Regulations and Procedures for Visiting Yachts

Article 1: Definitions

Article 2: Objective

  • The regulations and procedures aim to clarify the provisions of the regulatory regulation for visiting yachts wishing to enter and exit and/or navigate within the geographical scope, including tourism, maintenance, refueling, obtaining supplies, or participating in marine exhibitions and similar activities.

Article 3: Scope of Application

  • The provisions of these regulations and procedures apply to the owner, crew, passengers, tourist shipping agent, and operators of tourist marinas for visiting yachts within the geographical scope in accordance with the regulatory list and the relevant regulations, procedures, instructions, and circulars issued by the authority.

 

Article 4: General Provisions

  • The visiting yacht that wishes to enter and/or visit and/or navigate within the geographical area must comply with the following:

    • 1- Appoint and authorize a tourist maritime agent for the yacht before entering the geographical area, who will be the official representative of the yacht between the yacht and the authority and relevant entities.

    • 2- Obtain the technical license (tourist recreational) from the authority and the maritime license from the Transport General Authority before entering the geographical area, which must remain valid throughout the duration of the visiting yacht's stay in the geographical area.

    • 3- The tourist maritime agent must perform his responsibilities on behalf of the visiting yacht with the highest quality standards, in addition to any other responsibilities stipulated in the regulatory regulation for the tourist maritime agent and its controls and procedures issued by the authority.

    • 4- Hold a valid insurance document throughout the duration of the visiting yacht's stay, which includes liability insurance towards third parties, as well as coverage for the hull and machinery and removal of debris, including damages to fixed or floating docks or environmental damages and oil pollution.

    • 5- The visiting yacht must not engage in any commercial activity before obtaining the necessary licenses and permits from the authority that authorize it to do so.

    • 6- All passengers and crew members on board the yacht must have valid visas to enter the Kingdom.

    • 7- Appointing a tourist maritime agent does not exempt the owner or captain of the visiting yacht from their responsibilities and obligations under the regulatory regulation and the controls, procedures, instructions, and circulars related to it.

    • 8- Immediately report any changes in the details and documents submitted in the application for the technical license (tourist recreational).

Article 5: Procedures for Applying for a Traffic Permit

  • 1- The appointed tourism maritime agent must submit an electronic application via the electronic platform and enter the following information:

    • ‌A- Registration certificate for the visiting yacht.

    • ‌B- List of crew members and passengers.

    • ‌C- Valid comprehensive insurance document covering the geographical area, liability to third parties, and for the structure and machinery, as well as debris removal including damages to fixed or floating docks or environmental damages and oil pollution.

    • ‌D- Specify the purpose of the yacht's visit to the geographical area, which may include crew change, maintenance, refueling, or obtaining supplies.

  • 2- The authority issues a transit permit for a duration of (4) days, and if there is a need to exceed this period, an application for the technical (tourism recreational) license must be submitted.

Article 6: Procedures for Applying for the Tourist Recreational Specialist License

  • 1- The authorized tourism maritime agent must submit an electronic claim through the electronic platform, attaching a clear copy of the supporting documents - in Arabic or English - as follows:

    • ‌A- A copy of the visiting yacht's registration certificate.

    • ‌B- A copy of the general inspection report (it must not be more than one year old at the time of submitting the claim).

    • ‌C- A copy of the compliance certificates issued by the flag state or classification authority indicating the visiting yacht's seaworthiness.

    • ‌D- A copy of the crew data list and passenger list.

    • ‌E- A copy of the passports of the captain and crew of the visiting yacht.

    • ‌F- A copy of the identification details of the owner of the visiting yacht.

    • ‌G- A copy of the berth contract.

    • ‌H- A valid comprehensive insurance document within the geographical scope, covering the full civil liability of the insured arising from death, bodily injury, or property damage caused by the vessel and wreck removal.

    • ‌I- A copy of the captain and crew certificates.

    • ‌J- A copy of the ship's wireless license (Ship Station License) indicating the essential devices (AIS, Marine VHF, EPIRB).

