Regulation for Preventing Non-Saudis from Engaging in the Housing of Pilgrims, Umrah Performers, and Visitors

  • The Council of Ministers

  • After reviewing the correspondence received from the Diwan of the Presidency of the Council of Ministers No. 2597/B dated 04-07-1426 AH, which includes the telegram of His Royal Highness the Minister of Interior and Chairman of the Supreme Hajj Committee No. 26891/29 dated 04/03-04-1422 AH, regarding the prohibition of non-Saudis from engaging in the field of housing pilgrims, umrah performers, and visitors.

  • And after reviewingthe Regulations for Housing Pilgrimsapproved by Royal Order No. (8/568) dated 11-07-1410 AH

  • And after reviewing the minutes No. (386) dated 11-09-1422 AH, and No. (336) dated 13-09-1426 AH prepared by the Experts Authority.

  • And after considering the Shura Council Resolution No. (27/29) dated 11-06-1426 AH.

  • And after reviewing the recommendation of the General Committee of the Council of Ministers No. (556) dated 19-10-1426 AH.

  • It is decided

  • to approve the regulatory statute to prohibit non-Saudis from engaging in the field of housing pilgrims, umrah performers, and visitors, in the attached form.

Article 1

Hajj missions, agencies, tourism companies, or similar entities are not permitted to engage with non-Saudis regarding the accommodation of pilgrims, Umrah performers, or visitors. Contracts must be made directly with owners, investors, lessors, or their representatives who are Saudi nationals.

Article 2

Without prejudice to the provisions of the regulations governing the housing of pilgrims, non-Saudis are not permitted to rent any building for the purpose of utilizing it for the accommodation of pilgrims, Umrah performers, or visitors, whether for a fee or free of charge.

Article 3

If a non-Saudi resident in the Kingdom wishes to accommodate one of his relatives or acquaintances in Mecca or Medina – who is arriving for the purpose of performing Hajj, Umrah, or visitation – he must notify the institution to which the pilgrim or Umrah performer belongs to obtain approval from the Ministry of Hajj.

Article 4

Previous Amendments
  • First - Two permanent committees shall be formed in Mecca and Medina, each committee being linked to the Emir of the region, as follows:

  • 1- A representative from the Ministry of Hajj                                           as Chairperson

  • 2- An advisor from the Ministry of Commerce                       as a member

  • 3- An officer from the Public Security                                         as a member

  • 4- An officer from the General Investigation Directorate                                     as a member

  • 5- An officer from the General Directorate of Passports                         as a member

  • 6- A representative from the General Panel for Tourism and Antiquities                       as a member

  • 7- A representative from any other entity that His Highness the Chairman of the Supreme Hajj Committee sees fit to add to this committee           as a member

  • Provided that the level of representation for all participating entities in this committee shall not be less than the (tenth) rank or its equivalent.

  • Second: The headquarters of the two committees shall be the branches of the Ministry of Hajj in Mecca and Medina, and a decision shall be issued by the Minister of Hajj to appoint the Chairperson of each committee and the rest of its members based on the nominations from their respective entities.

Article 5

Previous Amendments
  • The two committees established under Article Four of this Regulation are responsible for the following:

    • A) Collecting evidence, indications, and elements of proof related to the violation, apprehending violators, and referring them to the Public Prosecution and Investigation Authority.

    • B) Supervising the work of field teams, developing necessary plans and programs, and monitoring their implementation.

    • C) Reviewing the accounts of suspects at banks after coordination between the Emirate of the Makkah Region and the Emirate of the Madinah Region, with the approval of the Ministry of Finance.

    • D) Preventing actions that violate the provisions of this Regulation in coordination with the Committee for Inspecting Pilgrims' Accommodations.

    • E) Identifying cases that violate the provisions of the Regulation in coordination with the Pilgrimage and Umrah Institutions and the Guides Institution concerning Madinah, as well as the Domestic Pilgrims Institutions.

    • F) Supervising the tracking of violators of the provisions of this Regulation through field teams in coordination with the neighborhood leaders.

    • G) Raising awareness of this Regulation.

 

Article 6

A) Each committee convenes in the presence of the majority of its members, including the President or his representative, and issues its recommendations by a majority of the votes of those present. In the event of a tie, the side that the President voted with shall prevail.

B) The decisions of each committee are approved by a decision from the Emir of the region.

Article 7

  • a) A decision by the Minister of Hajj – in coordination with the relevant authorities – shall form temporary teams in Mecca and Medina linked to the Permanent Committee, to conduct field tours and follow-ups, with the number not exceeding ten teams, as follows:

    • 1- A representative from the Ministry of Hajj.

    • 2- A representative from the Ministry of Commerce.

    • 3- A representative from the Public Security.

    • 4- A representative from the General Investigations.

    • 5- A representative from the Passports Department.

  • The participating authorities shall support these teams with the necessary human resources and requirements.

  • b) The teams shall be responsible for the following:

    • 1- Conducting field tours to track violators of the provisions of this regulation within neighborhoods in coordination with the mayors to take the necessary actions in accordance with the law, and notifying the concerned committee stipulated in Article Four of this regulation to complete the legal procedures.

    • 2- Conducting tours of the offices of pilgrimage institutions, Umrah institutions, and the guides' institution in Medina, as well as domestic pilgrims' institutions to uncover cases of violations of the provisions of this regulation.

    • 3- Implementing the plans and programs established by the two permanent committees formed under Article Four of this regulation.

Article 8

Previous Amendments

In consideration of what is stated in Article Five of this Regulation, the Public Prosecution and Investigation Authority shall investigate violations of the provisions of this Regulation and submit the results to the Emir of the region.

Article 9

A- A committee of three members shall be established by a decision from the Minister of Hajj, one of whom must be a legal or Sharia consultant, to consider the cases in which certain individuals are accused. The judgment shall be issued by the committee and its decisions shall be approved by the Emir of the region.

B- The concerned party has the right to appeal the penalty decision before the Board of Grievances within sixty days from the date of being notified of the decision.
