A committee shall be formed from the employees of the Authority immediately upon the transfer of jurisdiction to it, and it shall undertake the inventory of the assets covered by the Law and document this in a record. The Authority may seek assistance from specialized companies and consulting offices to inventory the assets and settle the costs incurred from those assets.
The Authority may correspond with the relevant legal and administrative entities such as the courts, notary offices; the Saudi Central Bank; the Ministry of Foreign Affairs; the Ministry of Finance; the Ministry of Social Affairs; the Capital Market Authority, and others to verify the assets owned by those under its jurisdiction, whether they are cash, real estate, or shares within or outside the Kingdom.
The movable property that is identified from its location to the possession of the authority shall not be transferred except in accordance with the following provisions and conditions:-
1. It must be in excess of the living needs of the person under guardianship.
2. It must be fully owned by him; if it is co-owned, it must first be divided and separated.
3. It must not be subject to a dispute regarding its ownership.
4. The transfer must serve the interest of the person under the authority's guardianship.
If it becomes apparent to the authority that the subject under its jurisdiction has assets outside the Kingdom, it shall coordinate with the Ministry of Foreign Affairs to take the necessary legal procedures to preserve and manage those assets, and transfer what can be transferred to the Kingdom if it serves the interest.
No heir, partner, or any other party may engage in actions or manage the cash, movable property, and real estate owned or co-owned by the subject under the guardianship of the authority after the death of the deceased, guardian, trustee, agent, or supervisor, or upon the occurrence of any event affecting their capacity, except after obtaining the approval of the authority. Any action or transaction carried out contrary to this from the date of death or the occurrence of the event shall be deemed void, even if it occurs before the guardianship is established, unless the relevant administration in the authority decides to approve it.
Notwithstanding this, any expenses incurred for the subject under the law or for those obligated to provide for them, within the limits of their social and economic status, shall remain valid.
