Chapter 1: Establishment of the Public Prosecution, Its Formation, and Competences

Article 1

Previous Amendments

The Public Prosecution is part of the judicial authority and enjoys complete independence, being organizationally linked to the King, and no one is allowed to interfere in its work.
Its main headquarters is located in the city of Riyadh, and it establishes the necessary branches within the city of the main headquarters or outside of it.

Previous Amendments
  • 1 - The Public Prosecution is competent - according to the regulations - for the following:

    • A- Investigation of crimes.

    • B- Acting in the investigation by filing or dismissing the case.

    • C- Public prosecution before judicial authorities.

    • D- Requesting the appeal or cassation of judgments.

    • E- Supervising the execution of criminal judgments.

    • F- Oversight and inspection of prisons and detention centers, and any place where criminal judgments are executed, receiving complaints from prisoners and detainees, verifying the legality of their imprisonment or detention and the legality of their continued stay in prison or detention centers after the expiration of the period, taking necessary procedures to release anyone imprisoned or detained without a legitimate reason, and applying what the regulations stipulate against those responsible for that.

    • G- Any other jurisdiction assigned to it under the regulations.

Article 4

Previous Amendments
  • 1- A council called (Public Prosecution Council) shall be established and composed of the following:

    • A- The Public ProsecutorChairman

    • B- The Deputy Public ProsecutorMember and Vice Chairman

    • C- Seven members of the Public Prosecution, each holding a rank not less than Head of Investigation and Prosecution Department (A), appointed by Royal Decree based on nomination by the Public Prosecutor.Members

      • Their membership term shall be four years, renewable.

  • 2- The Public Prosecution Council shall convene under the chairmanship of its chairman or his deputy, and its meeting shall not be valid unless the majority of the members are present including the chairman of the session. The council's decisions shall be issued by the majority of its members, and in case of a tie, the side with the vote of the chairman of the session shall prevail.

  • 3- The Public Prosecution Council shall have, in addition to the competences specified in this law, the following:

    • A- Considering all matters related to the members of the prosecution; including appointment, promotion, secondment, transfer, loan, training, inspection of their work, disciplinary actions, termination of services, and others; in accordance with the prescribed rules and procedures, ensuring the independence of the members.

    • B- Issuing regulations related to the functional affairs of the members after the King's approval.

    • C- Establishing the necessary departments for the prosecution to perform its duties, according to the requirements of the work.

    • D- Supervising the prosecutions, departments, members, and their work, in accordance with the laws.

    • E- Studying matters related to the work of the prosecution and what is referred to it by the Public Prosecutor.

  • Preparing an annual report on the work of the prosecution including its observations and proposals regarding the progress of its work, and its views on the laws and procedures it applies, which the Public Prosecutor shall submit to the King including his views thereon.

Chapter 2: Members of the Public Prosecution and Its Employees

Article 5

Previous Amendments

The members of the authority shall have judicial capacity, and they shall enjoy complete independence, and they shall not be subject in their work except to the Sharia Provisions and the applicable regulations, and no one shall interfere in their area of work.

Article 6

Previous Amendments

Without prejudice to the provisions of this Law, the members of the authority enjoy the rights and guarantees established in the Civil Service Law and the Retirement Law. They are obligated to comply with the duties stipulated in the Civil Service Law.

Article 7

Previous Amendments

A member of the authority is not permitted to combine their position with engaging in trade or any profession or work that is inconsistent with the independence of the authority's work and its dignity. The authority's management committee may decide to prohibit a member from undertaking any activity that it deems to conflict with the duties of the position and the proper performance thereof.
