The Public Prosecutor, based on the powers granted to him under Article (112) of the Law of Criminal Procedure amended by Royal Decree No. (M/125) dated 1441/9/14 AH, which states "The Public Prosecutor - after agreement with the Ministry of Interior and the Presidency of State Security - shall determine what constitutes major crimes requiring detention and publish that in the Official Gazette," and after agreement with the Ministry of Interior and the Presidency of State Security.
decides the following:First:The major crimes requiring detention are:
1- Hud crimes punishable by death or amputation.
2- Crimes of intentional or quasi-intentional murder.
3- Crimes that undermine national security.
4- Crimes punishable by law with imprisonment for a period exceeding three years.
5- Any crime for which a special provision in the law states that it is a major crime requiring detention.
6- Acts stipulated in Article (118) of the Law of Commercial Papers, amended by Royal Decree No. (M/45) dated 1409/9/12 AH, unless the drawer of the check pays its value, or in the case of settlement or waiver between the parties.
7- Embezzlement of public funds, or funds of entities with public legal personality, or companies or institutions that manage and operate public utilities or provide public services, or funds of joint-stock companies or companies in which the state participates in the capital, or banks or companies or individual institutions engaged in banking activities, unless the embezzled amount is returned.
8- Financial fraud cases where the total amount exceeds (20,000) twenty thousand riyals, unless the private right has expired.
9- Intentional assault on anything less than the person if it results in the loss of a limb, or disabling a benefit or part of it, or an injury with a healing period exceeding twenty-one days, unless the private right holder waives.
10- Intentional assault on public or private funds or properties by any means of destruction where the value of the damage exceeds (20,000) twenty thousand riyals, unless the value of the damage is paid or the private right holder waives.
11- Assault on one of the parents by beating unless the private right holder waives.
12- Violation of the sanctity of homes by entering them with the intent to assault the person, honor, or property unless the private right holder waives.
13- Non-Hud theft committed by a gang formation.
14- Looting of funds unless the private right holder waives.
15- Car theft unless the private right holder waives.
16- Pimping or preparing places for prostitution.
17- Selling, manufacturing, smuggling, or possessing intoxicants with the intent to promote or trade.
18- Smuggling, bringing, receiving, or cultivating qat plants with the intent to promote or trade.
19- Traffic accidents occurring while driving under the influence of intoxicants, drugs, or mental effect, or during drifting, or driving in the opposite direction of traffic, or running a red traffic light, or exceeding the speed limit that endangers public safety as specified in Article (74) of the Implementing Regulation of the Traffic Law issued by Ministerial Decision No. (2249) dated 1441/3/10 AH, if resulting in death, loss of a limb, disabling a benefit or part of it, or injury with a healing period exceeding twenty-one days.
20- Intentional assault on a security officer by beating while performing his duties, or intentionally causing damage to his official vehicle or equipment used.
21- Firing a firearm in public places or events.
22- Firing or brandishing a firearm with the intent to assault or threaten unless the private right holder waives.
23- Extortion crimes.
24- Kidnapping or detention crimes with the intent to assault the person, honor, or property.
25- Commercial fraud crimes if the counterfeit product or materials used in the fraud are harmful to human or animal health or affect their safety.
26- All criminal descriptions related to methamphetamine (shabu) are considered major crimes requiring detention.
Second:Except for paragraph (5) of item (First) of this decision, the Public Prosecutor has the authority to release detainees in the crimes listed in this decision.
Third:In case of dispute in interpreting this decision, the Public Prosecutor's interpretation shall prevail, and he may issue an explanatory memorandum.
Fourth:This decision shall be implemented as of the date of its publication in the Official Gazette.
