Detailed Mechanism for the Regulation of the Rights and Obligations of Public Transport Users

  • Board of Directors Resolution of the Transport General Authority No. (1/9/2023/3) dated 05/03/1445 AH

  • Based on the powers granted to it by law

  • After reviewingthe Regulation on the Rights and Obligations of Public Transport Users, approved by the Council of Ministers Resolution No. (44) dated 14/1/1445 AH.

  • After reviewingthe Statute of the Transport General Authority, issued by the Council of Ministers Resolution No. (323) dated 14/9/1434 AH, and its amendments.

  • After reviewing the recommendation of the Executive Committee No. (1/8/T/2023/3) dated 21/2/1445 AH.

  • After deliberation, the Board decided the following:

    • First: Approval of the detailed mechanism for the Regulation on the Rights and Obligations of Public Transport Usersand the schedule for classification of violations and finesin the attached form.

    • Second: The effective date of the Regulation on the Rights and Obligations of Public Transport Users, the detailed mechanism of the Regulation, and the schedule for classification of violations and fines shall be thirty (30) days from the date of publication of the detailed mechanism and the schedule for classification of violations and fines in the Official Gazette.

    • Third: The Authority shall follow up on the implementation of the Regulation on the Rights and Obligations of Public Transport Users and the detailed mechanism, and submit to the Board a quarterly report on the application of the Regulation and the mechanism and any amendments it deems appropriate.

Chapter 1: General Provisions

Article (1): Scope of Application

  • 1- The provisions of this mechanism apply to users of public transport activities when provided on the territory of the Kingdom and to other countries by a licensed transport company authorized to conduct the activity.

  • 2- This mechanism applies to the loss or damage of luggage that occurs when the passenger is inside the means of transport or is about to exit or enter it, and to luggage that is on board the means of transport or that occurs during loading or unloading.

  • 3- The application of this mechanism does not affect the implementation of any of the requirements and obligations stipulated in the laws, regulations, and agreements in force in the Kingdom.

Article 3: Assistance and Empowerment of Persons with Disabilities and Individuals with Limited Mobility to Utilize Transportation Activities

  • 1. Passengers with disabilities and limited mobility, along with their companions - if any - have the right to benefit from transportation services and any exemptions or discounts determined by the authority on ticket prices designated for persons with disabilities and limited mobility and their companions, in accordance with the fare-setting policy for the use of public transport issued by the authority, and to not pay any additional fare for using the service.

  • 2. The carrier and the infrastructure manager must provide all essential information related to the journey and the terms of transport in accessible formats that are easy for persons with disabilities and limited mobility to access.

  • 3. A passenger with a disability or limited mobility may request assistance from the employees of the carrier or the infrastructure manager to board or alight from the means of transport, and these employees are required to provide assistance and fulfill the request.

  • 4. The carrier must make available the reservation of two adjacent seats, one for the person with a disability or limited mobility and the other for the accompanying person - if any -.

Article 4: The Right to Access Information

  • 1. Passengers must be provided with clear information regarding their rights as stipulated in this mechanism, at public transport stations and facilities, and wherever necessary, including electronic platforms, ensuring easy access for individuals with disabilities and those with limited mobility. It should include details on how to file complaints, the entities responsible for handling them, and the mechanism for processing them.

  • 2. The carrier is obligated to use a summary of the provisions of the regulation and the detailed mechanism and make it available to passengers, which includes the minimum information contained in Appurtenance No. (2) titled: Basic Mobility Information; in addition to any other information deemed necessary by the authority, and it should be available in the languages specified by the authority.

Article 5: Accompanying Luggage and Animals

  • 1. Passengers are allowed to bring their personal luggage or any other items they can carry themselves on board the vehicle, and place them in designated areas - if available - provided that they do not pose a risk to the safety and security of others or obstruct movement and operational safety in accordance with the conditions applicable to the carrier.

  • 2. Passengers with visual impairments are permitted to bring certified service animals on board the vehicle, provided that they do not pose a risk to others or obstruct movement and operational safety. In case of refusal, the carrier must inform the concerned individual of the availability of any alternative service that meets their needs.

  • 3. Passengers are allowed to bring their small pets, provided they are placed in a carrier or designated areas for their transport; and that they do not pose a risk to others or obstruct movement and operational safety.

  • 4. The carrier must prepare a list of prohibited items, have it approved by the authority, and publish and announce it on board the vehicle, at ticket sales centers, and through smart applications wherever possible.

  • 5. The carrier may inspect unchecked hand luggage and empty its contents when necessary for security and safety purposes.

  • 6. The carrier shall not be liable for the loss, damage, or destruction of luggage that is in the possession of the passenger or for any deficiency or defect therein unless proven otherwise.

  • 7. The carrier must maintain accurate records of all items lost by passengers or found by the carrier or handed over to them as lost property on board the trip in a dedicated database, which the passenger can request access to.

  • 8. If a passenger dies or suffers a medical emergency during the trip, the carrier is obligated to seek assistance and support from emergency service teams and take necessary measures to provide aid on board the vehicle, and to safeguard their luggage and belongings until they are handed over to their relatives or to the police.
