Statute of the National E-Learning Center

Article 1

  • The following words and phrases - wherever they appear in this regulation - shall have the meanings specified next to each:

    • Regulation: Regulation of the National E-Learning Center.

    • Minister: Minister of Education.

    • Center: National E-Learning Center.

    • Council: Board of Directors of the Center.

    • President: President of the Council.

    • Director: General Director of the Center.

    • E-Learning: The use of educational, information, and communication technologies to enhance the effectiveness of the educational and training process in all its forms and to ensure its quality.

Article 2

  • The center enjoys legal personality and financial and administrative independence, and is organizationally linked to the Minister, with its headquarters located in the city of Riyadh.

Article 3

  • The center aims to regulate the quality of e-learning, and for this purpose - without limitation - it has the following:

    • 1- Establishing regulations and quality standards in the field of e-learning.

    • 2- Regulating the quality of e-learning programs.

    • 3- Granting licenses to entities and companies providing e-learning programs that offer accredited certificates.

    • 4- Qualification for the licenses granted to entities and companies providing e-learning programs.

    • 5- Supervising the national program for open educational content.

    • 6- Conducting research and studies in the field of e-learning.

    • 7- Providing consultations in the field of e-learning.

    • 8- Organizing conferences, meetings, and workshops.

    • 9- Representing the Kingdom externally in the field of e-learning.

Article 4

Article 5

  • 1- The Council shall meet at the invitation of the President once every three months, or whenever deemed necessary by the President. The invitation must be sent in writing at least seven days prior to the meeting, and it should include the agenda.

  • 2- The meetings of the Council shall be held in the presence of the majority of the members, including the President or a member designated by him from the representatives of government entities.

  • 3- The decisions of the Council shall be issued by a majority of the votes of those present, and in the event of a tie, the side that the President of the meeting voted for shall prevail.

  • 4- The President may invite any representatives of government entities not represented in the Council, or experts, or specialists, to attend the meetings of the Council, without having the right to vote.

Article 6

  • The Council is responsible for overseeing the management of the center's affairs and conducting its matters, and it makes all necessary decisions to achieve its objectives within the framework of the regulations. In particular, it has the following responsibilities:

    • 1- Establishing the general policies for the center and the work plan it follows to achieve its purposes, and monitoring the implementation of that.

    • 2- Approving the center's plans and programs.

    • 3- Approving quality standards in the field of e-learning and its regulations.

    • 4- Approving the licensing and qualification regulations for e-learning programs.

    • 5- Approving the financial regulations of the center in agreement with the Ministry of Finance.

    • 6- Approving the administrative regulations that the center operates under and other internal regulations necessary for managing the center's affairs.

    • 7- Approving the organizational structure of the center.

    • 8- Approving the establishment of branches and offices for the center.

    • 9- Determining the financial compensation for the services and works provided by the center that the Council deems appropriate to charge a fee for.

    • 10- Approving the financial investment policy of the center in accordance with the laws.

    • 11- Accepting gifts, donations, grants, bequests, and endowments in accordance with the governing provisions.

    • 12- Approving the draft budget of the center, its final account, the auditor's report, and the annual report, and submitting what is necessary according to the applicable legal procedures.

    • 13- Reviewing the periodic reports submitted to it regarding the progress of work in the center, and making the necessary decisions regarding them.

  • The Council, in exercising its powers, may form permanent or temporary committees from among its members or others, assigning to them tasks it deems appropriate, and specifying in the decision to form each committee its chairperson, members, and responsibilities, and it may seek assistance from whomever it deems necessary to perform the tasks assigned to it.

  • The Council may also delegate some of its powers to its chairperson or to any member it sees fit or to the staff of the center.

Article 7

  • The General Director of the Center shall be appointed -by a decision of the Council- and the decision shall specify his salary and other financial benefits. He shall be the executive responsible for managing the Center, and his responsibilities shall be limited to what is stipulated in the regulations and what is decided by the Council. He shall exercise the following competencies:

    • 1- Proposing the Center's plans and programs, and supervising their implementation after the Council's approval.

    • 2- Proposing the necessary regulations for the operation of the Center, and determining the work procedures based on the policies, regulations, and decisions issued by the Council.

    • 3- Proposing quality standards in the field of e-learning and their controls, in preparation for presenting them to the Council.

    • 4- Proposing the licensing and qualification controls for e-learning programs; in preparation for presenting them to the Council.

    • 5- Proposing the organizational structure of the Center, along with its financial and administrative regulations, and presenting them to the Council, and supervising their implementation after approval.

    • 6- Supervising the preparation of the Center's annual report, its budget draft, and its final account; in preparation for presenting them to the Council.

    • 7- Disbursing from the Center's budget and taking all financial actions, in accordance with the regulations and rules, and within the limits of the powers delegated to him by the Council.

    • 8- Providing periodic reports to the Council about the Center's activities, achievements, and initiatives.

    • 9- Appointing the Center's staff in accordance with the regulations governing that, and supervising them according to the powers granted to him and what is specified in the Center's regulations.

    • 10- Following up on the implementation of the Council's decisions.

    • 11- Proposing the financial investment policy for the Center; in preparation for presenting it to the Council.

    • 12- Signing agreements and contracts after the Council's approval, and in accordance with the applicable legal procedures.

    • 13- Representing the Center before the judiciary, and before government entities, institutions, and other relevant bodies, as well as other entities inside and outside the Kingdom.

  • The Director of the Center may delegate some of his competencies to whomever he sees fit among the Center's staff.

Article 8

Previous Amendments
  • 1- The resources of the center consist of the following:

    • A- The allocations designated for it in the state’s general Budget.

    • B- The financial compensation that the center receives for the works and services it provides.

    • C- The returns on investments of its available financial resources.

    • D- Any donations, contributions, grants, bequests, and endowments accepted by the Council.

    • E- Any other resource approved by the Council, provided it does not violate the regulations and instructions.

  • 2- The funds of the center are deposited in a designated account at the Saudi Central Bank, and it may open other accounts for this purpose at any of the banks licensed to operate in the Kingdom, and expenditures from these funds are made according to the center's Budget.

Article 9

  • The financial year of the center is the financial year of the state. Exceptionally, the first financial year shall commence from the date of the enforcement of the regulation and shall end at the conclusion of the financial year of the state.

Article 10

  • The employees of the center are subject to the Labor Law and the Social Insurance Law.
