Regulations of the Members of the Public Prosecution and Its Employees

First: Appointment, Promotion, and Transfer

Article 1

  • The following conditions are required for anyone appointed as a member of the authority:

    • 1- To be a Saudi national.
      2- To have good conduct and behavior.
      3- To possess the necessary capacity.
      4- To hold a degree from one of the Sharia colleges, or an equivalent certificate, or to hold a specialization in law from one of the universities in the Kingdom, or another equivalent certificate. In the case of equivalency, it is required to pass a special examination held for this purpose.
      5- To be not less than twenty-two years old.
      6- To be medically fit.
      7- Not to have been convicted of a Hudud punishment, or Ta'zir punishment, or a crime involving dishonor or breach of trust, nor to have been subject to a disciplinary decision of dismissal from a public position, even if rehabilitation has been granted.
      8- To successfully pass the test held for appointment.

Article 2

Members of the authority are subject to an intensive training program lasting no less than six months, and this duration is considered equivalent to working in similar tasks for one year. The Council of the authority shall determine the rules for implementing this program.

Article 3

It is required for anyone holding the position of Investigation Lieutenant - in addition to what is stated in Article (1) of this Regulation - to have obtained a university degree with an overall grade of no less than "Good."

Article 5

It is required for anyone holding the position of Investigator (B) to have spent at least one year in the position of Investigator (C), or to have worked in similar duties for a minimum of four years.

Article 6

It is required for anyone holding the position of Investigator (A) to have spent at least four years in the position of Investigator (B), or to have worked in similar roles for at least eight years.

Article 7

It is required for anyone holding the position of Deputy Head of Investigation and Prosecution Department (B) to have spent at least three years in the position of Investigator (A), or to have worked in similar roles for at least eleven years.

Article 8

It is required for anyone holding the position of Deputy Head of the Investigation and Prosecution Department (A) to have spent at least two years in the position of Deputy Head of the Investigation and Prosecution Department (B), or to have worked in similar roles for at least thirteen years.

Article 9

It is required for anyone holding the position of Head of Investigation and Prosecution Department (B) to have spent at least two years in the position of Deputy Head of Investigation and Prosecution Department (A), or to have worked in similar roles for at least fifteen years.
