Regulations on Rights and Obligations of Users of Public Transport

  • After reviewing in its session chaired by the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud, the correspondence received from the Royal Court No. 35124 dated 17/5/1444 AH, including the letter of His Excellency the Minister of Transport and Logistic Services, Chairman of the Board of Directors of the Transport General Authority No. 7466 dated 13/8/1443 AH, regarding the draft regulation on the rights and obligations of public transport users.

  • After reviewing the aforementioned draft regulation.

  • After reviewing theRegulation on the Preservation of Public Decencyissued by Council of Ministers Decision No. (444) dated 4/8/1440 AH.

  • After reviewing memoranda No. (2899) dated 29/12/1443 AH, No. (1983) dated 29/6/1444 AH, No. (2722) dated 8/9/1444 AH, and No. (3725) dated 2/12/1444 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • After reviewing the recommendation prepared by the Council of Economic and Development Affairs No. (17-28/44/D) dated 18/7/1444 AH.

  • After considering the Shura Council decision No. (74/12) dated 4/5/1444 AH.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (13281) dated 29/12/1444 AH.

  • It is decided as follows:

    • First: Approval of the regulation on the rights and obligations of public transport users, according to the attached text.

    • Second: The Transport General Authority shall undertake the following:

      • 1- To take into account theRegulation on the Preservation of Public Decencyissued by Council of Ministers Decision No. (444) dated 4/8/1440 AH, and the procedures for controlling its violations, and the powers of the concerned authorities in this regard, when applying the regulation referred to in item (First) of this decision.

      • 2- To review the regulation - referred to in item (First) of this decision - after one year of its implementation, and to submit any proposals it deems appropriate regarding it, if any.

Article 1

  • In these Regulations, the following words and phrases shall have the meanings assigned thereto, unless the context requires otherwise:

    • Kingdom: Kingdom of Saudi Arabia.

    • Authority: Transport General Authority. Board: Board of Directors of the Authority. President: President of the Authority.

    • Regulations: Regulations on Rights and Obligations of Users of Public Transport and their detailed rules. Public Transport: Regular passenger transport that is available to the public for a fee by means of transport within and between the cities of the Kingdom and to other countries, excluding air transport. Public Transport Activities: Any of the following activities:

      • - Land Transport: Public transport of passengers by buses or other means specified by the Authority.

      • - Railway Transport: Transport of passengers by railway, whether within cities by light means of transport, such as trams and the metro, or between cities and on international lines by express trains and automated people movers.

      • - Maritime Transport: Transport of passengers within the territorial waters of the Kingdom or from the Kingdom to other countries by water buses, ferries, and passenger ships.

    • Service: Any public transport service.

    • Transport Facilities: Facilities, systems, and programs necessary for engaging in public transport activities and providing the service, including arrival and departure stations for all means of public transport.

    • Carrier: An entity licensed by the Authority to engage in public transport activities and to provide the service. Means of Transport: Means of transport licensed to provide the service, such as vehicles, buses, trains, marine vessels, and the like.

    • Passenger: A customer who contracts with a carrier to obtain the service. Employees: Any of the employees of the Authority, the carrier, or the entity in charge of transport facilities, or the employees working under the supervision thereof.

    • Third Party: A person who frequents transport facilities or means of transport other than passengers or employees.

    • Person with Limited Mobility: Any person other than persons with disabilities who suffers an injury or a temporary condition that prevents him from walking without the assistance of other persons or mobility equipment.

    • Person with a Disability: Any person who has a long-term physical, mental, Regulations on Rights and Obligations of Users of Public Transport 2 intellectual, sensory, or psychological disorder or impairment that may prevent him from fully and effectively participating in society on an equal basis with others.

    • Fare: An amount paid for the service.

    • Mobility Equipment: Any means or tool specifically designed to assist persons with disabilities or with limited mobility in their movement, including electrically powered or manual wheelchairs, walking aids, crutches, and the like.

    • Service Animal: Any pet trained to accompany and serve persons with disabilities that can guide or alert people with hearing and visual impairments, move mobility equipment, and retrieve fallen items, in addition to other services that a service animal can perform.

    • User-Friendly or Accessible Vehicles: Any vehicle equipped with means that allow persons in wheelchairs to use their wheelchairs and enable said persons to move on board.

Article 2

  • The service shall be provided when requested without discrimination.

Article 3

  • A passenger under the age of 13 may not be offered the service to travel alone between cities, and a passenger under the age of eight may not be offered the service to travel alone within a city.

Article 4

  • Parents and guardians shall be responsible for the behavior of their minor children and those under their guardianship.

Article 5

  • The carrier shall equip the means of transport specified by the Authority with the tools and equipment necessary to serve persons with disabilities and with limited mobility.

Article 6

  • Each person with a disability or with limited mobility is entitled to receive the service, and he may not be denied such service except in the following two cases:

    • 1. If the denial is due to health and safety requirements as determined by the Authority.

    • 2. If the service cannot be provided because the means of transport or transport facilities cannot meet the requirements of the person with a disability or with limited mobility. If, in such cases, an alternative service that meets the needs of the person with a disability or with limited mobility is available, he shall be informed thereof.

  • The passenger shall comply with the following:

    • 1. Paying the transport fare, and complying with these Regulations as well as the carrier's instructions and policy regarding the service.

    • 2. Adhering to the itinerary specified in the ticket and deboarding at the designated station.

    • 3. Maintaining decorum in means of transport and transport facilities, in accordance with relevant legal provisions and the terms and conditions set by the Authority and the carrier.

    • 4. Giving priority to the elderly, pregnant women, children, and ill persons.

    • 5. Refraining from tampering with means of transport and transport facilities or using them for purposes other than those for which they are intended.

    • 6. Refraining from carrying items or baggage that violate the carrier's policy and the conditions set by the Authority.

    • 7. Refraining from carrying any hazardous or prohibited items and any items that pose a risk to the means of transport, transport facilities, or the lives of others.

    • 8. Refraining from using safety and protection equipment except in cases requiring such use.

    • 9. Delivering lost items immediately to the carrier or the entity in charge of the transport facilities.

    • 10. Reporting any property lost during the trip.

    • 11. Complying with the carrier's policy when carrying pets permitted in the means of transport and its facilities.
