The Council of Ministers

After reviewing the correspondence received from the Royal Court No. 41039 dated 7/6/1446 AH, including the letter of His Excellency the Minister of Transport and Logistic Services, Chairman of the Board of Directors of the National Center for Transport Safety No. 67133 dated 3/6/1446 AH, regarding the draft statute of the National Center for Transport Safety.

After reviewing the aforementioned draft statute.

After reviewing the organizational arrangements of the National Center for Transport Safety, issued by Council of Ministers Decision No. (340) dated 5/5/1444 AH.

After reviewing memoranda No. (3992) dated 6/12/1446 AH, and No. (492) dated 3/2/1447 AH, prepared by the Bureau of Experts at the Council of Ministers.

After reviewing the recommendation prepared by the Council of Economic and Development Affairs No. (20-46/50/D) dated 26/12/1446 AH.

After reviewing the recommendation of the General Committee of the Council of Ministers No. (2126) dated 27/2/1447 AH.

It is decided as follows:

First: Approval of the statute of the National Center for Transport Safety, in the attached form.

Second: The aforementioned statute in item (First) of this decision shall, upon its enforcement, replacethe organizational arrangements of the National Center for Transport Safety, issued by Council of Ministers Decision No. (340) dated 5/5/1444 AH.

Third: The exercise by the Board of Directors of the National Center for Transport Safety of the authority to determine the financial fee - as stipulated in the statute mentioned in item (First) of this decision - shall be in agreement with the Ministry of Finance and the Non-Oil Revenues Development Center, until the issuance and implementation of the (Governance of the Exercise of Imposing Financial Fees for Services and Works Provided by Entities Authorized by Law to Impose Financial Fees).

Prime Minister

Article 1

  • The following terms - wherever they appear in this Statute - shall have the meanings indicated next to each, unless the context requires otherwise:

  • Center: The National Center for Transport Safety.

  • Statute: The Statute of the Center.

  • Minister: Minister of Transport and Logistic Services.

  • Chief Executive: The Chief Executive Officer of the Center.

  • Council: The Board of Directors of the Center.

  • President: The Chairman of the Board.

  • Means of Transport: Vehicles, trucks, buses, aircraft, trains, and marine vessels; of all types, for non-military or non-security use.

  • Serious Accidents: Accidents and incidents related to the operation of means of transport resulting in loss of life, serious injuries, significant damage to infrastructure, or affecting transport safety.

  • Safety Investigations: The process of collecting, examining, analyzing, and drawing conclusions from information on serious accidents, including identifying causes and contributing factors and reaching appropriate recommendations to prevent recurrence.

Article 2

The center enjoys public legal personality, financial and administrative independence, and is organizationally linked to the Minister. Its main headquarters is in the city of Riyadh, and by a decision of the Council, it may establish branches or offices within the Kingdom as needed.

Article 3

The center aims to enhance the level of safety in the transportation system in all its forms, by spreading awareness and a culture of safety among beneficiaries inside and outside the system, and issuing advisory recommendations based on safety investigation processes, best practices, and relevant international experiences to other concerned entities.

Article 4

  • The Center, in order to achieve its objectives - without prejudice to the jurisdiction of other relevant authorities, and without prejudice to the Kingdom's obligations under international agreements to which it is a party - shall undertake the following:

  • 1- Formulating policies, plans, programs, and initiatives related to transport safety, in coordination with other relevant authorities.

  • 2- Safety investigations into all serious accidents occurring in means of transport, as follows:

    • A- Those occurring to vehicles, trucks, and buses within the Kingdom's territory.

    • B- Those occurring to civil aircraft within the Kingdom's territory, Saudi aircraft or those operated by persons holding Saudi nationality over international waters or over territories not owned by any state, and Saudi aircraft or those operated by persons holding Saudi nationality in the territories of other states.

    • C- Those occurring to marine vessels within the Kingdom's territory, marine vessels on the high seas if flying the flag of the Kingdom, and marine vessels flying the flag of the Kingdom in the territories of other states.

    • D- Those occurring to trains within the Kingdom's territory.