    • ‌K- A document outlining the planned route of the yacht, the duration of the yacht's stay, and the sailing areas within the geographical scope.

    • ‌L- Declare all yacht accessories, for example: water toys, drones, jet skis, aerial vehicles (helicopter), and obtain the necessary licenses and permits from the relevant authorities.

    • ‌M- Declare all marine activities that will be practiced within the geographical scope, such as diving, recreational fishing.

    • ‌N- Submit any other requirements deemed necessary by the authority to obtain the technical (tourism recreational) license.

  • 2- If any document is not available in the mentioned languages, a translated copy into Arabic by a certified translator can be submitted along with a copy of the original document.

  • 3- The authority approves the technical (tourism recreational) license claim after the issuance of the maritime license from the Transport General Authority within a period not exceeding (24) twenty-four hours from the completion of the claim.

  • 4- The authority has the right to add or cancel any of the eligibility criteria or required documents for the technical (tourism recreational) license claim based on its assessment of the applicant.

  • 5- In the event of license rejection, the authority will notify the applicant, and the applicant may resubmit the claim after fulfilling the requirements.

Article 7: General Conditions and Requirements for Issuing the Tourism and Entertainment Specialist License

  • 1- The visiting yacht is obligated during its stay within the geographical area to comply with the relevant instructions, including but not limited to:

    • A- Any technical requirements stipulated in the regulatory regulation for visiting yachts or any instructions or circulars issued by the authority.

    • B- Keeping the visiting yacht in good and seaworthy condition, in accordance with all plans and schedules recommended by the manufacturer, and the validity of the required certificates, as required by the flag state.

    • C- Complying with the maximum number of passengers specified in the commercial survey certificate or the registration certificate for large yachts, with a maximum of (12) passengers or (36) passengers, as applicable to the requirements of the flag state of the visiting yacht. Additional persons on board the yacht during social events when the yacht is alongside the dock or in a mooring area managed and controlled by the tourist marina may be exempted - after coordination with the authority.

    • D- Providing life jackets appropriate to the allowed passenger load, in addition to a reserve number equal to 10% of the number of jackets, with each life jacket bearing the name of the yacht and containing a whistle, night light, and reflective tape; children's life jackets must be in their designated places and comply with international specifications.

    • E- Repairing or replacing safety and navigation equipment, wireless communications, fire detection and suppression equipment, or any other equipment that may require maintenance or replacement.

    • F- Not allowing diving activities unless the requirements stated in the relevant regulations from the concerned authorities are met.

    • G- Not allowing any swimming activities or the use of water games from sunset to sunrise.

  • 2- The technical (tourism and recreational) license must be valid throughout the yacht's stay (up to six months), and the owner or the tourism shipping agent of the visiting yacht must operate it accordingly.

  • 3- Upon the expiration of the technical (tourism and recreational) license, the visiting yacht may remain in the geographical area during a grace period not exceeding (72) seventy-two hours from the date of the license expiration.

  • 4- In the event of a breach of any of the conditions or requirements, the competent authority may suspend or revoke the license and notify the relevant authorities immediately.

Article 8: Procedures for Applying for a Tourist Trip Permit

  • The authorized tourist maritime agent must submit an electronic application via the electronic platform and enter the following information:

  • 1- In the case of a private trip:

    • A- A statement of the names of the crew and passengers and their information.

    • B- Identification of the locations and routes of the trip.

    • C- The duration of the trip.

    • D- The date of the trip.

    • E- Information about the marine vessel.

    • F- The point of departure and return.

    • G- The purpose of the trip.

  • 2- In the case of a lease trip, the documents mentioned in paragraphs (A) and (B) of paragraph (1) of this article must be submitted to the lease contract.

  • 3- The operator of the tourist marina must ensure the accuracy of the data before the yacht departs from the tourist marina.

Article 9: Procedures for Applying for an Exit Permit

  • 1- The tourist maritime agent must submit an electronic application via the electronic platform and enter the following information:

    • A- A statement of the names of the crew and passengers and their information.

