Regulations of the Permanent Committee for Appeals at the Saudi Commission for Health Specialties

Article 1: Definitions

  • The words and phrases mentioned below, wherever they appear in this Regulation, shall have the meanings specified next to each of them unless the context of the text requires otherwise:

  • The Authority: Saudi Commission for Health Specialties.

  • The General Secretary: The General Secretary of the Authority.

  • Appeal Service: An additional service provided by the Authority aimed at reviewing the final decision issued by one of the Authority's departments for its cancellation, modification, or endorsement, and is submitted by the concerned party after their objection to the department that issued the decision.

  • Decision: The final decision issued by one of the Authority's departments.

  • Regulation: Regulation of Appeals at the Authority.

  • Committee: Any committee formed under this Regulation to consider appeals at the Authority. 

  • Committee Member: This definition includes all members of the committee.

  • General Department of Legal Affairs: The General Department of Legal Affairs at the Authority.

Article 2: Formation of the Committee

  • A committee or more shall be formed by a decision of the General Secretary to consider the appeals, and the number of members in any committee shall not exceed six members. The decision to form each committee shall specify its members and its President, provided that the President is a legal advisor.

Article 3: Committee Affiliation

  • The Committee is linked to the General Secretary. 

Article 4: Duration of Membership in the Committee

  • The duration of membership in the Committee shall not exceed two years, renewable, and the Secretary-General has the authority to reconstitute the Committee regardless of the expiration date of the membership term.

Article 5: Rewards for Committee Members

  • Each member of the Committee shall receive (1000) one thousand Riyals, and the Secretary of the Committee shall receive (500) five hundred Riyals for each meeting, provided that the meetings of the Committee do not exceed (48) meetings per year.

Article 6: Objectives

  • The aim of this Regulation – through the work of the Committee – is as follows:

  • 1.     To reduce the cases filed against the Authority before the judiciary.

  • 2.     For the Committee to be the competent authority to consider appeals before resorting to the judiciary.

  • 3.     To improve the administrative procedures, regulations, and policies of the Authority.

Article 7: Duties and Powers of the Committee

  • 1.    Consideration of appeals against the decisions of the authority referred to it – except for what is specifically excluded by a provision in the authority's regulations – before resorting to the competent judicial authorities.

  • 2.    Cooperation and communication with the departments, councils, and committees within the authority.

  • 3.    Raising recommendations issued by it and appropriate solutions and proposed implementation mechanisms for the main impediments that prevent the resolution of appeals to the relevant departments of the authority to avoid them in the future.

  • 4.    Recommending to the Secretary-General regarding the decisions being appealed against for their cancellation, amendment, or endorsement.

Article 8: Appeal Procedures

  • The financial fee for the Appeal service is an amount of (3000) three thousand Riyals, to be fully refunded to the appellant in the event of the cancellation or modification of the decision. 
     

Article 9: Objection Procedure

  • The appellant must file an objection to the decision with the issuing administration before submitting the appeal.

Article 10: Joint Cooperation with Departments

  • All departments, councils, and committees within the authority must cooperate if any data, information, or documents related to appeals are requested.
