  • After reviewing in its session held under the chairmanship of the Custodian of the Two Holy Mosques King Salman bin Abdulaziz Al Saud, the correspondence received from the Royal Court No. 67132 dated 28/9/1444 AH, including the telegram of His Excellency the Minister of Education, Chairman of the Board of Directors of the National Center for Educational Professional Development No. 4401055667 dated 22/9/1444 AH, regarding the amendment of the Statute of the National Center for Educational Professional Development.

  • After reviewing the aforementioned draft statute.

  • After reviewing theStatute of the National Center for Educational Professional Development, approved by Council of Ministers Decision No. (197) dated 8/3/1441 AH.

  • After reviewing Council of Ministers Decision No. (616) dated 20/10/1442 AH, regarding the approval of the rules and arrangements for how employees and workers in the sectors targeted by transformation and privatization are treated.

  • After reviewing memoranda No. (1887) dated 28/5/1445 AH, and No. (2666) dated 24/7/1445 AH, prepared by the Bureau of Experts at the Council of Ministers.

  • After reviewing the minutes prepared by the Council of Economic and Development Affairs No. (45/1369/M) dated 21/7/1445 AH.

  • After reviewing the recommendation of the General Committee of the Council of Ministers No. (8225) dated 1/8/1445 AH.

  • It is decided as follows:

    • First: Approval of the Statute of the National Center for Educational Professional Development, according to the attached text.

    • Second: Amendment of Clause (Second) of Council of Ministers Decision No. (197) dated 8/3/1441 AH, to read as follows: "Employees who are decided to be transferred and moved from the Ministry of Education to the Center shall be treated in accordance with the rules and arrangements issued by Council of Ministers Decision No. (616) dated 20/10/1442 AH."

    • Third: The Board of Trustees of the Center shall exercise its powers stipulated in paragraph (8) of Article (Sixth) of the statute - referred to in Clause (First) of this decision - in agreement with the committee concerned with fees and financial charges formed by the Royal Court telegram No. 83347 dated 2/12/1444 AH, until the issuance and enforcement of the (Regulation on the Practice of Public Bodies and Institutions and Equivalent Entities in Imposing Financial Charges for Services and Works Provided).

Article 1

  • The following words and phrases shall have the meanings indicated next to each of them unless the context requires otherwise:

    • Regulation: Regulation of the National Center for Educational Professional Development.

    • Institute: National Center for Educational Professional Development.

    • Council: Board of Trustees of the Institute.

    • Ministry: Ministry of Education.

    • Minister: Minister of Education.

    • Commission: Education and Training Evaluation Commission.

    • Educational Sector: General Education.

    • Beneficiary: Those who benefit from the services and programs of the Institute, including holders of educational positions in the educational sector, and those equivalent to them working in private or non-profit educational institutions, candidates for educational positions, and any other categories determined by the Council to be included in the Institute's services.

    • Educational Professional Development Services: The services provided by the Institute to beneficiaries, in partnership with the Ministry or public, private, or non-profit sector entities. This includes qualifying, developing, and professionally and leadership preparing the beneficiaries, as well as any other forms of development, programs, or developmental services approved by the Council.

Article 2

  • The institute enjoys public legal personality and financial and administrative independence, and is organizationally linked to the Minister. The main headquarters of the institute is located in the city of Riyadh, and it has the authority to establish branches or offices within the Kingdom as needed.

Article 3

  • The institute aims to achieve the following:

    • 1- Support the professionalization of public education and elevate the level of educational professional practices to a level of professionalism.

    • 2- Build a system for professional educational development in the public education sector that is highly efficient and effective, and support its implementation.

    • 3- Organize and provide professional educational development services and programs, ensuring their efficiency and effectiveness in the educational sector.

    • 4- Enhance sustainable professional development in the educational sector by building diverse professional pathways and development frameworks.

    • 5- Prepare educational leaders by identifying and developing them.

Article 4

  • The Institute is considered the competent authority for providing professional educational development services. It has, without prejudice to the competencies of other government agencies, the authority to undertake all necessary actions to achieve its objectives, including the following:

    • 1- Establishing policies, specifications, and procedures for professional educational development services, and preparing and approving the regulations that ensure their implementation.

    • 2- Collaborating with the Authority in preparing and developing a model (framework) of competencies for beneficiaries occupying educational positions.

    • 3- Preparing and approving standards for professional educational development programs that do not culminate in a qualification.

    • 4- Preparing, approving, and implementing professional educational development programs and services for beneficiaries, and determining their standards, regulations, and specifications.

    • 5- Preparing and developing educational leadership and human resources.

    • 6- Establishing and operating branch centers for the Institute - within the approved ceilings for the Institute in the state’s general budget, and in accordance with the applicable laws and procedures - and issuing regulatory bylaws for the activities of those centers, without prejudice to the provisions contained in the regulation.

