Rules Regulating the Vehicle Damage Assessment Branch

  • The Chief Executive Officer of the Saudi Authority for Accredited Valuers.

  • Based on the powers granted to him by law.

  • After reviewingParagraph (sixteen) of Article (twenty-eight) of the Law of Accredited Valuersissued by Royal Decree No. (M/43) dated 09-07-1433H, which includes the authority of the Authority's Board of Directors to issue decisions and rules related to the profession.

  • After reviewing Paragraph (eleven) of Article (eight) of the Regulations of the Powers of the Saudi Authority for Accredited Valuers, issued by the Authority's Board of Directors Decision No. (3/M/23) dated 06-01-1445H, which includes the authority of the Chief Executive Officer of the Authority to issue decisions and rules related to the profession.
     

  • It is decided as follows:

  •  

    • First:

    • Approval of the rules regulating the Vehicle Damage Assessment Branch in the attached format.

    •  

    • Second:

    • All currently operating appraisal centers and all those performing vehicle damage assessments must align their status in accordance with the provisions of the rules approved in item (First) of this decision.

    •  

    • Third:

    • The rules and the decision shall be published in the Official Gazette, and shall be effective from the date of their publication, and any conflicting decisions shall be repealed.

Chapter 1: General Provisions

Article 1

  • 1- The words and phrases contained in these regulations shall have the meanings specified before each of them in Article (1) of the Law of Licensed Appraisers issued by Royal Decree No. (M/43) dated 9/7/1433 AH, and its amendments, and Article (1) of the Implementing Regulation of the Law issued by the decision of His Excellency the Minister of Finance No. (107) dated 28/1/1445 AH, and its amendments.

  • 2- The following words and phrases - wherever they appear in the regulations - shall have the meanings clarified before each of them; unless the context requires otherwise:

    • Regulations: The regulations governing the branch of vehicle damage assessment.

    • Vehicle: Any means of transport prepared to operate on wheels or tracks, powered or towed by mechanical force, excluding trains.

    • Center: A vehicle damage assessment facility that meets the regulatory and professional requirements related to the practice of vehicle damage assessment.

    • Requirements: The technical and regulatory controls -complementary to the controls specified by other relevant authorities- for establishing and operating the center.

    • Track: The track equipped with equipment and devices for assessing vehicle damage.

    • Trucks: Vehicles with a gross weight of not less than (3.5) tons.

    • Special use vehicles and heavy vehicles: Vehicles with a gross weight of not less than (3.5) tons, such as (lifting and handling equipment, tractors, trailers, and buses).

    • Temporary approval: Approval -issued by a decision from the Chief Executive Officer- to practice the profession of vehicle damage assessment before obtaining the license, specified for a certain period not exceeding two years in all cases.

    • Competent administration: The executive administration for strategy and business development.

Article 2

  • The provisions of the rules apply to all accredited appraisers or those who have obtained temporary approval - as the case may be - in the field of vehicle damage assessment.

Article 4

  • The certified appraiser or the one who has obtained provisional approval - as the case may be - is fully responsible for applying the provisions contained in the regulations and what the authority issues in terms of controls and instructions, and the employees in the centers are obligated to adhere to these provisions within the scope of their participation in the practice of the appraisal profession.
