Procedures and Conditions for Licensing the Practice of Public Bus Transport within Cities

Introduction

First: Definitions

  • The following words and phrases - wherever they appear in these Procedures and Conditions - shall have the meanings indicated next to them unless the context of the text requires otherwise:

    • 1 The Authority: The Transport General Authority.

    • 2 The President: The President of the Transport General Authority.

    • 3 The Activity: The practice of public transport by buses within cities.

    • 4 The Entity: Any legal personality with a legal entity such as institutions and companies.

    • 6 The License: A document issued by the Authority granting the Entity permission to practice the Activity in accordance with the provisions of these Procedures and Conditions.

    • 7 The Procedures and Conditions: Procedures and conditions for licensing public transport by buses.

    • 8 The Operating Card: A document issued by the Authority authorizing the bus to operate in the Activity.

    • 9 The Contract: The contract concluded between the Carrier and the entity owning the public transport project by buses within the cities in the city of the License.

    • 10 The Bus: The means of transport used in the Activity and their requirements according to the specifications, conditions, and approved technical equipment.

    • 11 The City of the License: The city or governorate where the Entity has been licensed to practice the Activity.

    • 12 The Carrier: The Entity licensed to practice the Activity.

    • 13 The Passenger: The ultimate beneficiary of the services of the Activity.

    • 14 The Driver: The natural person holding a Driver's Card to operate the bus.

    • 15 The Driver's Card: A document issued by the Authority authorizing the driver to operate the bus in the Activity.

    • 16 The Periodic Technical Inspection: A complete inspection of the bus at one of the approved periodic technical inspection centers.

    • 17 The Technical Equipment: The approved devices and tools that must be available in the bus.

    • 18 The Operational Age: The maximum approved period for using the bus in the Activity.

    • 19 The Project: The public transport project by buses within the cities in the city of the License.

    • 20 The Financial Penalties: The amounts imposed as a result of violating any of the provisions of these Procedures and Conditions.

    • 21 The Financial Consideration: What is allocated to the Authority from financial resources in return for issuing/renewing the License or Operating Cards or Driver Cards or any other services provided by the Authority.

    • 22 The Public Transport System on Roads, and its Executive Regulation: The public transport system on roads in the Kingdom of Saudi Arabia issued by Royal Decree No. (M/25) dated 21/6/1397 AH, and any amendments thereto, and its executive regulation issued by the decision of the Minister of Transport and Logistics Services No. (3) dated 05/01/1412 AH.

    • 23 The Traffic Law and its Executive Regulation: The Traffic Law issued by Royal Decree No. (M/85) dated 26/10/1428 AH, and its executive regulation issued by the decision of the Minister of Interior No. (7019) dated 3/7/1429 AH, and any amendments thereto.

Secondly: License

Third: Procedures for Issuing the License

  • 1- The establishment must fulfill all the conditions and requirements for the License within a maximum period of (60) sixty days from the date of submitting the Claim, otherwise, the Claim shall be considered null and void.

  • 2- The Claim is reviewed by the General Administration of Bus Transport within a period not exceeding (30) thirty days.

  • 3- The License is issued in the name of the establishment, and its duration is one year.

Fourthly

  • The licensing requirements stated in paragraph (1/b) and paragraphs (4-5) of item (Second) are essential for its validity. In the event of a breach of any of these requirements, the license shall be suspended, and the carrier must not engage in the activity during the suspension period, without prejudice to the authority's right to impose the stipulated financial fine for that condition.

Fifthly

  • The carrier is obligated to comply with the regulations and instructions related to the operation of public transport facilities.

Sixth: Renewal of the License

Previous Amendments
  • 1- Subject to the provisions of item (Second), the License shall be renewed upon the request of the carrier for a similar duration, and according to the following regulations:

    • A- Submission of the renewal application and fulfillment of all its conditions during the period preceding the expiration date of the License by (60) sixty days.

    • B- Payment of financial fines (if any).

    • C- Payment of the financial fee (if any).

  • 2- It is not permissible to engage in the activity after the expiration of the License.
    A renewal application may be submitted and all its conditions fulfilled within (90) days from the expiration of the License, otherwise, the License shall be considered canceled, without prejudice to the authority's right to impose a financial fine (if any).

Seventh

  • The establishment may not waive the license granted to it, except with the approval of the authority responsible for managing the project and the agency.

Eighth: Revocation of the License

Previous Amendments
  • 1- The carrier may apply for the cancellation of the License, according to the following controls:

    • A- Obtaining the approval of the authority responsible for managing the Project.

    • B- Changing the registration type of the buses from public transport or public bus to private transport or private bus.

    • C- Paying any financial penalties (if applicable).

    • D- Paying any financial fees (if applicable).

  • 2- The License shall be canceled after the payment of financial penalties – if applicable – in the following cases:

    • A- Cancellation of the Contract concluded with the authority responsible for managing the Project.

    • B- Liquidation of the company, whether by agreement of the partners, expiration of its term, or by a final judicial ruling.

    • C- Death of the owner of the sole proprietorship.

    • D- Subject to what is stated in paragraph (2/c) of this clause, the heirs of the deceased owner of the sole proprietorship may, within (90) ninety days from the date of death, request to rectify the legal status of the establishment to continue practicing the activity; provided that the legal agent of the heirs undertakes to comply with the procedures and conditions stated during the rectification period.

    • E- The passage of (90) days after the expiration of the License without renewal.

Ninth: Buses

  • 1- Without prejudice to the provisions of the Traffic Law and its executive regulations, and the standard specifications approved by the Saudi Standards, Metrology and Quality Organization, the bus shall be designated for public transport within cities, and the president may, by his decision, specify the specifications, conditions, and technical equipment for the bus used in the activity and safety requirements.

  • 2- Buses must be owned by the establishment directly, or through financial lease contracts; provided that the establishment is the actual user of the bus.

  • 3- The type of registration for the bus must be public transport or public bus, in accordance with the Traffic Law and its executive regulations, and obtain the approval of the organization when registering it or renewing its operating license, transferring its ownership, modifying its registration type, replacing its plates, or deregistering it.

  • 4- The operational age of the buses used in the activity must not exceed ten years from the year of manufacture.
