Regulation for Organizing the Activities of the Pilgrims and Umrah Performers Department

Article 1

As necessary, the Council shall, each Hijri year, issue a decision assigning one or more circuits from among the Appeal Circuits and the First Instance Circuits to consider cases related to pilgrims and Umrah performers, as well as cases that fall within the jurisdiction of the designated circuit.
The circuit shall consist of one or more judges according to the jurisdiction stipulated by law, and the decision shall specify the location of the circuit's work, the duration of the assignment, its commencement, and the daily working hours of the circuit and their start time.

Article 2

 

1 - The President of the Council shall be appointed by a decision issued by the head of each department and its members.
2 - The President of the Council shall appoint, by a decision issued by him, one of the members of the judicial body as the General President of the departments, and shall also appoint one of the members of the judicial body as the Assistant to the President. The decision of their appointment shall specify their place of work, the duration of the appointment, its commencement, and their daily working hours, ensuring that the duties are divided between them. Their task shall be to supervise the departments as required by work procedures, coordinate with relevant authorities, and undertake any other tasks determined by the Council.

Article 3

1- Each department shall have an independent headquarters, and it shall be provided, prior to the commencement of the assignment, with sufficient time to equip it with the necessary work procedures, including computers and other devices for managing and recording cases. It shall also be provided with a sufficient number of employees, workers, and others as needed, who shall operate under the supervision of the department head, and all shall be subject to the oversight of the General President of the departments.
2- Each department shall have an official seal to stamp its documents.
 

Article 4

 

The courts have jurisdiction over cases that arise within the boundaries of the Holy Mosque in Mecca, Mina, Muzdalifah, the Arafat area, the sacred sites and their facilities, and the boundaries of the Holy Mosque in Medina during the period of assignment.
 

Article 5

The chambers are specifically authorized to consider the following:
1- Establishing the Waiver and certifying the acknowledgment.
2- Considering criminal cases that do not involve destruction and any resulting damage, regardless of its extent.
3- Considering financial cases that do not exceed twenty thousand Riyals.
4- Any other cases determined by the Council.

Article 6

Except for cases of proving waivers, certifying confessions, and cases involving prisoners and detainees, the parties to the case may, by mutual agreement, if they appear before the circuit, request that their case be considered in writing – before it is recorded – by one of the competent courts in the Kingdom that is specialized in the type of case, whether they are residents of the Kingdom, whether they are Saudi or non-Saudi. The circuit shall refer the case to the competent court, and this applies to the plaintiff if they request that their case be considered in the court of the defendant's country within the Kingdom.

Article 7

Without prejudice to the provisions of Article Four, each court shall consider any case brought before it if it has jurisdiction over it in terms of type.

Article 8

At the end of each assignment, the following must be done:
1- The departments must close their records and registers of all types, sign them, and seal them with the official seal.
2- The records, registers, files, and documents must be deposited by the General President of the departments with the competent court of the respective type in the cities of Mecca or Medina. The court will handle the procedures for cases that have been concluded, including annotations and similar matters upon request for their processing, and the procedures prescribed by law will apply. No work may be conducted on the records and registers thereafter.
3- Cases that have not been heard or have been heard but not ruled upon or not reviewed by the Court of Appeal – through the General President of the departments – shall be referred to the competent court for consideration, and the case file must be accompanied by a certified copy of the record of the case that was heard but not ruled upon, as well as providing the concerned authority with a copy of the referral letter.
4- The members of the departments and their General President shall prepare a comprehensive report that includes a summary of the departments' work, the achievements made, the impediments encountered, and suggestions regarding them, which shall be submitted to the council through the General President of the departments.

Article 9

This regulation shall come into effect from the date of its issuance, and any provisions that conflict with it shall be revoked.
