Technical Regulation for Automotive Spare Parts

Article (1) Terms and Definitions

  • 1/ 1 The terms and phrases below - when applying the provisions of this Regulation - shall have the meanings indicated next to them, unless the context of the text requires otherwise:

    • The Kingdom: The Kingdom of Saudi Arabia.

    • The Authority: The Saudi Standards, Metrology and Quality Organization.

    • The Council: The Board of Directors of the Authority.

    • Regulatory Authorities: The governmental entities with regulatory tasks according to their jurisdiction, responsible for implementing or monitoring the implementation of technical regulations, whether at customs points, markets, or factories.

    • Technical Regulation: An approved document from the Board of Directors that sets the characteristics of products and the processes associated with them and their production methods, including applicable administrative provisions that must be adhered to. It may specifically include or address terms, definitions, packaging, and requirements for labeling or marking products, services, processes, or production methods.

    • Standard Specification: An approved document from the Board of Directors that sets - for regular and repeated use - the rules, instructions, or characteristics for products or processes and related production methods, the application of which is optional. It may specifically include or address terms, definitions, packaging, and requirements for labeling or marking that apply to products, services, processes, or production methods.

    • Essential Requirements: The requirements specific to products that may affect safety, health, and the environment; which must be adhered to.

    • Market Survey Authorities: The governmental entity/entities responsible for conducting market surveys.

    • Market Survey: The activities and measures taken by the Market Survey Authorities to verify that products meet the requirements stipulated in the relevant technical regulations and that they do not pose a risk to health, safety, and the environment, or any other aspect related to protecting the public interest.

    • Hazard: A potential source of harm.

    • Risks: The likelihood of a hazard causing harm; related to the degree of harm.

    • Materials: Refers to the following:

      • The manufacturer of the product if established in the Kingdom, or any person who presents their identity as the manufacturer of the product by naming the product in their name or any relevant commercial description, as well as any person who undertakes to renew the product.

      • The manufacturer's agent in the Kingdom if the manufacturer is located outside the Kingdom, or the importer in the absence of the manufacturer's agent in the Kingdom.

      • Any person in the supply chain whose activity may affect the characteristics of the product.

    • Conformity Assessment Procedures: An approved document from the Board of Directors that outlines the procedure used directly or indirectly to assess conformity.

    • Accepted Entities: Conformity assessment entities that have been accepted by the Authority according to the Regulation for the Acceptance of Conformity Assessment Entities.

    • Certificate of Conformity: The certificate issued by the Authority or one of the accepted entities that confirms the conformity of the product or any batch of it with the requirements of the relevant standard specifications.

    • Supplier's Declaration of Conformity: A declaration from the supplier themselves that their product complies with the applicable legislative requirements, without any mandatory intervention from a third party - neither at the design stage nor at the production stage of the manufacturing process - and the declaration may rely on conducting tests on the product according to the relevant legislation.

    • Saudi Quality Mark: A mark approved by the Authority indicating that the establishment has an effective management system that ensures the production of a product compliant with the Regulation and the granting procedures and the relevant Saudi standard specifications.

    • Market Status: The status of the product in the Kingdom's market, for which either the manufacturer or the importer is responsible.

    • Market Offering: Any supply of the product for distribution, consumption, or use in the Kingdom within a commercial activity, whether for monetary compensation or without compensation.

    • Withdrawal: Any action aimed at preventing products from being offered in the market and in the supply chain.

    • Recall: Any action aimed at retrieving products that have been provided to the end user, according to the recall regulation.

    • Product: Vehicle spare parts (automobiles).

    • Vehicle: A vehicle powered by an engine and equipped with four wheels that does not run on rails or cables or similar, including light and heavy service vehicles, passenger vehicles, multipurpose passenger vehicles, buses, and trucks used for transporting goods or towing trailers and semi-trailers, excluding motorcycles and trailers.

    • Manufacturer: The establishment that has the technical responsibility for manufacturing automotive spare parts and is responsible for their production.

    • Country of Origin: The country where the parts are manufactured, or the country where the final spare part is assembled, when some parts of the spare part are manufactured in more than one country.