    • B- Identification of the point of departure.

    • C- Date of departure.

    • D- Time of departure.

    • E- Information about the maritime vessel.

    • F- Destination.

  • 2- After fulfilling all requirements (Port clearance), the operator of the tourist marina must ensure the data is accurate and issue the departure permit.

  • 3- The license is canceled as soon as the maritime vessel leaves the geographical area, even if its duration has not expired, and the authority has the right to make exceptions as needed.

Article 10: Rules for Safety, Safe Navigation, and Protection of the Marine Environment

  • 1- The visiting yacht and its crew must fully comply with all applicable maritime laws, regulations, and international agreements in the Kingdom.

  • 2- Compliance with navigation and safety instructions specific to tourist marinas and ports.

  • 3- Continuously maintain the Automatic Identification System (AIS) device of the visiting yacht in operational condition during its stay within the geographical area.

  • 4- The visiting yacht must limit its navigation and mooring activities to the designated areas authorized by the authority or the tourist marina and must not enter prohibited, protected, or unauthorized areas.

  • 5- Compliance with the specified speed limit is required, and excessive speed that may cause an accident or create waves that could damage any other yacht, vessel, or property is prohibited.

  • 6- The visiting yacht must be equipped with safety and navigation equipment, wireless communications, and environmental protection equipment in accordance with the requirements and international agreements and treaties applicable in the Kingdom.

  • 7- The visiting yacht must be equipped with fire detection and firefighting equipment.

  • 8- The visiting yacht must have the necessary safety equipment, including life jackets, lifebuoys, fire extinguishers, distress signals, and first aid supplies, according to the size and capacity of the yacht.

  • 9- Regular fire and emergency drills must be conducted, ensuring that all crew members are familiar with emergency procedures, evacuation methods, and safety protocols.

  • 10- The discharge of any waste, including sewage, waste, and oily substances, within the geographical area is strictly prohibited.

  • 11- Promote sustainable environmental practices and reduce the use of single-use plastics on board the visiting yacht.

  • 12- The use of sunscreen harmful to coral reefs and the marine environment is prohibited, and it can be replaced with any other organic, environmentally friendly products.

  • 13- Maintain a safe distance from marine habitats when sailing or mooring next to them.

  • 14- Mooring must be done with extreme care, using designated marine buoys to avoid damaging underwater ecosystems and not mooring in prohibited or protected areas.

  • 15- A tourist trip permit must be retained when leaving the tourist marina.

  • 16- Ensure that the use of water sports complies with appropriate or approved age standards, restrictions on specific noise level standards, is equipped with appropriate safety equipment, and is supervised by trained crew.

  • 17- Ensure that no fixed water sports equipment is left in open water or abandoned in any unauthorized area.

  • 18- The disposal of ballast water or solid and liquid waste is prohibited except at facilities designated for the tourist marina.

  • 19- Racing of any kind is prohibited except in areas designated for that purpose and authorized by the relevant authorities in the Kingdom.

  • 20- Mooring or sailing of the visiting yacht or any water sports equipment in protected areas is prohibited.

  • 21- If fishing is conducted, it must be for personal consumption only, and according to the regulations set by the authority organizing recreational fishing activities based on type, seasons, quantities, and fishing methods, and it is prohibited to trade or sell it in all fish markets and shops of all kinds.

  • 22- Do not catch sharks, dolphins, or any other protected or prohibited fish species regardless of their type or size throughout the year.

  • 23- The use of nets, spearfishing guns, or any other prohibited fishing tools and equipment is prohibited.

  • 24- Compliance with the laws, regulations, and instructions related to the protection of the marine environment, living aquatic resources, and the preservation of marine biodiversity is required.

  • 25- Upon leaving the geographical area, the captain of the visiting yacht and the tourist maritime agent must register their departure at the nearest port or tourist marina and request the cancellation of the technical (tourist and recreational) license.