  • 3- Establishing a database and information system that includes all matters related to serious accidents and their statistics, and what is necessary to conduct safety investigations in the Kingdom, in coordination with other relevant authorities.

  • 4- Facilitating access to data and information related to serious accidents and their details to other relevant authorities.

  • 5- Establishing an electronic platform linking the Center with any other relevant authorities as deemed appropriate, contributing to the rapid receipt of serious accident reports, data and information exchange, and enhancing the level of safety in means of transport.

  • 6- Issuing advisory recommendations based on the results of safety investigations to other relevant authorities.

  • 7- Providing services and consultations related to its work to governmental and other entities inside and outside the Kingdom.

  • 8- Coordinating with other relevant authorities to supply it with data and information related to its work and tasks.

  • 9- Conducting studies and research, preparing reports and indicators related to transport safety and its enhancement; and sharing them with other relevant authorities.

  • 10- Utilizing technological means in performing its tasks in a manner that positively impacts the results aimed at maintaining transport safety.

  • 11- Benefiting from local and international practices and expertise that contribute to enhancing transport safety.

  • 12- Cooperating with academic bodies and local and international research institutions related to its work.

  • 13- Holding seminars, courses, and training workshops related to transport safety for its staff, other relevant authorities, or beneficiaries of its services; contributing to raising awareness of the Center's roles and spreading the culture of transport safety.

  • 14- Organizing and holding exhibitions and conferences related to transport safety and participating in them; in accordance with the applicable regulatory procedures.

  • 15- Representing the Kingdom in local and international bodies, organizations, forums, and conferences related to its roles; in accordance with the applicable regulatory procedures and in coordination with other relevant authorities.

  • 16- Any other task assigned to it pursuant to laws and regulations.

Article 5

  • The center shall have a Board of Directors chaired by the Minister, and membership shall include:

  • 1- The Chief Executive Officer.

  • 2- A representative from the Ministry of Interior.

  • 3- A representative from the Ministry of Health.

  • 4- A representative from the Ministry of Transport and Logistic Services.

  • 5- A representative from the Ministry of Municipal and Rural Affairs and Housing.

  • 6- A representative from the General Authority of Civil Aviation.

  • 7- A representative from the Transport General Authority.

  • 8- A representative from the General Authority for Roads.

  • 9- A representative from the Saudi Ports Authority.

  • 10- A representative from the Saudi Standards, Metrology and Quality Organization.

  • 11- A representative from the Ministerial Committee for Traffic Safety.

  • 12- Three representatives from the private sector specialized in transport safety, appointed by an order from the Council of Ministers based on a nomination from the Minister, with membership for a period of three (3) years renewable once.

  • The rank of representatives of government agencies shall not be less than the fourteenth rank or its equivalent.

Article 6

  • The Council is the supreme authority of the center and is responsible for supervising it and managing its affairs. It has the power to exercise all authorities and make all necessary decisions to achieve its objectives; within the limits of the provisions of the statute and the powers granted to it under the relevant laws. In particular, it has the following:

  • 1- Approving the policies, plans, programs, and initiatives related to the center, reviewing them, and following up on their implementation.

  • 2- Determining the financial fees for the services, consultations, or works provided by the center that the Council deems appropriate to charge for.

  • 3- Approving the administrative and financial regulations, provided that the approval of the administrative regulations is in agreement with the Ministry of Human Resources and Social Development, and the approval of the financial regulations and provisions with financial impact in other regulations is in agreement with the Ministry of Finance.

  • 4- Approving the necessary regulations to facilitate work within the center.

  • 5- Approving the conclusion of agreements, memoranda of understanding, and contracts, in accordance with the applicable legal procedures.

  • 6- Reviewing periodic reports submitted on the progress of work in the center and its financial status.

  • 7- Approving the organizational structure of the center and its manual.

  • 8- Approving the establishment of branches and offices for the center.

  • 9- Approving the center’s budget, its annual report, final account, and auditor’s report, and submitting them in accordance with the applicable legal procedures.

  • 10- Accepting gifts, grants, endowments, bequests, donations, and waqf, in accordance with the governing provisions.

  • 11- Appointing an external auditor for the center and an internal financial controller.