    • Original Spare Parts: Parts designed and manufactured to replace according to the specifications of the vehicle manufacturer to perform a specific function from the vehicle manufacturer or the manufacturer who produces the parts according to the same specification and quality control system of the vehicle manufacturer.

    • Commercial Spare Parts (Conformity): Spare parts that conform to international standard specifications or specifications of the country of origin or specifications of the spare parts manufacturer, achieving the performance requirements of the vehicle manufacturer according to the standards specified in the Gulf standard SASO GSO 171 and manufactured by a third party (not the vehicle manufacturer or its supply chain) as replacement parts for vehicles.

    • Supply Chain: All stages that the product goes through after its manufacture until it reaches the consumer, including its packaging and wrapping, or supplying, transporting, storing, delivering, or selling it wholesale or retail, and any other related process.

  • 2/1 The words and phrases contained in this Regulation shall have the meanings provided in the applicable laws, regulations, and decisions of the Authority.

Article (2) Scope

Previous Amendments

This Regulation applies to new spare parts for vehicles (cars); as specified in Appurtenance (1), whether manufactured within the Kingdom or imported from abroad, in accordance with the definitions and related terms provided in Article (1).

Exempt from this Regulation are all products related to tires, car batteries, and safety barriers, as they are covered by other technical regulations.

Article 3 - Objectives

  • The aim of this Regulation is to define the basic requirements for automotive spare parts covered by this Regulation, and the conformity assessment procedures that suppliers must adhere to, in order to ensure that these products meet the basic requirements aimed at preserving the environment and the health and safety of consumers, as well as facilitating market procedures.

Article 4: Obligations of the Supplier

  • The supplier must comply with the following requirements:

  • 4/1 Technical Requirements

  • To meet the requirements of this regulation, the supplier must fulfill the essential characteristics of automotive spare parts, as follows:

    • 4/1/1 The automotive spare parts supplied must meet the technical requirements specified in the standard specifications outlined in Appendix (1) of this regulation. In the absence of Gulf or Saudi standard specifications, the spare parts must comply with one or more of the international or regional standard specifications or the country of origin (national) specifications or the specifications of the spare parts manufacturer, ensuring that they meet the performance requirements of the vehicle manufacturer according to the standards specified in Gulf Standard 1712 SASO GSO.

    • 4/1/2 The importation of used, refurbished, or expired spare parts is prohibited, except for major spare parts such as:

      • - Bodies (chassis).

      • - Engine (motor).

      • - Differential gearbox (differential).

      • - Gearbox (gearbox).

        These must be packaged, clean, free from grease and oils, and labeled with the term "refurbished" in a non-removable manner, along with the supplier's declaration of compliance for these parts.

    • 4/1/3 The manufacturer must have an effective quality management system (a manufacturer holding a management system certificate according to ISO/TS 16949 "the special requirements for the application of ISO 9001 in the field of automotive production and related spare parts" - or its equivalent - is considered to meet the requirements of this clause).

    • 4/1/4 The supplier must cooperate with regulatory authorities and market survey authorities, such as providing documentation of the technical file, certificates of conformity, and any other documented information proving the product's compliance with the requirements of this regulation, whenever requested.

    • 4/1/5 Deleted.

  • 4/2 Packaging Requirements

    • 4/2/1 Ensure that the packaging materials for spare parts are free from acetone, lead, or any heavy metals.

    • 4/2/2 Ensure that the plastic packaging or materials for the product carry a biodegradable plastic label if these materials are included in the scope of the biodegradable plastic regulation, or a recycling symbol if using recyclable plastic packaging.

    • 4/2/3 Each piece must be placed in a sealed package whenever possible.

    • 4/2/4 The following information must be indicated on each package:

      • ‌A- Manufacturer's name or brand.

      • ‌B- Country of manufacture.

      • ‌C- Name or number of the part according to the manufacturer's classification in the manufacturer's catalog.

      • ‌D- Quantity in the package.

      • ‌E- Vehicle models compatible with the spare parts unless specified in the manufacturer's catalog.

      • ‌F- Safe operating parameters (such as an arrow indicating the installation method) if necessary.

