Implementing Regulation of the Engineering Professions Practice Law - 1439

Article 1

  • The following words and phrases indicate the meanings specified next to each, unless the context requires otherwise:

    • Law: Law on the Practice of Engineering Professions, issued by Royal Decree No. (M/36) dated 19/4/1438 AH.

    • Regulation: Implementing Regulation of the Law.

    • Ministry: Ministry of Commerce and Investment.

    • Minister: Minister of Commerce and Investment.

    • Authority: Saudi Council of Engineers.

    • Board of Directors: Board of Directors of the Authority.

    • Committee: Professional Accreditation Committee of the Authority.

    • Review Committee: One or more committees to review violations according to the provisions of Article (12) of the Law.

    • Inspector: An employee of the Authority appointed by a decision from the Minister to monitor violations of the provisions of the Law and its Regulation.

    • Engineering Work: Studies, designs, drawings, supervision, implementation, operation, and maintenance in the branches of engineering specialties.

    • Practice of Engineering Professions: Engaging in any engineering work practiced in the branches of engineering specialties.

    • Professional Accreditation: Registration with the Authority and obtaining the professional degree.

    • Professional Degree: The professional degree obtained by the engineer from the Authority upon professional accreditation.

    • Engineer’s Charter: A set of rules that govern the ethics of practicing engineering professions and their behaviors, approved by the Authority.

    • License: The license granted by the Ministry to engineering offices and companies when practicing any of the engineering professions, in accordance with the standards for practicing the profession and the licensing conditions set by the Authority.

 

Article 2

The Board of Directors, in coordination with the Ministry, shall form a Professional Accreditation Committee at the Authority consisting of no less than ten members, whose professional rank is no less than that of a Professional Engineer, ensuring proportional representation of the various categories of engineers. Its decisions shall be issued by a majority vote, and the Committee shall prepare its procedures and be approved by a decision from the Minister.

 

Article 3

  • 1. The categories of professional appropriation consist of the following:

    • A. Engineer: A holder of a bachelor's degree in any of the engineering disciplines from one of the Saudi universities, or its equivalent from a recognized university.

    • B. Specialist: A holder of a bachelor's degree in any of the supporting engineering disciplines from one of the Saudi universities, or its equivalent from a recognized university.

    • C. Technician: A holder of a diploma in any of the supporting engineering disciplines from one of the Saudi universities, or its equivalent from a recognized university.

  • 2. The Board of Directors shall determine, in agreement with the Ministry, the supporting engineering disciplines.

Article 4

  • 1. The professional grades for an engineer consist of the following:

    • A. Engineer. 

    • B. Associate Engineer. 

    • C. Professional Engineer. 

    • D. Consulting Engineer.

  • 2. The Board of Directors shall determine, based on a proposal from the Committee, the requirements for the professional grades for engineers mentioned in paragraph (1) of this article, the duration of professional appropriation and the procedures for its renewal, as well as the financial fees for it, to be reviewed every five years. 

Article 5

The Committee establishes the classification rules for engineering specialties and the conditions and regulations related to the technical ability tests required for each degree, and it is approved by a decision from the Board of Directors.

Article 7

The authority issues the Engineer's Charter, which outlines the rules governing the ethics of practicing engineering professions and their behaviors, which must be adhered to by the professionally certified.

 

Article 8

  • The professional appropriation is revoked in any of the following cases:

    • 1. If the holder of the professional appropriation submits a request for its cancellation.

    • 2. If the holder of the professional appropriation violates any of the conditions of the professional appropriation.

    • 3. If a reasoned decision is issued by the committee reviewing the cancellation of the professional appropriation.

 

Article 9

The Authority issues the standards for the practice of the profession and the licensing conditions for engineering offices and companies.

 

Article 10

  • The license for the office or engineering company is revoked in any of the following cases:

    • 1. If the license holder submits a request for its cancellation.

    • 2. If the license holder violates any of the standards for the practice of the profession and the conditions of the licenses.

    • 3. If a reasoned decision is issued by the review committee to revoke the license.
