    • After reviewing in its session held under the chairmanship of the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud, the correspondence received from the Royal Court No. 22560 dated 28/3/1444 AH, including the telegram of His Excellency the Minister of Human Resources and Social Development, Chairman of the Board of Directors of the Authority for Persons with Disabilities No. 75091 dated 14/4/1441 AH, regarding the draft Law of the Rights of Persons with Disabilities.

    • After reviewing the aforementioned draft law.

    • After reviewing theDisability Welfare Lawissued by Royal Decree No. (M/37) dated 23/9/1421 AH.

    • After reviewing the minutes No. (760) dated 4/8/1437 AH, No. (40) dated 12/1/1439 AH, No. (1065) dated 7/8/1439 AH, No. (1090) dated 14/8/1441 AH, No. (449) dated 17/7/1442 AH, No. (218) dated 19/5/1443 AH, No. (182) dated 3/6/1444 AH, and memorandum No. (3262) dated 3/11/1444 AH, prepared by the Bureau of Experts at the Council of Ministers.

    • After reviewing the recommendation of the Council of Economic and Development Affairs No. (2-44/12/T) dated 25/12/1444 AH.

    • After considering the decision of the Shura Council No. (25/4) dated 21/3/1444 AH.

    • After reviewing the recommendation of the General Committee of the Council of Ministers No. (1121) dated 29/1/1445 AH.

    • It is decided as follows:

      • First: Approval of the Law of the Rights of Persons with Disabilities, in the attached form.

      • A draft Royal Decree has been prepared accordingly, its text is attached hereto.

      • Second: The Authority for Persons with Disabilities, when implementing the provisions related to social and economic support and the like, contained in the law referred to in item (First) of this decision, shall align them with what is issued by the Ministerial Committee for the Social Support and Assistance System - formed pursuant to item (Eighth) of the decision of the Council of Economic and Development Affairs No. (4-42/1/Q) communicated by the kind directive contained in the Royal Court telegram No. 28583 dated 23/5/1442 AH - without prejudice to the Committee’s competencies, and without prejudice to the provisions of the law referred to in item (First) of this decision.

    • Pursuant to Article (Seventy) of theBasic Law of Governanceissued by Royal Order No. (A/90) dated 27/8/1412 AH.

    • And pursuant to Article (Twenty) of theLaw of the Council of Ministersissued by Royal Order No. (A/13) dated 3/3/1414 AH.

    • And pursuant to Article (Eighteen) of theLaw of the Shura Councilissued by Royal Order No. (A/91) dated 27/8/1412 AH.

    • After reviewing the decision of the Shura Council No. (25/4) dated 21/3/1444 AH.

    • After reviewing the decision of the Council of Ministers No. (110) dated 6/2/1445 AH.

      • We decree the following:

        • First: Approval of the Law of the Rights of Persons with Disabilities, in the attached form.

        • Second: The Prime Minister, Ministers, and heads of the concerned independent agencies - each within their jurisdiction - shall implement this Royal Decree.

1. Definitions and General Principles

Article 1

In this Law, the following words and phrases shall have the meanings assigned thereto:
Law: Law of the Rights of Persons with Disabilities.
Authority: Authority for the Care of Persons with Disabilities.
Regulations: Implementing Regulations of this Law.
Relevant Agency: The agency in charge of one or more of the areas covered by the provisions of this Law.
Person with a Disability: Any person who has a long-term physical, mental, intellectual, sensory, or psychological disorder or impairment that may, when facing different challenges, prevent him from fully and effectively participating in society on an equal basis with others.
Services: An integrated set of services provided to every person with a disability taking into account his health condition and degree of disability, or his social situation. Such services shall include health, educational, training, rehabilitation, cultural, social, media, sports, and employment services as well as other services.
Rehabilitation: The utilization of medical, social, psychological, educational, vocational, and environmental services to assist a person with a disability in achieving the highest possible degree of effectiveness to enable such person to adapt to the requirements of his natural and social environment and to develop his ability to rely on himself and become an active member of society, to the extent possible.
Educational and Training Support Services: Additional services required in educational and training settings due to the nature of the disability.
Accessibility: A set of appropriate measures which ensure that persons with disabilities have access to services on an equal basis with others; access to their surrounding physical environment, transportation, information, and communications, including technological means and information and communication systems; and access to other facilities and services available to the public.
Reasonable Accommodations: A set of measures necessary for accommodating the special needs of a person or a group of persons with disabilities that enable them to exercise all rights and enjoy basic services on an equal basis with others, provided that such measures do not cause undue burden on the entities providing such measures.
Discrimination on the Basis of Disability: Any form of discrimination, exclusion, or restriction against persons with disabilities on the basis of disability the purpose or effect of which is to impair or nullify all or some of the human rights for such persons or their right to enjoy or exercise such rights on an equal basis with others.

Article 2

This Law aims to protect and promote the rights of persons with disabilities and to ensure their access to all services on an equal basis with others, and affirms the following basic principles:
1. Non-discrimination on the basis of disability and the provision of equal opportunities.
2. Providing accessibility requirements and reasonable accommodations.
3. Including the requirements of persons with disabilities in governmental and non governmental legislation, strategies, policies, activities, programs, plans, and designs.
4. Enabling persons with disabilities to participate in the management of their affairs in accordance with governing provisions.
5. Enabling persons with disabilities who have reached the age of majority to make legal transactions, unless their disability prevents them from making such transactions in accordance with relevant legal provisions.
6. Adopting alternative and appropriate methods of communication with persons with disabilities, including verbal or written communication, sign language, or any other method of communication.
7. Training individuals in all entities who are entrusted with serving persons with disabilities on ways to deal with and communicate with such persons as well as raising awareness of their rights.

Chapter 2: Rights and Services

Article 3

Persons with disabilities shall have the right to access their surrounding physical environments, in accordance with the engineering and architectural specifications provided for in relevant legal provisions, in all facilities, including the following:
1. Verifying compliance with accessibility requirements, as provided for in relevant legal provisions, upon the issuance or renewal of the licenses required for governmental and non-governmental facilities.
2. Guaranteeing the right of persons with disabilities to move easily and safely when designing and constructing city streets, sidewalks, pedestrian paths, and parking lots. The Regulations shall specify the controls and procedures necessary for the implementation of the provisions of this Article.

Article 4

Accessibility requirements and reasonable accommodations shall be provided to persons with disabilities during preliminary investigation, investigation, trial, and execution of judgments.

Article 5

Persons with disabilities shall have the right to have their special requirements observed during emergencies, natural disasters, and crises. The relevant agencies shall, in coordination with the Authority, issue the guidelines for the implementation of the provisions of this Article.

Article 6

Persons with disabilities shall have the right to have their special requirements and needs observed with regards to traffic safety laws and guidelines.

Article 7

Persons with disabilities shall have the right to move as safely and independently as possible. The Regulations shall specify the controls necessary for the implementation of the provisions of this Article.