      • ‌G- Any conformity mark – if available.

      • ‌H- Installation instructions in Arabic or in both Arabic and English whenever possible.

      • ‌I- Environmental and general safety information.

  • 3/4 Transportation and Storage Requirements

  • The manufacturer may propose any specific requirements related to transportation and storage - whenever appropriate, such as:

    • 1/3/4 Storage on shelves or special storage means.

    • 2/3/4 Storing spare parts according to the manufacturer's guidelines and good practices in this regard.

    • 3/3/4 Indicating the temperature and the importance of controlling it.

    • 4/3/4 Indicating the humidity level and the importance of controlling it with details - if available.

    • 5/3/4 Dust control, and the necessity of that.

    • 6/3/4 Identifying storage locations (open areas exposed to sunlight or specially built rooms).

    • 7/3/4 The supplier must ensure that the storage or transportation conditions do not affect the product's compliance with the requirements stipulated in this technical regulation and the approved standard specifications.

  • 4/4 Metrological Requirements

    • International System (SI Units) or its multiples or parts must be used during design, manufacturing, or trading.

Article (5) Explanatory Data

Previous Amendments
  • 1/5 The explanatory data on the product must comply with the technical requirements set forth in this technical regulation and the relevant standard specifications; as detailed in Appendix (1).

  • 2/5 Spare parts must be imported unseparated from their packaging, and the data specified in item (4/2/4) must be clearly indicated on each part in a manner that is difficult to remove.

  • 3/5 All information used in the explanatory data must be accurate and substantiated.

  • 4/5 When it is not possible to package spare parts due to size or other reasons, the data specified in item (4/2/4) must be indicated on each part or in the documents accompanying the spare parts.

  • 5/5 The images and phrases used on the product packaging must not violate public order, public morals, and the prevailing Islamic values in the Kingdom.

Article (6) Procedures for Conformity Assessment

Article 7 Responsibilities of Regulatory Authorities (Ports and Factories)

The regulatory authorities, as part of their jurisdiction and powers, shall undertake the following:

1/7 The regulatory authorities shall verify that automotive spare parts subject to this Regulation meet the specified conformity assessment procedures and that the technical documents accompanying the shipments are available at the ports and factories.

2/7 The regulatory authorities have the right to randomly withdraw samples of automotive spare parts subject to this Regulation and refer them to specialized laboratories to ensure their compliance with the requirements set forth in this Regulation.

3/7 The regulatory authorities have the right to charge suppliers (manufacturers and importers) for the costs of conducting tests and related matters.

4/7 In the event of a non-compliance issue with the product, the regulatory authority shall withdraw the concerned products from the warehouses and take the legal actions against them.

Article 8 Responsibilities of Market Survey Authorities

Previous Amendments

The market surveillance authorities, as part of their jurisdiction and powers, shall carry out the following:

1/8 Implement market surveillance procedures on products displayed in the markets, as well as products stored in suppliers' warehouses, to verify the safety of the products and their compliance with the essential requirements outlined in this Regulation and the relevant standard specifications.

2/8 Withdraw samples of the product, whether from the market or suppliers' warehouses (manufacturers and importers), in order to conduct the necessary tests and ensure their compliance with the requirements stipulated in this Regulation.

3/8 In the event of detecting a non-compliance of a product - whether displayed or stored - with the requirements of this Regulation, the market surveillance authorities shall take all administrative actions for the withdrawal and recall of the concerned product, and the procedures and penalties referred to in Article (9) shall be applied, after taking the necessary actions.

Article 9: Violations and Penalties

Previous Amendments
  • 1/9 It is prohibited to manufacture and import products that do not comply with the provisions of this technical regulation, as well as to place and display them in the market, or even to announce them.

  • 2/9 The failure of a product to meet the requirements of this regulation is considered sufficient grounds for market surveillance authorities and regulatory bodies to determine that this product is non-compliant, which may pose a risk to consumer health and safety and to the environment, in the following cases:

    • أ) Failure to affix compliance marks or the Saudi Quality Mark - if available - or to affix them incorrectly.

