Marina Design and Operations Regulation

Article 1: Definitions

  • The following terms and words, wherever mentioned in this Regulation, shall have the meanings assigned to each of them, unless the context otherwise requires:

    • Kingdom: Kingdom of Saudi Arabia.

    • Authority: Saudi Red Sea Authority.

    • Board of Directors of the Authority: Board of Directors of the Saudi Red Sea Authority.

    • Regulation: Regulation for the Design and Operation of Tourist Marinas.

    • Marina: The area used for the cessation or berthing of the marine craft in the Geographical Scope.

    • Marina Operator: The establishment with a legal capacity licensed by the authority that handles the daily management and operation of the Tourist Marina.

    • Maritime Activities: Maritime navigational activities of the marine craft practiced or used for tourism purposes within the Geographical Scope.

    • Marine Craft: Each floating craft prepared for work above or below water bodies used for  tourist or recreational purposes, and the accessories of the Marine Craft

    • necessary for its exploitation are part of it.

    • Operating License: The license issued by the Saudi Red Sea Authority grants approval to the operator to operate the tourist marina.

    • Geographical Scope: The territorial sea of the Kingdom of Saudi Arabia in the Red Sea, in which navigational and maritime activities are practiced, and the part of the land associated with the exercise of such activities, except for the military, security and other zones therein.

Article II (2): Purpose of the Regulation

This Regulation aims to set the terms, conditions and procedures governing the activity and work of Marina Operators and the design of Tourist Marinas within the Geographical Scope, and to provide the main health, safety and environmental protection considerations required from the Marina Operator to obtain the Operating License.

Article III (3): Licensing

  • Local or foreign tourist Marina Operators must meet the regulatory requirements in accordance with the local regulations in force in the Kingdom.

  • The Authority shall issue, renew or cancel the necessary license and operate the Tourist Marinas within the Geographical Scope in accordance with the requirements and conditions set by the Authority, provided that this does not prejudice the completion of the requirements and conditions approved by other concerned authorities.

  • Marina Operators shall obtain prior approval from the Authority for the continued validity of the license in the event of amending its legal entity, and the Authority may, at its discretion, accept or reject the continued validity of the license if the amendment is made without its prior knowledge.

  • The activity of operating Tourist Marinas may not be conducted without obtaining a license, after its expiry or cancellation, or during the period of its suspension.

  • To apply for a license, the following conditions must be met:

    • a) The establishment must have a branch in the Kingdom of SaudiArabia.

    • b) To have sufficient experience to practice the operation of Tourist Marinas.

    • c) Proof of solvency in relation to the volume of business and services provided

    • d) Provide a list of all works and services provided to beneficiaries

    • e) Pay the financial consideration for issuing a license to operate Tourist Marinas, as approved by the Board of Directors of the Authority.

  • 6. Fill out the license application form prepared by the Authority.

Article IV (4): Design of the Tourist Marina

  1. The design of the marina must comply with the Tourist Marinas Building Code Guide approved by the Saudi Red Sea Authority.

  2. The following services must be available in the Tourist Marina:

    • a) The marina must be operated in sustainable ways with at least 50% of the total capacity.

    • b) The presence of sufficient draught for the channel sof the Tourist Marina and its berths.

    • c) The presence of stations supplying fuel and water.

    • d) Provide safe electric charging stations.

    • e) Sewage plants and solid or liquid waste receiving stations.

    • f) Breakwater to protect Marine Crafts. g) Protective supports and bumpers on the piers to protect the MarineCrafts.

  3. The design must be compliant with the quality measures, standards and programs mentioned below to improve the management and operation of Tourist Marinas including but not limited to:

    • a) ISO/CD13687:Yacht ports-minimum requirements.

    • b) ISO 14000- Environmental management.

    • c) ISO 9000- Quality Management.

    • d) Blue Flag- the environmental sign of beaches.

  4. Provide separate pedestrian walkways and roads for light vehicles and heavy vehicles such as trucks, cranes, forklifts, and others with parking areas for vehicles as clearly defined as possible.

  5. Corridors and facilities for people with disabilities must be adapted.

  6. Pedestrian paths should be free of obstructions and trip-and-tripping hazards.

  7. Provide guidance to Tourist Marina users in terms of signs or other notices before starting work

  8. The presence of clear instructions on navigational aids for entry and exit from the Tourist Marina

Article 5 (5): Tourist Marinas Management System

  1. The Marina Operator must have an integrated management system, which usually deals with everyone in terms of tourism and leisure operations, and there is a set of rules and conditions that must be adhered to.

  2. Marinas must be fully equipped in terms of personnel, provided that there is a sufficient number on duty to ensure the adequacy of human cadres in the night shift and seven days a week to deal with any accidents as specified in the risk assessment.

  3. Additional considerations related to occupational health, safety and environment in the marinas management system include:

    • a) Inform the marina administration office as soon as possible after any accident that causes injury to any person or damage to any public or private property inside the marina building, and the marina management office in turn reports the incidents to the competent authorities.

    • b) The marina should have procedures to investigate and report accidents

    • c) The marina must have a record of accidents.

  4. The existence of a list of prohibited activities in clearly visible locations for beneficiaries - unless permission is expressly obtained from the concerned authorities - according to the following:

    • a) Hazardous or flammable materials may only be brought in or stored on board the Marine Craft in properly secured containers designed to contain such materials against leakage while ensuring that they are securely covered.

