Exemption Rules in the Anti-Concealment Law

Article 1

  • The words and phrases mentioned in these rules shall have the meanings set forth before each of them in Article (First) of the Anti-Concealment Law, issued by Royal Decree No. (M/4) dated 1/1/1442 AH.

Article 2

  • Taking into account what is stipulated in Article (Thirteen) of the Law, the Criminal Court may exempt anyone who initiates reporting to the Ministry about committing any of the crimes stipulated in the Law from the penalties stipulated in paragraph (1) of Article (Nine) of the Law, and the resulting other penalties on the crime and its proceeds, when the following are met:

    • 1- To cease committing the crime upon reporting it.

    • 2- To report the crime or the identity of any of its perpetrators or participants to the Ministry before its discovery.

    • 3- That none of the crime's perpetrators has preceded him in reporting it.

    • 4- To cooperate with the Ministry and the competent authorities from the date of reporting until the completion of procedures with the parties under investigation in the crime.

    • 5- To provide evidence or information that can be relied upon to prove the crime.

    • 6- Not to destroy, forge, or conceal any information or evidence related to the crime.

    • 7- That his report leads to reaching the proceeds of other crime perpetrators, or to preventing them from controlling it.

Article 3

  • Without prejudice to the authority of the criminal court regarding other mitigating or aggravating circumstances, if the informant does not fulfill what is stated in Article (Two) of these rules; the criminal court may reduce the penalties for him, for any of the following reasons:

    • 1- His advanced age.

    • 2- The nature of his economic and social condition.

    • 3- His good faith.

    • 4- The simplicity of the size of the establishment where the crime occurred and the funds obtained from it.

    • 5- The extent of the contribution of the information and evidence he provided in uncovering and proving the crime.

Article 4

  • These rules shall be published in the Official Gazette and shall come into effect from the date of the enforcement of the law.
