Decision No. (1900) for the year 1428

  • The Minister of Interior, based on the powers granted to him under Article Twelve of the Implementing Regulations of the Law of Criminal Procedure, which states that "the Minister of Interior shall determine - based on the recommendation of the President of the General Investigation and Prosecution Authority - what constitutes major crimes warranting detention."

  • After reviewing the presentation of the President of the General Investigation and Prosecution Authority.

  • Decides the following:

  • First:The major crimes warranting detention are:

    • 1- Hudud punishable by death or amputation.
      2- Intentional murder or quasi-intentional murder.
      3- Terrorism crimes and crimes undermining state security.
      4- Cases involving narcotics and psychotropic substances, or weapons and ammunition, or counterfeiting or imitation of currency, or forgery, or bribery, or impersonation of an officer enforcement law, or money laundering, any of which is punishable by a system-imposed imprisonment exceeding two years.
      5- Car theft.
      6- Pimping or preparing places for prostitution.
      7- Promotion of intoxicants, or intent to promote in cases of smuggling, manufacturing, or possession.
      8- Embezzlement of government funds, or funds of joint-stock companies, banks, or financial institutions unless the embezzled amount is returned.
      9- Intentional assault causing injury less than death resulting in loss of a member, or disabling a function or part of it, or an injury with a recovery period exceeding fifteen days, unless the private right holder waives the right.
      10- Intentional assault on public or private funds or properties by any means of destruction with damage value exceeding five thousand riyals, unless the private right holder waives the right.
      11- Assault on a security officer while performing his duties, or damaging his official vehicle, or the equipment he uses.
      12- Use or brandishing of a firearm with the intent to assault or threaten.
      13- Violation of the sanctity of homes by entering with the intent to assault the person, honor, or property.
      14- Violation of honor by photographing and publishing or threatening to publish.
      15- Assault on one of the parents by beating unless a waiver is obtained.

  • Second:This decision shall be communicated to those concerned for implementation and shall be effective as of 1/8/1428 AH.
    It shall be considered a repeal of our decision No. 1245 dated 23/7/1423 AH.
