Owners or lessors are required to provide data regarding the homes they wish to rent during the Hajj season to the Tawafa institutions, specifying the following:
(a) The location of the house and its complete address.
(b) The type of building.
(c) The number of floors and rooms on each floor.
(d) A list of the contents of the house.
(e) Attach a copy of the permit for the house for accommodating pilgrims issued by the home inspection committee for the same year.
(f) Attach a copy of the lease contract between the original owner and the tenant.
(g) Attach a copy of the legal power of attorney (in case of delegation).
The lease shall be from the original owner of the house, or their legal agent, or from the tenant, provided that the duration of the lease is for a full year.
The tenant is not permitted to lease the house from the owner, except to pilgrims or their representatives only.
The contracting for the rental of the floors shall be between the owners, or their agents, or the lessors and the pilgrim, or their direct representative, provided that the institutions are notified of the floors that have been agreed upon by both parties. The rental contracts shall be certified by these institutions without charge, and documented by the Ministry's Agency for Pilgrimage Affairs.
It is not permissible for the pilgrimage service institutions, or their branch offices, to rent a house for the purpose of re-renting it to the pilgrims or their representatives.
Members of institutions and their branch offices are allowed to lease any properties they own or have rented throughout the year in their individual capacity, just like other owners and lessors.
It is not permissible for the pilgrimage service institutions, or their branch offices, to monopolize any profit or take percentages, commissions, or any compensation under any title from the contracting process for housing pilgrims, whether from the pilgrims themselves or their representatives, or from the owners or lessors.
The basis for the accommodation rent is the agreement between the owner or lessor and the tenants or their representatives, and according to the conditions of supply and demand.
The owners or lessors are obligated to provide all the required services in the Accommodation (such as water, electricity, furnishings, services, maintenance, cleaning, and security) in the manner agreed upon between them and the pilgrims, or their representatives. If the owner or lessor expresses their inability to provide these services (or some of them) and this is taken into consideration when determining the Payment, the concerned Hajj mission may agree with whom they deem appropriate to carry out these services.
