Implementing Regulation for the Activity of Transporting Goods by Motorized Bicycle for Commercial Purposes

Chapter 1: Preliminary Provisions

Article 1

  • The words and phrases contained in this Regulation shall have the meanings assigned to them in the Law and this Regulation, unless the context of the text dictates otherwise:

    • 1- Law: The Land Transport Law on Roads in the Kingdom of Saudi Arabia, issued by Royal Decree No. (M/188) dated 24/8/1446 AH.
    • 2- Regulation: The Implementing Regulation for the Activity of Transporting Goods via Motorcycles for Commercial Purposes.
    • 3- Activity: The activity of transporting goods via motorcycles for commercial purposes, which is considered a sub-activity of the commercial goods transport activity.
    • 4- Activity of Transporting Goods via Motorcycles for Commercial Purposes: The transport by the establishment of third-party goods for commercial purposes via motorcycles in accordance with the provisions of this Regulation.
    • 5- Service Provider: The establishment practicing the activity of transporting goods via motorcycles for commercial purposes.
    • 6- Motorcycle: A mechanically powered vehicle, with two or more wheels, not designed in the form of a car, and equipped for transporting goods for commercial purposes.
    • 7- Goods Transport Box: A box firmly and immovably fixed on the motorcycle, in accordance with the provisions of this Regulation.
    • 8- Carrier: A special storage bag for preserving transported goods in accordance with the provisions of the Regulation.
    • 9- License: An official document issued by the Authority to the establishment, permitting it to practice the activity of transporting goods via motorcycles for commercial purposes.
    • 10- Establishment: Any legal entity enjoying full legal capacity.
    • 11- Authority’s Electronic Platform: An electronic platform accredited by the Authority, which enables it to access data of the service provider, motorcycles, and drivers.
    • 12- Beneficiary: The sender or the recipient.
    • 13- Driver: Anyone who drives the motorcycle.
    • 14- Professional Driver Card: A document issued by the Authority to the driver in accordance with the conditions and requirements specified in this Regulation.
    • 15- Operation Card: A document issued by the Authority for the motorcycle belonging to the service provider in accordance with the conditions and requirements specified in this Regulation.
    • 16- Goods: Materials, equipment, commodities, foodstuffs, or others transported by motorcycle.
    • 17- Geographical Scope: The operational scope of the motorcycle in the activity, including areas, cities, distances, roads, or any locations determined by the Authority.
    • 18- Inspector: The person authorized to inspect, monitor, and record violations of the Law or Regulation, appointed by a decision from the President.
    • 19- Financial Penalties: The monetary amount that the violator is obligated to pay to the Authority as a result of violating any provisions of the Law or the Violations and Penalties Schedule.
    • 20- Financial Consideration: The amount determined by the Authority in exchange for any licenses, documents, services, or works provided under the provisions of the Law or Regulation.
    • 21- Committee: The committee formed by a decision of the President in accordance with the provisions of the Law.

Article 2

The regulation aims to organize the activity of transporting goods via motorbikes for commercial purposes, develop its services, and encourage investment in it, in accordance with the economic and social development goals in the Kingdom, while taking into account environmental aspects and security and safety requirements.

Article 3

  • Without prejudice to the systems, regulations, decisions, and other relevant instructions in force in the Kingdom, and the international agreements to which the Kingdom is a party:

    • 1- The provisions of this regulation apply to practitioners of the activity of transporting goods via motorbike for commercial purposes.
    • 2- The practice of transporting goods via motorbike for commercial purposes is limited to establishments only.
    • 3- It is prohibited for any person to practice the activity of transporting goods via motorbike for commercial purposes without obtaining the necessary license from the Authority, or to continue practicing it after the license expires, is canceled, or during its suspension period. The prohibition includes all preparatory acts for any person to practice the activity without a license, including: inviting persons, calling them, pursuing them, obstructing them, gathering, or roaming in places where goods are located.

Chapter 2: License

Article 4

  • It is a condition for the establishment to obtain a license for the activity of transporting goods via motorbike for commercial purposes to fulfill the following:

    • 1- An application submitted by the establishment through the Authority's approved channels.
    • 2- A valid commercial register including the activity of transporting goods via motorbike for commercial purposes.
    • 3- A valid social insurance certificate.
    • 4- A valid Zakat and income certificate (if more than one year has passed since the commercial register).
    • 5- The establishment must have previously obtained approval in the experimental regulatory environment for motorbikes, provided that the approval status is (Active).
    • 6- Availability of a center to practice the activity in the city where the license is issued, and shelters for motorbikes in the cities and governorates targeted for practicing the activity, in accordance with the number of motorbikes, and in accordance with the conditions issued by the relevant authorities.
    • 7- Connection to the Authority's electronic platform.
    • 8- Payment of financial fines, if any.
    • 9- Payment of the financial fee, if any.

Article 5

1- The establishment shall fulfill all the conditions and requirements for obtaining the license stipulated in Article (Four) within a period of (90) days from the date of submitting the application; otherwise, the application shall be considered void.

2- A restricted license shall be issued to the establishment upon submitting the application for obtaining the license after fulfilling paragraphs (2, 5) of Article (Four), for a period of (30) days, to enable the establishment to complete fulfilling all the conditions for issuing the license stipulated in Article (Four), provided that the establishment does not practice the activity through the restricted license, and the restricted license shall be canceled after its expiration.

3- The license shall be issued in the name of the establishment, for a period of (1) year, after completing and fulfilling all the requirements stipulated in Article (Four).

Article 6

The licensing conditions stated in paragraphs (2, 6, 7) of Article (Four) are mandatory for its validity, and in the event of any breach of these conditions, penalties shall be imposed in accordance with the approved "Schedule of Violations and Penalties."

Article 7

  • 1- Subject to Article (Four) of this Regulation, the license shall be renewed upon a request from the service provider and after payment of the fee - if any - for a similar period or as deemed appropriate by the Authority, in accordance with the following regulations:

    • A- Submitting the renewal request and fulfilling all its conditions within the period preceding the license expiration date by (60) days, otherwise the request shall be considered void.
    • B- Providing a valid Saudization certificate.
  • 2- It is permitted to submit the renewal request and fulfill all its conditions within (30) days from the expiration of the license for the activity of transporting goods via motorbike for commercial purposes, otherwise the request shall be considered void, without prejudice to the right to impose the prescribed penalties for delay in submitting the request.
