Organizational Arrangements of the National Center for Curricula

  • The Council of Ministers

  • After reviewing in its session held under the chairmanship of the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud, the correspondence received from the Royal Court No. 63744 dated 15/9/1444 AH, including the telegram of His Excellency the Minister of Education No. 4401014947 dated 11/9/1444 AH, regarding the proposal to transform the Curriculum Development Center at the Ministry into a National Curriculum Center.

  • And after reviewingthe Statute of the Education and Training Evaluation Commission, issued by Council of Ministers Decision No. (108) dated 14/2/1440 AH.

  • And after reviewing the rules and arrangements regarding the treatment of employees and workers in the sectors targeted for transformation and privatization, issued by Council of Ministers Decision No. (616) dated 20/10/1442 AH.

  • And after reviewing memoranda No. (1122) dated 2/4/1445 AH, and No. (2665) dated 24/7/1445 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • And after reviewing the minutes prepared by the Council of Economic and Development Affairs No. (45/1365/M) dated 21/7/1445 AH.

  • And after reviewing the recommendation of the General Committee of the Council of Ministers No. (8147) dated 27/7/1445 AH.

  • It is decided as follows:

    • First: To transform the Curriculum Development Center at the Ministry of Education into an independent center named the “National Curriculum Center,” in accordance with its organizational arrangements attached to this decision.

    • Second: By way of exception to the provision of paragraph (2) of Article (Eleven) of the organizational arrangements of the center, the first financial year of the center shall commence from the effective date of the arrangements and end at the end of the following fiscal year of the state.

    • Third: The National Curriculum Center shall review the systems, royal orders, royal decrees, decisions, and instructions related to its competencies, in light of what is contained in its organizational arrangements, propose what is necessary in this regard, and submit what requires action within twelve (12) months from the date of this decision.

    • Fourth: The Board of Directors of the National Curriculum Center shall prepare a draft regulation for the center in light of what is stated in its organizational arrangements and what may appear to it in this regard, and submit it to complete the necessary legal procedures within twelve (12) months from the date of this decision.

    • Fifth: To form a technical committee at the Ministry of Education, including representatives from: (Ministry of Finance, Ministry of Human Resources and Social Development, General Organization for Social Insurance, and the National Curriculum Center), to take the necessary measures to transfer employees, assets, documents, financial appropriations, and initiatives related to the competencies of the National Curriculum Center from the Ministry of Education to the Center. The employees to be transferred from the Ministry to the Center shall be treated in accordance with the provisions contained in the rules and arrangements regarding the treatment of employees and workers in the sectors targeted for transformation and privatization, issued by Council of Ministers Decision No. (616) dated 20/10/1442 AH. The committee shall complete its work within a period not exceeding six (6) months from the date of this decision.

    • Sixth: The Board of Directors of the National Curriculum Center shall exercise its powers stipulated in paragraph (10) of Article (Six) of the center’s organizational arrangements in agreement with the Central Committee for Fees and Financial Charges formed by Royal Court telegram No. 83347 dated 2/12/1444 AH, until the issuance and implementation of the “Regulation on the Practice of Public Authorities and Institutions and Equivalent Entities Imposing Financial Charges for Services and Works Provided.”

    • Seventh: To amend paragraph (5) ofArticle (Four) of the Statute of the Education and Training Evaluation Commission, issued by Council of Ministers Decision No. (108) dated 14/2/1440 AH, to read as follows: “Periodic evaluation of public education curricula according to standards adopted by the Council.”

    • Eighth: By way of exception to the provision of paragraph (1) ofArticle (Five) of the organizational arrangements of the center, His Excellency Mr. Hamoud bin Baddah Al-Muraikhi and His Excellency Mr. Musaed bin Nasser Al-Barak shall be members of the Board of Directors of the center.

Article 1

  • The following words and phrases - wherever they appear in these arrangements - shall have the meanings specified before each of them:

    • Center: The National Center for Curricula.

    • Arrangements: The organizational arrangements of the Center.

    • Council: The Board of Directors of the Center.

    • President: The President of the Council.

    • Chief Executive Officer: The Chief Executive Officer of the Center.

    • Minister: The Minister of Education.

    • Ministry: The Ministry of Education.

    • Commission: The Education and Training Evaluation Commission.

    • General Education: All educational stages up to the end of secondary education or its equivalent.

    • Curricula: General education curricula, which include policies, documents, standards, and frameworks of curricula, educational materials, courses, educational content in its various types, means, tools, and strategies for its delivery, curriculum usage guides, and any documents or educational materials that the Council decides to consider as part of general education curricula.

