Ministerial Decision No. (2000) for the year 1435H

  • The Minister of Interior, based on the powers granted under Article One Hundred and Twelve of the Law of Criminal Procedure issued by Royal Decree No. (M/2) dated 22/1/1435 AH, which states that (the Minister of Interior - based on the recommendation of the President of the General Investigation and Prosecution Authority - shall determine what constitutes major crimes warranting detention, and this shall be published in the Official Gazette).
    After reviewing the recommendation of the President of the General Investigation and Prosecution Authority.

  • The following is decided:

    • First:The major crimes warranting detention are:
      1- Hudud crimes punishable by death or amputation.
      2- Crimes of intentional or quasi-intentional murder.
      3- Terrorism crimes, financing terrorism, and crimes undermining national security.
      4- Crimes punishable by imprisonment with a maximum term exceeding two years as stipulated in the following laws:

      • A- Law of Combating Narcotics and Psychotropic Substances.
        B- Law of Weapons and Ammunition.
        C- Penal Code for Money Counterfeiting and Imitation.
        D- Penal Code for Forgery Offenses.
        E- Anti-Bribery Law.
        F- Penal Law of Impersonating Public Officers.
        G- Anti-Money Laundering Law.
        H- Anti-Cyber Crime Law.
        I- Electronic Transactions Law.
        J- Law of Explosives and Fireworks.
        K- Anti-Trafficking in Persons Law.
        L- Environmental Law.
        M- Law for the Implementation of the Convention on the Prohibition of the Development, Production, Stockpiling, and Use of Chemical Weapons and Their Destruction.
        N- Law of Import and Management of Chemical Materials.
        O- Acts stipulated in paragraphs (2,3,4,5,7) of Article Thirty-Two of the Law of Fertilization, Utero-Fetal and Infertility Treatment Units, if the Review Committee of this law deems the act warrants imprisonment.
        P- Law of Imprisonment and Detention.

    • 5- Any crime for which a special provision in the law states that it is a major crime warranting detention.
      6- Acts stipulated in Article (118) as amended of the Law of Commercial Papers, unless the drawer of the check pays its value, or in case of settlement or waiver between the parties.
      7- Embezzlement of public funds, or funds of entities with public legal personality, or companies or institutions that manage and operate public utilities or provide public services, or funds of joint-stock companies or companies in which the state participates in the capital, or banks or companies or individual institutions engaged in banking activities, unless the embezzled amount is returned.
      8- Financial fraud cases, unless private rights are settled.
      9- Intentional assault causing bodily harm less than death, or disabling a benefit or part of it, or injury with a healing period exceeding fifteen days, unless the private right holder waives the right.
      10- Intentional assault on public or private funds or properties by any means of destruction with damage value exceeding five thousand riyals, unless the damage value is paid or the private right holder waives the right.
      11- Assault on one of the parents by beating unless a waiver is obtained.
      12- Violation of the sanctity of homes by entering them with intent to assault the person, honor, or property.
      13- Non-Hudud theft committed by more than one person.
      14- Car theft.
      15- Pimping or preparing places for prostitution.
      16- Manufacturing, promoting, smuggling, or possessing intoxicants with intent to promote.
      17- Traffic accidents while driving under the influence of intoxicants, narcotics, or psychotropic substances, drifting, driving against the traffic direction, or running a red traffic light, if resulting in death, loss of a limb, disabling a benefit or part of it, or injury with a healing period exceeding fifteen days.
      18- Assault on a public officer during the performance of his duties, or damaging his official vehicle or equipment used.
      19- Use or brandishing of a firearm with intent to assault or threaten.
      20- Extortion crimes, violation of privacy by photographing, publishing, or threatening to publish.

  • Second:The President of the General Investigation and Prosecution Authority - based on a reasoned recommendation from the investigator handling the case and endorsement by the head of the department - may approve the release of the accused in the crimes stipulated in paragraphs (12, 13, 14, 15, 16, 17, 18, 19, 20) of this decision.
    Third:This decision shall be communicated to whom it may concern for implementation, and it shall replace our decisions No. 1900 dated 9/7/1428 AH, No. 1900 dated 24/5/1431 AH, and No. 2000 dated 3/6/1431 AH, and shall be effective thirty days after its publication in the Official Gazette.