    • ب) Failure to issue a certificate of compliance or the supplier's declaration of compliance, or issuing them incorrectly.

    • ج) Lack of or incomplete technical documentation (the technical file of the product, declaration of compliance ...), or containing incomplete or incorrect information.

    • د) Lack of or incomplete explanatory data or usage instructions (if applicable).

  • 3/9 Upon detecting any violation of the provisions of this regulation, the market surveillance authorities - as applicable - shall take all necessary measures to remove the violation and its effects from the market, and they may:

    • أ) Assign the violating entity - responsible for placing and displaying the non-compliant product - to withdraw it from warehouses or the market in order to correct the violation, if possible, or to export it, or to destroy it (depending on the nature of the product) within the timeframe specified by the market surveillance authorities.

    • ب) Withdraw, seize, or destroy the products, or take any other action to recall them from the markets, and the market surveillance authorities - as applicable - shall announce the recall of the product from the markets, charging the violating entity all costs incurred as a result.

    • ج) Handle the non-compliant products covered by this regulation in accordance with the provisions set forth by the applicable laws and regulations of the regulatory bodies and market surveillance authorities.

  • 4/9 Upon detecting a violation related to automotive spare parts, the authority shall take the necessary actions against these products that do not comply with the requirements of this regulation, including revoking the related certificate of compliance, and taking necessary measures with the accredited entity that issued the certificate in accordance with the regulation for the acceptance of conformity assessment bodies.

  • 5/9 Without prejudice to any harsher penalties under the applicable laws, any person who violates the requirements of the approved standard specifications for products covered by this technical regulation shall be punished with the penalties stipulated in the Anti-Commercial Fraud Law.

Article 10 General Provisions

Previous Amendments

1/10 The supplier bears full legal responsibility for implementing the requirements of this Regulation, and is subject to the penalties stipulated by the Commercial Fraud Law and/or any related regulations, if it is proven that they have violated any article of this Regulation.

2/10 The supplier is responsible for ensuring that the spare parts they supply are from licensed manufacturers in the country of origin.

3/10 If the spare parts consist of more than one component manufactured in more than one country and assembled in another country, the country of origin considered shall be the country where this component was assembled, taking into account the regulations governing this matter.

4/10 In the case of importing spare parts by the manufacturer or their agent, they must be supplied only from the vehicle manufacturing companies, and if the parts are not manufactured by the automobile manufacturers, they must be supplied from the approved companies. They are not permitted to combine the activity of supplying original spare parts with the supply of commercial spare parts.

5/10 This Regulation does not exempt the supplier from complying with all other applicable laws and regulations in the Kingdom related to the trading, transportation, and storage of the product, as well as the regulations related to the environment, security, and safety.

6/10 All suppliers of automotive spare parts - subject to the provisions of this Regulation - must provide inspectors from regulatory authorities and market survey authorities with all facilities and information they request to carry out their assigned tasks.

7/10 If any situation arises that cannot be addressed under the provisions of this Regulation, or if any dispute arises in its application, the matter shall be referred to a specialized committee in the authority to issue the appropriate decision regarding this situation or dispute, in a manner that serves the public interest.

8/10 The supplier may submit a new request after the reasons for the rejection of the request have been resolved, and after making the necessary corrections to the reasons that led to the rejection, and paying any additional costs determined by the authority.

9/10 The authority shall study the complaints received regarding products that have obtained a certificate of conformity or a quality mark - if available - verify the validity of these complaints, and take legal action in the event of any violations being proven.

10/10 The authority has the right to revoke the certificate of conformity if the supplier violates the provisions of this technical regulation, or to revoke the license to use the quality mark in accordance with the general technical regulation for the Saudi quality mark, and to take legal actions that ensure the preservation of the authority's rights.

11/10 If any modifications are made to the product during the validity period of the certificate of conformity or the license to use the quality mark (except for formal modifications that do not affect the safety of the product), the certificate or license becomes invalid for this product, and a new application must be submitted.

12/10 Only the authority has the right to interpret the provisions of this Regulation, and all beneficiaries of the application of this Regulation must comply with the interpretations issued by the authority.