  • The Council may delegate some of its powers - except for the powers mentioned in paragraphs: (1) and (2) and (3) and (6) and (7) and (8) and (9) and (11) of this article - to the President or to whomever it deems from its members or the center’s employees.

  • The Council may form permanent or temporary committees from among its members or others, assign them the tasks it deems appropriate, specify in the decision forming each committee its chairperson, members, and competencies, and they may seek assistance from whomever they see fit to perform the assigned tasks.

Article 7

  • 1- The Council meetings shall be held at the Center's headquarters under the chairmanship of the President or his delegate from among the members representing government entities, excluding the Executive President. If necessary, meetings may be held at another location within the Kingdom.

  • 2- The Council shall hold its meetings regularly at least four (4) times a year. The President may call for a meeting whenever necessary, or upon the request of at least one-third (1/3) of the members. The invitation must be sent at least seven days before the meeting date and must be accompanied by the meeting agenda.

  • 3- The meeting shall be valid if attended by the majority of the members, including the President or his delegate, and decisions shall be issued by the majority vote of those present. In the event of a tie, the side voted for by the meeting President shall prevail.

  • 4- A Council member shall not abstain from voting nor delegate another member to vote on his behalf in his absence. The objecting member may record his objection and the reasons for it in the meeting minutes.

  • 5- The Council's deliberations and decisions shall be documented in minutes signed by the meeting President and the attending members.

  • 6- If necessary and in emergency cases, and according to the President's discretion, meetings may be held and voted on remotely through the use of technology means. Decisions may be made by circulation among the members and signed to indicate that all members have been informed. Decisions issued in this manner shall not be considered valid unless circulated to all members, voted on by all members, and approved by the majority of their votes.

  • 7- The Council shall have a Secretary from among the Center’s staff, chosen by the President based on the nomination of the Executive President, who shall be responsible for the Council’s secretariat, preparing meetings, recording minutes, deliberations, and decisions, and attending Council meetings without having the right to vote.

  • 8- The Council may invite specialists and consultants whom it deems necessary to assist to attend its meetings, without granting them the right to vote.

Article 8

  • The Center shall have a Chief Executive Officer, who is appointed and relieved of his position by a decision of the Council, and is responsible for managing the Center and conducting its affairs. His responsibilities and authorities are concentrated within the limits stipulated by the statute and as decided by the Council. In particular, he shall exercise the following powers:

  • 1- Proposing policies, plans, programs, and initiatives, and submitting them to the Council for approval.

  • 2- Proposing the financial consideration for the services, consultations, and works provided by the Center, and submitting them to the Council for approval.

  • 3- Supervising the preparation of the organizational structure of the Center and its manual, its administrative and financial regulations, and the necessary regulations to manage its work; and submitting them to the Council for ratification.

  • 4- Signing agreements, memoranda of understanding, and contracts after the Council's approval, or according to the authorities granted to him, and in accordance with the applicable legal procedures.

  • 5- Supervising the workflow in the Center, and submitting periodic reports to the Council.

  • 6- Following up on the implementation of the decisions issued by the Council, and decisions related to the Center's work.

  • 7- Supervising the preparation of the Center's budget draft, the annual report, and the draft final account; and submitting them to the Council for ratification.

  • 8- Disbursing from the approved budget and taking financial procedures, in accordance with the established laws, regulations, and the authorities delegated to him by the Council.

  • 9- Representing the Center before judicial, administrative, and other authorities inside and outside the Kingdom, and he may delegate others to do so.

  • 10- Appointing the Center's employees in accordance with the approved regulations, and supervising them.

  • 11- Contracting with the Center's employees, experts, consultants, and consulting firms from inside or outside the Kingdom; in accordance with the approved regulations and the authorities delegated to him by the Council.

  • 12- Issuing the necessary decisions to implement the provisions of the statute, the regulations issued thereunder, and the approved rules and procedures; according to the authorities vested in him.

  • 13- Any other task assigned to him by the Council.

  • The Chief Executive Officer may delegate any of his authorities to other employees of the Center.

Article 9

The center's personnel are subject to the provisions of the Labor Law and the Social Insurance Law.
