In this Law, the following words and phrases shall have the meanings assigned thereto, unless the context requires otherwise:
Kingdom: Kingdom of Saudi Arabia.
Territory: Lands and the territorial waters under the sovereignty of the Kingdom, and the air space thereover.
Law: Law of Civil Aviation Tariff.
Regulations: Implementing Regulations of this Law.
GACA: General Authority of Civil Aviation.
Board: GACA’s Board of Directors.
President: President of GACA.
Aircraft: Any machine that can derive support in the atmosphere from the reactions of the air other than the reactions of the air against the earth's surface.
Aerodrome: A defined area on land or water (including any buildings, installations, and equipment) intended to be used either wholly or partially for the arrival, departure, and surface movement of aircraft.
International Aerodrome: An aerodrome designated by the Kingdom within its territory for the entry and exit of international air traffic where the procedures pertaining to customs, passport control, health, and quarantine, including animal and plant quarantine, and other similar procedures are implemented.
Regional Aerodrome: An aerodrome designated by the Kingdom within its territory to receive scheduled domestic flights, in which specific international aerodrome services are available, such as passport control and customs, for the purpose of receiving international flights, when needed.
Domestic Aerodrome: An aerodrome designated by the Kingdom within its territory to receive domestic flights, without providing international flight procedures such as passport control, customs, and the like.
Charges: Amounts paid for services rendered by GACA, such as navigational services, issuance and renewal of permits and licenses, use of aerodrome installations and facilities, and the like.
Rent: An amount paid under an investment lease contract for property utilization or paid for investment in commercial facilities, such as terminals, baggage service areas, buildings, lands, shops, and the like.
Register: The Saudi National Aircraft Register, prepared and supervised by GACA.
National and foreign air carriers, companies or sole proprietorships, shall pay the charges due for civil aviation services for carrying out their operations and domestic and inbound and outbound international flights, as well as charges for flying over the Kingdom’s airspace, in accordance with the provisions of this Law and its Regulations.
Due charges under this Law shall be paid in Saudi riyal or a convertible foreign currency.
1 - The amounts of wages and rents stipulated under this Law shall be collected and deposited in the Authority's account at the Saudi Central Bank in accordance with the regulations in force in the Kingdom.
2 - In the event of a delay in the payment of wages beyond the due date, despite repeated demands for payment, and in the absence of a guarantee from which the wage amount can be collected, the delayed payer shall be considered as obstructing, and a delay fine not exceeding (30%) thirty percent of the amount due shall be collected from him, and the fine shall be deposited in the public treasury of the state.
3 - The Authority shall include in the contract it concludes with the tenant a clause obligating him to provide a bank guarantee upon signing the contract equivalent to (30%) thirty percent of its value, as a guarantee for the payment of the rent due from him. This guarantee shall remain valid and non-cancellable except after the expiration of the contract term and with the Authority's approval, and any amount due from the tenant shall be collected from it immediately upon its due date in accordance with the provisions of the contract, with a demand for him to cover any shortfall in the guarantee amount immediately.
The Board may determine the charges to be collected from each individual departing the Kingdom through any of its aerodromes, as well as the cases where such charges are not collected.
An aircraft may not depart from an aerodrome prior to the payment of all due charges, unless the entity to which the aircraft belongs has an official agent or representative in the Kingdom authorized by GACA; in such case the due charges shall be collected from such agent or representative, in accordance with the provisions of this Law and its Regulations.
The aircraft charges provided for in this Law shall be calculated based on the maximum takeoff weight, as indicated in its airworthiness certificate.
Fractions starting from 500 kg shall be rounded up in all weights. Any weight below 500 kg shall not be calculated.
GACA shall collect due charges for air carriage operations and domestic flights and inbound and outbound international flights in accordance with the Regulations, for the following categories:
1. Landing.
2. Hangaring.
3. Air navigation for passing and landing aircraft.
4. Transporting passengers using various means including jet bridges.
5. Security services for each aircraft departing from any aerodrome in the Kingdom, excluding aircraft of international connecting flights and cargo aircraft.
6. Guarding services for aircraft, upon request.
7. Aircraft towing upon the owner's request.
8. Use of vehicles and ground support equipment designated for aircraft services for one year or parts thereof.
