In the context of defining the terms contained in this Regulation, reference is made to their meanings as stated in Article (1) of the Law on the Rights of Persons with Disabilities, in addition to the meanings specified for each of the following terms:
Universal Design:
Designing services, products, environments, and programs for use by everyone, taking into account the needs of different community groups when designing public services, products, environments, and programs, in a way that achieves maximum possible inclusive access.
Facilitative Arrangements:
Considering what is stipulated in Article One of the Law, the disproportionate burden on the entity providing the facilitative arrangements refers to the financial burden that constitutes a serious harm when applied.
Establishments:
The governmental and private entity, which is accessible to all who wish to utilize its services.
In application of the provisions of paragraph (1) of Article Two of the Law, emphasizing the principle of equal opportunities and non-discrimination based on disability, persons with disabilities must be provided with opportunities equivalent to those available to others, by removing any barriers or obstacles—legislative, social, physical, or non-physical—that prevent them from exercising their rights, and providing the necessary support to facilitate their access to these rights.
The relevant authority issues a disability certificate for persons with disabilities based on an approved assessment, and the data contained in this certificate is recognized as official documentation for proving the disability, its type, and degree before all governmental and non-governmental entities.
In consideration of the provisions of the relevant regulations, the concerned authorities - responsible for issuing or renewing the necessary licenses for public and private facilities and establishments - shall include accessibility requirements in the internal procedures for approving the issuance or renewal of the necessary licenses, according to the following standards:
A- Enabling persons with disabilities to move independently.
B- Ensuring that movement is easy and free from physical barriers.
C- That the technical requirements for access are feasible for safe mobility.
D- When establishing the requirements, they should be compatible with the principles of universal design.
Taking into account the standards stipulated in Article Four of the Regulation, the accessibility requirements for the surrounding physical environments shall be applied in accordance with the provisions of the Saudi Building Code Implementation System, the standards issued in its implementation, and the guides and specifications prepared and approved by the Board of Directors of the Authority.
Means of land, sea, and air transport and their departure stations must be equipped with the necessary tools, technologies, information, and electronic services to facilitate the service for persons with disabilities, and they should be provided with guidance tools in various public places.