    • 7- Setting the conditions and requirements for registering qualified practitioners of the professional educational development service.

    • 8- Preparing studies and research, and providing consultations in the areas relevant to the Institute.

    • 9- Representing the Kingdom externally within the limits of its competencies, in accordance with the legal procedures.

    • 10- Organizing seminars, conferences, events, workshops, exhibitions, competitions, and awards - related to professional educational development - and holding and participating in them, in accordance with the applicable procedures.

    • 11- Issuing magazines, periodicals, books, guides, and newsletters related to its missions and activities, in accordance with the applicable laws and procedures.

    • 12- Collaborating with research centers and expert houses at both local and international levels - when necessary - to contribute to achieving its objectives.

    • 13- Designing and establishing educational and training programs and preparatory programs related to the relevant fields, and qualifying trainers to deliver them.

    • 14- Granting academic and training certificates in the relevant fields, in coordination with the relevant authorities.

    • 15- Providing services, works, and initiatives related to the relevant fields.

    • 16- Owning movable and immovable assets and disposing of them, in accordance with the applicable laws.

    • 17- Participating in the membership of institutes, federations, organizations, and regional and international bodies related to its areas of competence, in accordance with the applicable legal procedures.

Article 5

Previous Amendments
  • A- The Institute shall have a Board of Trustees chaired by the Minister, with the membership of:

    • 1- The Director General of the Institute                                                                  Member

    • 2- A representative from the Ministry of Finance                                                         Member

    • 3- A representative from the Ministry of Human Resources and Social Development                Member

    • 4- A representative from the Ministry of Education                                                        Member

    • 5- A representative from the Institute of Public Administration                                              Member

    • 6- A representative from the Technical and Vocational Training Corporation             Member

    • 7- A representative from the Education and Training Evaluation Commission                                Member

    • 8- Two members from the faculty of public universities        Members

    • 9- Representatives from the private education and training sector                          Members

  • B- The ranks of the representatives of government agencies must not be less than (the fourteenth) or its equivalent, and the members specified in paragraphs (9) and (8) shall be appointed by a decree from the President of the Council of Ministers based on a nomination from the President of the Council, and their membership in the Council shall be for a period of (three) years, renewable once.

  • C- The President shall select a Deputy from among the members representing government entities, excluding the Director General of the Institute.

Article 6

  • The Council is responsible for overseeing the management of the Institute's affairs and conducting its matters, and making all necessary decisions to achieve its objectives within the framework of the regulations. It has, in particular, the following responsibilities:

    • 1- Approving the work policies related to the Institute, and the plans, programs, and initiatives necessary for their implementation, and raising any requirements to complete any legal procedures regarding them.

    • 2- Approving the requirements for granting academic and training certificates provided by the Institute.

    • 3- Approving the requirements for appointing and qualifying teachers and trainers.

    • 4- Approving the requirements for designing and establishing educational and training programs and preparatory programs related to the fields of the Institute's specialization.

    • 5- Approving the structure and organizational guide of the Institute.

    • 6- Assigning matters related to the development of educational job holders to the Education Development Holding Company or any of its subsidiaries, in accordance with the applicable legal procedures.

    • 7- Approving the financial and administrative regulations that the Institute operates under, as well as other internal and technical regulations necessary for its operations, provided that the approval of financial regulations and provisions with financial implications in other regulations is in agreement with the Ministry of Finance, and the approval of administrative regulations is in agreement with the Ministry of Human Resources and Social Development, taking into account any rules and instructions issued in this regard.

    • 8- Approving the financial compensation for the services and works provided by the Institute, which the Council deems necessary to collect a financial fee for, in accordance with the applicable legal procedures.

    • 9- Approving the draft budget of the Institute, its final account, and the annual report on its activities; in preparation for completing the applicable legal procedures.

    • 10- Appointing an external auditor (or more) and an internal financial controller.

    • 11- Approving the auditor's report.

    • 12- Approving the establishment of branches, offices, or centers for the Institute.

    • 13- Reviewing the periodic reports submitted to it regarding the progress of work in the Institute, and making the necessary decisions regarding them.

    • 14- Approving the Institute's conclusion of agreements, memoranda of understanding, and contracts, and its membership in institutes, federations, organizations, and regional and international bodies related to its areas of specialization, in accordance with the applicable legal procedures.

    • 15- Accepting gifts, donations, grants, bequests, and the proceeds of endowments, according to the governing rules for that.

    • 16- Forming permanent or temporary committees from its members or others, entrusted with tasks it deems appropriate, specifying in the formation decision of each committee its chairperson, members, and jurisdiction, and allowing it to seek assistance from whom it deems necessary to perform those tasks.