    • b) Appropriate drainage facilities shall be used in the Tourist Marina, it is the responsibility of the Marina Operator to ensure that no environmental pollution occurs within the Tourist Marina basin, and the moored Marine Craft shall use their tanks for wastewater toilets before its subsequent discharge through the disposal facilities provided by the Tourist Marina.

    • c) Unauthorized materials or tools that are strictly prohibited.

    • d) Fishing is not allowed in the Tourist Marina.

    • e) The use of open flames, charcoal or burning wood for barbecue on board the Marine Craft is not allowed during berthing at the Tourist Marina.

    • f) Water skiing, marine races, surfing, water flying, swimming, and diving are not permitted in the Tourist Marina unless expressly authorized by the concerned authorities.

  5. The marina management system should also determine the aspects and requirements of the workers below according to the following:

    • A. The general appearance of the facility (and good maintenance indicators).

    • B. Management Office from inside and outside

    • C. Lighting around the facilities of the Tourist Marina.

    • D. Clear identification of dock structures, mooring vehicles, and mooring buoys, with a permanently installed number

    • E. Sanitation in which the waste disposal facilities provided by the Tourist Marina must be well maintained and emptied frequently

    • F. Providing pumping stations and storage tanks for liquid and solid Marine Craft waste.

Article VI (6) Health, Safety and Environment Department

  • Health, safety, and environmental requirements must be adhered to, as Tourist Marinas must take the following:

    1. All necessary measures to protect the environment and marine wildlife in locations where Maritime and marine activities are carried out within the Geographical Scope.

    2. Commitment to the berthing sites specified according to the approved nautical charts.

    3. Commitment to implement local and international guidelines, directives and instructions for environmental protection issued by the relevant authorities

    4. Any act or activity that causes direct or indirect damage to the environment and marine wildlife shall be carried out within the Geographical Scope as a result of the dumping of waste.

    5. Any act or activity that causes direct or indirect damage to the environment and marine wildlife shall be carried out within the Geographical Scope as a result of the leakage of all types of oils.

    6. Comply with any related regulations issued regarding the protection of the environment and marine wildlife from noise pollution

    7. Adopting all systems and technical means that contribute to preventing pollution.

    8. Commitment to the application of all comprehensive security and safety rules for international navigational systems and marine environment preservation systems.

    9. Clearly distinguish obstacles with special markings for floats.

    10. Placing speed markers inside canals and roads within the boundaries of the Tourist Marina.

    11. The presence of mooring buoys is sufficiently spaced and provide sufficient access to Tourist Marinas.

    12. Provide secure detention areas or berths on both sides to prevent congestion.

    13. Ensure the safety of people including Marine Crafts and those operating the lock or bridge from the risk of fall and damage.

    14. Take all reasonable means to regulate the affairs of Tourist Marinas responsibly and effectively, considering the ability to manage risks and manage crowds.

    15. Take all necessary measures to ensure the safety of persons and their luggage and that they do not contain any hazardous substances.

    16. Conduct a risk assessment and document key findings.

    17. Develop a set of operational guidelines that describe the main procedures to be followed during a hazard.

    18. Update risk assessments and operating instructions annually if necessary.

    19. Develop procedures for recording and analyzing safety incidents (accident investigation and reporting).

    20. Ensure staff training and competencies to deal with all identified risk scenarios.

    21. Ensure effective communication with all staff and beneficiaries.

    22. Conduct periodic inspection to ensure good maintenance of the facility.

    23. Obtain a copy of the safety requirements issued by the General Directorate of Civil Defense and the organization of this activity.

    24. Risk assessment procedures should be provided, and key findings documented according to the following:

      • a) All possible danger sand their consequences.

      • b) The likelihood of risk occurring.

      • c) Existing guarantees.

      • d) Risk reduction procedures according to the design of the marine Tourist Marina site, the expected number of marine vessels and beneficiaries

Article VII (7): Battery charging and refueling stations

Article VIII (8): Flammable Materials

  1. Safety standards must be observed for flammable or hazardous materials stored on site and provided by the Tourist Marina as follows:

    • a) Clear signage and signs follow to classify the safety of materials and products.

    • b) Measures to reduce the use of hazardous substances and to promote the use of environmentally friendly alternative materials.

    • c) Existing measures and controls to address risks specific to materials and products.

    • d) Relevant areas with no smoking signs.

    • e) Flammable materials such as paint and solvents are not stored in battery charging rooms or in mooring vehicles, and relevant signs or notices must be prominently placed or stipulated in the lease.

    • f) Flammable materials should be secured only in areas where fire detectors and stationary firefighting systems are provided.

    • g) Secondary containment storage systems for hazardous materials and waste, for example when they are near or above water

  2. Compliance with health and safety requirements for hazardous materials and methods of their storage in accordance with the legislation in force.

Article IX (9): Lifesaving Equipment for Public Use

Article X (10): Anchorage of Marine Crafts

  • The Marine Craft must be secured at designated mooring areas with available mooring arrangements, and safety aspects that must be considered at Tourist Marinas during risk assessment include the following:

    1. Providing bumpers or other mooring devices evaluated by the Tourist Marina that do not impose a risk to the safety of the Marine Craft, and they shall be replaced and charged to the lessee or user unless otherwise agreed.

    2. The presence of elements installed by the owner or user of the Marine Craft of the raft or pier, and these elements must be subject to immediate removal, and disposal by the Tourist Marina at the expense of the user or tenant unless agreed to do so.
