The Regulations of Car Transport and Vehicle Towing Activity

Preamble

  • The Regulation aims to organize the activity of vehicle transfer and towing of vehicles using technically equipped vehicles, enhance road safety, protect the environment, and improve competitiveness to provide the best services, as well as to regulate the contractual relationship between all parties involved in the transfer process.

 

Chapter 1: Preliminary Provisions

Article (1):

  • The following terms, whenever stated in this Regulation, must have the meanings assigned herein, unless the context requires otherwise:

    • 1. Authority: The Transport General Authority

    • 2. President: The President of the Transport General Authority

    • 3. Activity: Car transport and vehicle towing on the roads using a transport vehicle and / or towing vehicles for a charge

    • 4. Transport vehicle: A vehicle equipped with a technical equipment for transporting cars

    • 5. Towing vehicle: A vehicle equipped to tow only one vehicle on the roads

    • 6. Car: An automatic motor vehicle used to transport passengers or goods and its capacity does not exceed (8) people

    • 7. Vehicle: Every means of transport designed to transport passengers or goods and is driven by automatic power, and it does not include trains and marine vehicles

    • 8. Person: Any natural or legal person

    • 9. Establishment: Every legal person with a legal entity such as sole corporations and companies.

    • 10. Individual: Every natural person.

    • 11. License: A document issued by the Authority authorizing the person to practice the activity in accordance with the provisions of this Regulation.

    • 12. Carrier: The licensed person to practice the activity.

    • 13. Consignor: The person who made a contract with the carrier to transport a car or tow a vehicle on roads for the consignee, whether he is the owner or the authorized person

    • 14. Consignee: The person who receives the car or the vehicle from the carrier or authorizes someone to receive it on his behalf

    • 15. Operation Card: A document issued by the Authority authorizing the transport or towing vehicle to operate according to the provisions of this regulations.

    • 16. Center: the place where the establishment perform the activity in accordance with this regulation.

    • 17. Driver: The natural person who is licensed to drive the transporting/towing vehicle

    • 18. Periodic inspection center: A technical inspection center licensed by the General Traffic Department to periodically conduct a comprehensive technical inspection of transport or towing vehicle.

    • 19. Periodic technical inspection certificate: A document issued by the periodic inspection center after the transport or towing vehicle has passed the inspection requirements

    • 20. consignment note: A document issued under the contract of carriage and is considered proof that the carrier has received the car under transportation, or the vehicle under towing, in the condition indicated therein for delivery to the consignee in the same condition.

    • 21. Technical inspection on roadside: A sudden technical examination of a transport or towing vehicle performed by the service controller or whoever is assigned this task by the Authority in a safe area on roadside

    • 22. Movable inspection unit: A mobile system to carry out technical checks of the transporting or towing vehicle, in a more detailed way than checking for the apparent condition

    • 23. Service Controller: The person assigned with the control and inspection power to ensure compliance with the provisions of this Regulation, and taking the necessary action in the event of a breach of any provision.

    • 24. Control record: A paper or electronic form containing violations of the provisions of this Regulation.

    • 25. The authority electronic platform: An electronic platform that allows the authority to automatically track the locations of transport and towing vehicles and determine their speeds and weights, including monitoring the driving and rest periods of the driver, and checking the legal status of the vehicle and the driver

    • 26. Financial due: The financial resources allocated to the Authority in return for issuing / renewing the license, operating cards, drivers’ cards, or any of the other services provided by the Authority.

    • 27. Financial fines: Amounts imposed because of violating any of the provisions of this Regulation.

    • 28. Public Transport law: The Law of Public Transport on Roads of the Kingdom of Saudi Arabia promulgated by the Royal Decree No. (M / 25) dated 21-06-1397 H, and any modifications or updates thereto

    • 29. The regulation: The Regulations of Car Transport and Vehicle Towing Activity

    • 30. Traffic law and its Executive Regulations: Traffic Regulations promulgated by Royal Decree No. (M / 85) dated 26-10-1438H and its executive regulations promulgated by the Minister of Interior Decree No. 7019 and dated 3-7-1429H, and any updates thereto

 

Article (2):

  • Without prejudice to the provisions of the Traffic law, it’s executive regulations, the relevant regulations and resolutions, and the provisions of international agreements to which the Kingdom is a party therein:

    • a. The provisions of this regulation apply to the work of transporting cars and with a maximum of two cars on the transport vehicle, and on towing vehicles on the roads using vehicles equipped technically for a charge or for the own account, which are implemented domestically and to the outside of the Kingdom of Saudi Arabia, and this regulation is considered as one of the public transport law's regulations on the roads.

    • b. The provisions of this regulation do not apply to transportation or towing vehicles owned by government agencies as long as the transportation is not practiced for a charge.

Article (3)

  • The activity must be carried out in accordance with the provisions of this regulation by :

    • 1. Establishments after obtaining a license .

    • 2. Saudi individuals after obtaining a license.

Chapter 2: License

Article (5)

  • 1. The establishment fulfills all the conditions and requirements for issuing the license within a maximum period of (90) ninety days from the date of submitting the application, otherwise the application will be considered null.

  • 2. The license is issued by the authority in the name of the establishment for a period of three years, and the activity must not be practiced after its termination, cancellation, or suspension.

Article (6)

  • 1. The licensing conditions set forth in Paragraph (1/b) and Paragraphs (2, 3, 5) of Article (4) are inherent in its validity. In the event of violating any of these conditions, the license will be suspended, and the carrier must not practice the activity until fulfillment of that condition, without prejudice to the authority's right to impose the financial fine prescribed for that condition.

  • 2. If there is a shortage in the minimum number of transport vehicles required to practice the activity as a result of accidents or disasters beyond the control of the establishment, and the shortage has not been completed within (180) one hundred and eighty days from the date of the deficiency, the license must be suspended, without prejudice to the authority's right to impose the prescribed financial fine for that.