    • The Council may also delegate some of its powers - except for the powers mentioned in paragraphs (1), (2), (3), (4), (5), (6), (7) - to its chairperson or to any of its members or to the Institute's staff.

Article 7

  • 1- The Council shall meet periodically at least three times a year, or whenever necessary as determined by the President - or his delegate - or if requested by at least one-third of its members. The invitation to the meeting shall be sent in writing by the President - or his delegate - at least seven days prior to the meeting date, and the invitation shall include the agenda.

  • 2- The meetings of the Council shall be held at the headquarters of the main body. The President - or his delegate - may, by decision, hold the meeting at any other location within the Kingdom.

  • 3- For the meeting of the Council to be valid, the presence of the majority of the members, including the President - or his delegate - is required, and decisions shall be made by a majority of the votes of those present. In the event of a tie, the side that the President of the meeting voted for shall prevail.

  • 4- The Council may invite any specialists and experts it deems appropriate to attend its meetings, to provide information, opinions, and advice, without having the right to vote.

  • 5- A member of the Council may not abstain from voting nor delegate another member to vote on his behalf in his absence.

  • 6- The deliberations and decisions of the Council shall be recorded in minutes signed by the President of the meeting and the attending members. An objecting member may record his objection and the reasons for it in the minutes of the meeting.

  • 7- The Council, when necessary and in urgent cases as determined by the President - or his delegate - may hold meetings and vote on decisions remotely using technological means. Decisions may be made by circulating them among the members, and they shall be signed to indicate that all members have been informed of them. A decision made in this manner shall not be considered valid unless all members have voted on it. This decision shall be presented to the Council at the first subsequent meeting to be recorded in the minutes of the meeting.

  • 8- The Council shall have a Trustee appointed by the Council - based on the nomination of the President - who shall be responsible for its secretariat, preparing for its meetings, and recording the minutes, deliberations, and decisions.

  • 9- A member of the Council or the Trustee may not disclose any information they have come across regarding the secrets of the body even after the end of their membership.

Article 8

  • The institute shall have a Director General who is appointed and dismissed by a Decision from the Council. The Decision shall specify his salary and other financial benefits, and he shall be responsible for managing the affairs of the institute. His responsibilities are limited to what is stipulated in the regulations and what the Council decides, and he shall undertake the following competencies:

    • 1- Preparing work policies related to the institute, and the plans, programs, and initiatives necessary for their implementation, and submitting them to the Council for consideration and approval.

    • 2- Preparing the requirements for designing and establishing educational and training programs and preparatory programs related to the fields concerned with the institute, and submitting them to the Council for consideration and approval.

    • 3- Preparing the requirements for granting the academic and training certificates provided by the institute, and submitting them to the Council for consideration and approval.

    • 4- Preparing the requirements for appointing and qualifying teachers and trainers, and submitting them to the Council for consideration and approval.

    • 5- Proposing the opening of branches, offices, and centers for the institute within the Kingdom, and submitting it to the Council for approval.

    • 6- Proposing updates to the categories of beneficiaries and the additional developmental services provided by the institute, and submitting it to the Council for consideration and adoption.

    • 7- Following up on the implementation of the Decisions issued by the Council.

    • 8- Proposing the structure and organizational guide for the institute, and proposing its financial and administrative regulations, as well as other internal and technical regulations necessary for its operations; and submitting them to the Council for consideration and approval.

    • 9- Proposing the financial compensation for the services and works provided by the institute and submitting it to the Council for consideration and approval.

    • 10- Supervising the preparation of the institute's annual budget project, the final account, and the annual report of the institute, in preparation for presenting them to the Council.

    • 11- Disbursing from the institute's budget and taking all financial procedures, in accordance with the approved systems and regulations, and within the limits of the powers delegated to him by the Council.

    • 12- Signing agreements, memoranda of understanding, and contracts after the Council's approval.

    • 13- Representing the institute before the judiciary, relevant government agencies, and other entities inside and outside the Kingdom. He may delegate others in this regard.

    • 14- Appointing employees in the institute and supervising them, in accordance with the approved provisions for the institute.

    • 15- Any other work assigned to him by the Council within the scope of his jurisdiction.

    • The Director General may delegate some of his competencies or powers to whomever he sees fit among the institute's staff.

Article 9

  • The resources of the institute consist of the following:

    • 1- What is allocated to it in the state’s general Budget.

    • 2- What the Council accepts in terms of gifts, donations, grants, bequests, and the proceeds of endowments in accordance with the applicable legal procedures.

    • 3- The financial compensation it receives for the services and works it provides.

    • 4- Any other resource approved by the Council for the institute in accordance with its competencies, and in a manner that does not violate the laws and regulations.
