. Printing houses: The activity is defined in the license as (Computerized printing).
C. Libraries: The activity is defined in the license as: (Retail sale of books of all kinds, or retail sale of used books, or retail sale of stationery, office supplies, newspapers, and magazines (libraries)).
D. Drawing and handwriting: The activity is defined in the license as (Calligraphers' activities).
E. Photography: The activity is defined in the license as (Photography activities).
F. Offices of foreign media and their correspondents: The type of activity is defined according to the request submitted by the media outlet to open an office or appoint a correspondent.
G. Advertising and promotion: The activity is defined in the license as (Advertising and promotion institutions and agencies).
H. Public relations: The activity is defined in the license as (Organizing and managing trade fairs, or organizing and managing meetings and conferences, or organizing and managing events and promoting them).
I. Publishing: The activity is defined in the license as (Publishing printed books).
J. Distribution: The activity is defined in the license as (Wholesale sale of books, magazines, and newspapers).
K. Press services: The activity is defined in the license as (Press services).
L. Production of computer programs or their sale or rental: The activity is defined in the license as (Copying ready-made computer programs (software), or wholesale sale of software, or import activities).
M. Media studies and consultations: The activity is defined in the license as (Media studies and consultation services activities).
N. Copying and reproduction: The activity is defined in the license as: (Copying using office machines, including (photocopiers or thermal "student services").

Article 4: Consideration of Rights

It must be taken into account in the practice of any of the activities mentioned in Article (2) of the Law and this Regulation, that they do not conflict with the Copyright Protection Law.

Article 5: Importance of Media Licensing

 A- No person may engage in any media activity without obtaining a License from the Ministry, and the License issued by the Ministry does not exempt the individual from obtaining the necessary licenses from other government entities as required by applicable laws and regulations.
B- Anyone wishing to permanently cease media activities must return the License to the General Directorate of Publications and obtain a letter from the Ministry to present to the relevant authorities.

Article 6: Duration of the License and Renewal Period

A- The duration of the License to open any of the media establishments for the activities specified in Article Two of the Law and this Regulation is (3) years, and the renewal shall be for a similar duration or durations in accordance with the conditions stated in the Law and this Regulation.
B- License holders must initiate the renewal process at least three months before the expiration date, and they are not entitled to engage in the activity starting from the expiration date of the License without renewing it.
C- A fine of one hundred Riyals shall be imposed for each month that the License holder delays in renewing their License after its expiration, provided that the extension period does not exceed six months unless justified by an excuse accepted by the Ministry, and any part of a month shall be counted as a full month.

Article 7: Licensing Conditions

Previous Amendments
  • The following conditions must be met to grant a license for one of the activities stipulated in the law and this regulation:

  •  A- The license applicant must not be a government employee.

  • B- The applicant must be at least twenty-five years old unless exempted by the Minister.

  • C- Good conduct and behavior.

  • D-

    • 1. The applicant must hold a high school diploma or lower for the following activities:

    • (Pre-printing preparation services, printing presses, libraries, drawing and handwriting, photography, advertising and announcement, public relations, publishing, distribution, production or sale or rental of computer programs, copying and reproduction).

    • 2. For the activity of (press services): The applicant must hold a bachelor's degree.

    • 3. For the activity of (media studies and consultations): The applicant must hold a bachelor's degree with five years of experience in the same field.

  • E- When foreign media offices or their correspondents apply for licenses, the request will be presented to the Minister for approval or disapproval of the license.

  • F- The license holder or the manager must attend in person if the establishment is a company to fill out and sign the required forms.

  • G- The license applicant or the company manager must provide all necessary documents.

  • H- Any other conditions deemed necessary by the Ministry to obtain the license.

  • I- Every licensed establishment by the Ministry must maintain a statement that includes the names of the employees in the establishment, their nationalities, and the type of work each of them performs, and allow Ministry inspectors to review this statement and any documents related to the employees.

  • J. The applicant must hold a commercial registration.

Article 8: Regulations for Licensing to Practice Media Activities Under the Foreign Capital Investment System

Previous Amendments

Those wishing to engage in media activities under the Foreign Capital Investment Law must consider the following:
 A- Obtain a preliminary investment license in the Kingdom in accordance with the Foreign Capital Investment Law.
B- The applicants are subject to all applicable provisions for individuals and eligible entities in conducting the activity regarding compliance with the provisions of the law and this regulation.

C- The ministry has the right to request any documents or papers it deems necessary to review that relate to the project or the license applicants.

Article 9: Presentation of the License

The license is issued by the General Directorate of Publications, specifying the type of activity permitted to be practiced. The license holder is obligated to practice the activity specified in the license and to display it prominently in the licensed establishment.