Article 2

  • 1- The center enjoys legal personality, with financial and administrative independence, and is organizationally linked to the Minister.

  • 2- The main headquarters of the center shall be in the city of Riyadh. Branches or offices may be established within the Kingdom as needed.

Article 3

  • The center aims to achieve the following:

    • 1- To develop curricula in a manner that responds to the requirements of development and national targets in accordance with the latest theories, models, and scientific and educational methods, while considering Islamic constants and national visions and directions, and in line with the best international practices.

    • 2- To be a national center of expertise and a leading scientific and research reference for curriculum development processes at both the regional and international levels.

Article 4

Article 5

  • 1- The center shall have a Board of Directors chaired by the Minister, with the membership of:

    • A- Deputy Minister of Education for General Education.

    • B- Deputy Minister of Culture.

    • C- Deputy Minister of Sports.

    • D- Deputy Minister of Economy and Planning.

    • E- Vice President of the Human Rights Commission.

    • F- President of the Education and Training Evaluation Commission.

    • G- Governor of the Research Development and Innovation Authority.

    • H- One member of the Council of Universities Affairs.

    • I- A representative from the private or non-profit sector in the field of private or community education.

    • J- A member with expertise and specialization in the field of the center's work.

  • 2- The members specified in paragraphs (ح), (ط), and (ي) of paragraph (1) shall be appointed by a decree from the President of the Council of Ministers based on a proposal from the President, and their term of membership shall be (three) years, renewable once.

  • 3- The President shall select a Deputy from among the members representing government entities.

Article 6

  • The Council is the supreme authority of the center, overseeing its operations and managing its affairs. It has the authority - within the limits of the provisions of the arrangements - to make all necessary decisions to achieve its objectives, and in particular, it has the following responsibilities:

    • 1- Approving the draft of the national curriculum strategy and submitting it in accordance with the legal procedures.

    • 2- Approving the national framework for curricula.

    • 3- Approving the policies, frameworks, standards, and regulations governing curricula.

    • 4- Adopting the regulations and making the necessary decisions to implement the center's competencies.

    • 5- Approving the general policies of the center, its work plan, and the programs it follows to achieve its purposes, and monitoring their implementation.

    • 6- Approving the organizational structure of the center and its organizational guide.

    • 7- Approving the financial and administrative regulations that the center operates under, as well as other internal and technical regulations necessary for its operations, provided that the approval of the administrative regulations is in agreement with the Ministry of Human Resources and Social Development, and that the approval of the financial regulations and the provisions with financial implications in other regulations is in agreement with the Ministry of Finance.

    • 8- Approving the establishment of branches or offices for the center.

    • 9- Approving the establishment of specialized research and development centers affiliated with the center to carry out some of its competencies and tasks, organizing their competencies and tasks, work mechanisms, and arranging their financial and administrative situations, with the budget of those centers being part of the budget allocated to the center.

    • 10- Approving the financial fees for the services and licenses provided by the center.

    • 11- Reviewing the periodic reports submitted by the CEO regarding the progress of the center's work.

    • 12- Approving the draft budget of the center, its final account, the report of its auditor, and its annual report, in preparation for submitting them according to the applicable legal procedures.

    • 13- Accepting grants, donations, gifts, bequests, and endowments, in accordance with the legal provisions governing that.

    • 14- Appointing an external auditor (or more) and an internal financial controller.

    • 15- Evaluating the center's performance, monitoring it, and taking necessary corrective actions if required. The Council - in exercising its competencies - may form permanent or temporary committees from its members or others, assigning them tasks it deems appropriate, specifying in the formation decision of each committee its chair, members, and competencies, and allowing them to seek assistance from whom they deem necessary to perform the assigned tasks.

  • The Council may also delegate some of its competencies to the President or to any member or employee of the center as it sees fit.

Article 7

  • 1- The Council shall meet at least (four) times a year at the invitation of the President, and whenever necessary as deemed by the President, or if requested by at least one-third of the members.

  • 2- The invitation to attend the Council meeting shall be sent in writing at least (seven) days prior to the meeting date. The invitation must include the agenda.

  • 3- For the meeting of the Council to be valid, a majority of the members must be present - at least - including the President or his deputy, and the Council's decisions shall be made by a majority of the votes of the attending members. In the event of a tie, the side that the meeting's President votes for shall prevail.

  • 4- No member of the Council may abstain from voting or delegate another member to vote on their behalf in their absence.

  • 5- A member must declare any conflict of interest regarding any item listed on the Council's agenda.

