Rules of Inspection, Control, and Seizure

General Provisions

Article 1: Definitions

  • The words and phrases listed below - wherever they appear in these regulations - shall have the meanings specified next to each, unless the context requires otherwise:

  • Authority: Authority for Persons with Disabilities.

  • Council: Board of Directors of the Authority.

  • Law: Law on the Rights of Persons with Disabilities.

  • Regulation: Implementing Regulation of the Law.

  • Committee: Committee for Reviewing Violations of the Provisions of the Law on the Rights of Persons with Disabilities.

  • Rules: Rules for Inspection, Control, and Regulation.

  • President: Chief Executive Officer of the Authority.

  • Entity: Non-governmental legal entity.

Article 2

  • The purpose of these rules is to clarify the provisions that regulate the procedures for inspection, control, and enforcement in a manner that enhances the efficiency of operations and improves the compliance rates of non-governmental entities with the laws, regulations, and instructions, achieving the following:

    • 1- Monitoring compliance with the application of the law.

    • 2- Enhancing trust in the procedures for inspection, control, and enforcement by governing the necessary controls and procedures to ensure transparency and integrity in the work of inspectors during inspection and control activities.

    • 3- Raising the level of awareness regarding control procedures among all employees of the authority and those dealing with it.

    • 4- Clarity of the requirements necessary for inspectors and the entities they interact with.

Article 3

  • Subject to the provisions of Article Four of these rules, the performance of inspection, monitoring, and control activities - in accordance with these rules - shall not exempt from any oversight or inspection carried out by the relevant authorities in the activities and fields covered by the law in accordance with their competencies.

Scope of Application of the Rules

Article 4

  • The provisions of these rules apply to the inspection, control, and enforcement actions carried out by the authority when dealing with non-governmental entities, in violations of Article Twenty-Five of the Law as follows:

    • 1- Failure to adhere to the fundamental principles mentioned in Article (Two) of the Law.

    • 2- Denial of rights and services to persons with disabilities as stated in the Law.

    • 3- Enacting policies that discriminate -either directly or indirectly- on the basis of disability.

Article 5

  • The Authority shall exercise its competencies as stipulated in Article Twenty-Seven of the Law through the following:

    • 1- Periodic monitoring to ensure compliance of establishments with the requirements and conditions of the Law and Regulation.

    • 2- Monitoring and inspection based on a complaint regarding any of the subjects mentioned in Article Four of the Rules.

    • 3- Subsequent monitoring to verify the implementation of the decisions of the competent Committee and the removal of the violation.

Article 6

  • The Authority shall take the necessary procedures to monitor the implementation of the provisions of the law and its regulations, including coordination with the relevant government entities, to take the duties that must be followed in the violations stated in the law, which require handling by the concerned entities, exchanging information related to these violations, and following up on the implementation of the penalties issued regarding them.

Supervision, Duties of the Supervisor, and His Powers

Article 7

  • The President shall, by his decision, determine the departments and sections responsible for working towards achieving the objectives and tasks outlined in these rules, policies, and related procedures, with these departments specifically tasked with the following duties:

    • 1- Supervising the work of oversight and inspectors, directing them, and following up on the specific oversight plans and their programs.

    • 2- Preparing annual reports on the achievements of oversight and inspection that they undertake.

    • 3- Examining complaints and violations received, classifying them, and determining the method of handling them.

    • 4- Preparing models, minutes of control, and necessary forms for recording data and assisting work evidence.
