Rules for Granting Financial Rewards to Employees for Detecting Crimes and Violations Stipulated in the Anti-Concealment Law

First: General Provisions

  • 1- The words and phrases mentioned in these rules shall have the meanings set forth in Article (First) of the Anti-Concealment Law, issued by Royal Decree No. (M/4) dated 1/1/1442 AH.

  • 2- These rules aim to grant financial rewards to workers involved in uncovering the crimes and violations stipulated in the law, based on paragraph (6) of Article (Sixth) of the law, in order to motivate them and enhance performance levels in combating concealment.

  • 3- The disbursement of financial rewards to workers involved in uncovering the crimes and violations stipulated in the law shall be from the allocation specified in Clause (Third) of the Council of Ministers Decision No. (785) dated 28/12/1441 AH.

Secondly: Criteria for Determining the Reward

  • The amount of the reward granted to the employee working on uncovering any of the crimes or violations stipulated in the law must be commensurate with his performance evaluation and level of achievements concerning the application of the provisions of the law, taking into account the following criteria:

  • 1- The number of regulatory visits he conducts annually to establishments engaged in economic activities.

  • 2- The number of crimes and violations detected by the employee according to Articles (Three) and (Four) of the law.

  • 3- His adherence to the provisions of the law, regulation, decisions, and relevant instructions.

  • 4- His commitment to the ethical charter for regulatory work approved by the ministry.

  • The employee's evaluation will be based on the criteria mentioned in this clause on an annual basis from the date of the ministerial decision naming him among the employees with the status of judicial seizure.

Third: Mechanism for Evaluating Employee Performance and Determining the Amount of Their Reward

  • 1- The department concerned at the Ministry prepares an annual report on the employee's performance according to the standards mentioned in item (Second) of these rules.

  • 2- An annual reward not exceeding the basic salaries or wages of (three) months is granted to the employee working on uncovering the crimes and violations stipulated in the law, based on the report prepared by the department concerned at the Ministry, and approved by the Minister.

  • 3- By a decision of the Minister, the annual reward for the employee who makes exceptional efforts in combating concealment may be increased to not exceed the basic salaries or wages of (six) months, with a maximum of (15%) of the total number of employees working on uncovering the crimes and violations stipulated in the law.

  • 4- The criteria for exceptional efforts are determined by a decision of the Minister, to include the following:

    • A- The number of crimes and violations detected by the employee must be higher than the average number of crimes and violations detected by all employees.

    • B- Judgments or decisions must be issued based on the crimes and violations detected by the employee; relying on the quality of the employee's procedures in detection and preparation of the case file according to the provisions of the law and regulation.

    • C- The speed and effectiveness of the employee in handling the reports referred to him, and taking appropriate actions regarding them.

    • D- The size of the economic activity subject to the crime or violation, its revenues, the duration of practicing the economic activity, the severity of the crime or violation, its recurrence, and the impact resulting from it.

Fourth: Publication and Enforcement

  • These rules shall be published in the Official Gazette and shall come into effect from the date the law is enforced.
