Unified Law for the Care of the Funds of Minors and Those Deemed as Such in the GCC Countries

Chapter 1

Definitions and General Provisions

Article 1

In the application of the provisions of this law, the following words and phrases shall have the meanings specified next to each, unless the context requires a different meaning:
The minor who is not discernible: one who has not completed the seventh year of his age.
The insane: one who is completely or intermittently devoid of reason.
Devoid of perception: one who lacks discernment or awareness due to illness or old age.
The discernible minor: one who has completed the seventh year of his age but has not reached the age of majority.
The imbecile: one who has limited understanding, mixed speech, and poor judgment.
The gullible: one who is easily deceived in his financial transactions.
The spendthrift: one who squanders his money contrary to the dictates of Sharia or reason.
The devoid of perception, the imbecile, the gullible, the spendthrift, the absentee, and the missing.
The adult: one who has reached the age of majority unless interdicted for any reason.
Maturity: the proper management of money according to Sharia and reason.
Age of majority: the completion of (......) years of age.
Guardianship: a legal representation whereby the guardian acts on behalf of the minor in concluding contractual actions and managing his financial affairs.
The guardian: the father, then the one to whom guardianship is transferred according to the law of each country.
Trusteeship: a type of legal representation whereby the will of the trustee replaces the will of the minor in the legal effect directed to the latter.
Custodianship: a type of legal representation in which the custodian appointed by the court represents the interdicted person and manages his assets under the supervision of the General Panel in accordance with the provisions of the law.
The absentee: one whose residence and place of abode are unknown.
The missing: one whose life or death is unknown.
The panel: the General Panel for the care of the assets of minors and those in similar situations.
The council: the Board of Directors of the General Panel for the care of the assets of minors and those in similar situations.

Article 2

1. A person is considered a Legally Incompetent Person if they are a minor who is not discernible, insane, or lacking perception.
2. A person is considered to have diminished capacity if they are a discernible minor, mentally deficient, inattentive, or frivolous.
3. The conditions affecting capacity are insanity, mental deficiency, inattentiveness, frivolity, and loss of perception.

Article 3

1. The actions of a minor who is not distinguished are absolutely void.
2. The financial actions of a distinguished minor are valid if they are purely beneficial to him, and void if they are purely harmful to him.
3. The financial actions of a distinguished minor that are uncertain between benefit and harm are subject to annulment in the interest of the minor, and the right to invoke annulment is removed if they are ratified by his guardian, custodian, or the court in accordance with the law, or by the minor after reaching the age of majority.

Chapter 2: The Palace

Article 5

The guardianship over the property of the minor belongs to the father, and then to whomever the guardianship transfers according to the circumstances in accordance with the system (law) of each country.

Article 6

It is required that the Guardian has full legal capacity, is trustworthy regarding the Minor, and is capable of performing the duties of guardianship. If any of these conditions are not met, the Court shall revoke their guardianship.