  • 6- The Council may, when necessary and in urgent cases, and as deemed by the President, hold meetings and vote on decisions remotely using technological means. Decisions may be made by circulating them among the Council members, and they shall be signed to indicate that all members have been informed of them. Decisions made in this manner shall not be valid unless they are circulated to all members, voted on by all, and receive at least a majority of their votes. These decisions shall be presented to the Council at the first subsequent meeting for documentation in the minutes of the meeting.

  • 7- The deliberations and decisions of the Council shall be recorded in minutes signed by the meeting's President and the attending members.

  • Any member who objects may record their objection and the reasons for the objection in the minutes of the meeting.

  • 8- The Council may invite specialists and experts to attend its meetings, to provide information, opinions, and advice without having the right to vote.

  • 9- A member may not disclose any of the secrets of the center that they have come to know, even after their membership has ended.

  • 10- The meetings of the Council shall be held at the headquarters of the main center, and may, with the President's approval, be held at any other location within the Kingdom.

  • There shall be a Secretary for the Council from among the center's staff or others, chosen by the Council - based on the President's nomination - and the Council shall determine by a decision the Secretary's tasks, powers, and financial benefits.

Article 8

  • The center shall have an Executive Director, who is appointed and dismissed by a Decision from the Council, which specifies his salary and other financial benefits. He is the executive responsible for managing the affairs of the center, conducting its operations and responsibilities within the limits set by the arrangements and regulations issued under it and as determined by the Council. He shall exercise the following competencies:

    • 1- Proposing what is necessary regarding the National Curriculum Strategy project and submitting it to the Council for consideration of its approval.

    • 2- Proposing the National Curriculum Framework project and submitting it to the Council for ratification.

    • 3- Proposing policies, frameworks, standards, and specific regulations governing the curricula, and submitting them to the Council for approval.

    • 4- Proposing the general policies of the center, the work plan, and the programs that the center follows to achieve its objectives, and submitting them to the Council for approval.

    • 5- Proposing the necessary regulations, projects, and programs within the framework of implementing the center's competencies, and submitting them to the Council for consideration of their adoption.

    • 6- Proposing the organizational structure and organizational guide for the center, its administrative and financial regulations, and the necessary regulations to conduct its work, and submitting them to the Council for consideration of their ratification, and supervising their implementation after approval.

    • 7- Supervising the work of the center and its employees, in accordance with the powers entrusted to him and as determined by the center's regulations.

    • 8- Disbursing from the center's budget and taking all financial procedures, in accordance with the systems and regulations, and within the limits of the powers delegated to him by the Council.

    • 9- Supervising the preparation of the center's annual report, its budget project, and its final account; in preparation for presenting them to the Council.

    • 10- Representing the center before the judiciary and with government agencies, institutions, and other relevant bodies, and other entities inside and outside the Kingdom. He may delegate others in this regard.

    • 11- Preparing periodic reports on the center's activities, achievements, and challenges it faces, and submitting them to the Council; in preparation for completing what is necessary regarding them.

    • 12- Signing agreements and contracts after the Council's approval, or according to the powers granted to him by the Council, and in accordance with the applicable legal procedures.

    • 13- Appointing the center's staff in accordance with the regulations governing that, supervising them, and terminating their services; according to the powers granted to him and as determined by the center's regulations.

    • 14- Contracting with experts, specialists, and consultants in areas related to the center's work.

    • 15- Submitting proposals and recommendations to the Council regarding matters within its jurisdiction.

    • 16- Proposing the services and licenses that the center can provide and the financial compensation for those services and submitting that to the Council; for consideration of their approval.

    • 17- Following up on the implementation of decisions related to the center's work.

    • 18- Preparing performance indicators for the center and submitting them to the Council for approval.

    • 19- Any other competencies assigned to him by the Council.

  • The Executive Director may delegate some of his competencies to whomever he sees fit among the center's staff.

Article 9

  • 1- The resources of the center consist of the following:

    • A- The financial appropriations allocated to it in the state budget.

    • B- The financial fees it receives in exchange for providing services and licenses it issues.

    • C- What the council accepts in terms of gifts, donations, grants, bequests, and endowments.

    • D- Other resources approved by the council, provided they do not conflict with the regulations and instructions.

  • 2- The funds of the center are deposited in a current account of the Ministry of Finance at the Saudi Central Bank.

  • 3- The center opens an account for itself at the Saudi Central Bank, and it may open other accounts at any of the banks licensed to operate in the Kingdom, and it disburses from these accounts in accordance with the center's budget and its approved regulations.
