Regulations Governing the Establishment and Operation of Schools for Vehicle Driving Education and the Practice of the Driving Instruction Profession

  • Having reviewed the Traffic Law, issued by Royal Decree No. (M/85) dated 26/10/1428 AH, as amended by Royal Decrees No. (M/70) dated 6/11/1437 AH, No. (M/73) dated 18/7/1439 AH, and No. (M/115) dated 5/12/1439 AH.

  • Having reviewed the Implementing Regulation of the Traffic Law, issued by Ministerial Decision No. (2249) dated 10/3/1441 AH.

  • Having reviewed the Regulation of Driving Schools, issued by Ministerial Decision No. (3128) dated 2/11/1399 AH.

  • Pursuant to the requirements of the public interest.

  • Hereby decides as follows:

    • First: Approval of the Regulation Governing the Establishment and Operation of Schools for Teaching Vehicle Driving and the Practice of the Driving Instruction Profession, in the form attached to the Decision.
    • Second: This Decision shall be communicated to the relevant authorities for implementation, each within its respective jurisdiction.
    • Third: This Decision shall take effect from the date of its issuance and shall be published in the Official Gazette.

Article 1

  • The following words and phrases, wherever they appear in this Regulation, shall have the meanings set forth opposite each of them, unless the context requires otherwise:

    • 1- Law: Traffic Law issued by Royal Decree No. (M/85) dated 26/10/1428 AH, as amended by Royal Decree No. (M/70) dated 6/11/1437 AH, Royal Decree No. (M/73) dated 18/7/1439 AH, and Royal Decree No. (M/115) dated 5/12/1439 AH.
    • 2- Implementing Regulation: Implementing Regulation of the Traffic Law issued by Ministerial Decision No. (2249) dated 10/3/1441 AH.
    • 3- Regulation: The Regulation of Provisions Governing the Establishment and Operation of Schools for Teaching Vehicle Driving and the Practice of the Driving Instruction Profession.
    • 4- Minister: The Minister of Interior.
    • 5- Traffic Authority: The person assigned by the directors of traffic administrations, divisions, or departments in the Kingdom to supervise schools and practitioners of the driving instruction profession.
    • 6- Committee for Schools and Practitioners of the Driving Instruction Profession: A committee at the General Department of Traffic responsible for licensing the establishment and operation of schools for teaching vehicle driving or practicing the driving instruction profession and regulating their activities in accordance with the provisions of this Regulation.
    • 7- Guide to the Establishment and Operation of Schools for Teaching Vehicle Driving: A guide issued by the General Department of Traffic (the Committee for Schools and Practitioners of the Driving Instruction Profession) specifying the objectives of establishing and operating schools for teaching vehicle driving, the activities and work permitted within such schools, in addition to the conditions, specifications, and requirements necessary for their establishment and operation in all their categories with respect to all construction, specialist, administrative, technical, and educational aspects, as well as the necessary fittings and equipment, the classification of the personnel working therein, and the conditions and provisions for appointing such personnel.
    • 8- Guide to Practicing the Driving Instruction Profession: A guide issued by the General Department of Traffic (the Committee for Schools and Practitioners of the Driving Instruction Profession) specifying the objectives of practicing the driving instruction profession, the activities and work permitted when practicing this profession, in addition to the conditions, specifications, and requirements necessary for permitting its practice and the requirements applicable to the personnel working in this activity.
    • 9- Schools: Entities licensed to conduct the activity of teaching vehicle driving to applicants seeking to obtain a driving license and to raise the qualification level of drivers.
    • 10- Practitioners of the Driving Instruction Profession: Persons licensed to conduct the activity of teaching vehicle driving, to which persons apply for training and instruction to master driving and not to obtain a driving license.
    • 11- Initial Approval: Approval granted to an applicant for a license to establish schools for teaching vehicle driving or to practice the driving instruction profession, enabling the applicant to commence establishment procedures before obtaining the license.
    • 12- License: Approval granted to any person wishing to establish schools for teaching vehicle driving or to practice the driving instruction profession, enabling the person to commence conducting the activity.
    • 13- Curricula: The educational and training material, in its theoretical and practical content, provided to the trainee to teach the trainee how to drive vehicles.
    • 14- Programs: The educational and training plans, in their theoretical and practical content, approved for the trainee to teach vehicle driving and meet the needs of drivers in terms of skill and driving behavior.
    • 15- Equipment: The means and equipment used for training, instruction, and identity verification at schools and by practitioners of the driving instruction profession.
    • 16- Personnel: Everyone working at schools for teaching vehicle driving or practicing the driving instruction profession in activities relating to instruction and training in driving.
    • 17- Trainee: The beneficiary of the approved driving instruction programs and curricula at schools for teaching vehicle driving or with practitioners of the driving instruction profession.
    • 18- Test: The practical test administered to the trainee at schools for teaching vehicle driving after completion of the prescribed theoretical and practical training hours, covering the skills necessary to enable the trainee to drive safely, and a theoretical test of the trainee’s knowledge of the provisions set forth in the Traffic Law and its Implementing Regulation, road traffic regulations, traffic signs and signals, and general safety rules, in accordance with the regulations set forth in the Implementing Regulation of Article Thirty-Six of the Traffic Law, provided that it is conducted by the Traffic Authority or by a person authorized by the General Department of Traffic to do so.

Article 2

  • It is not permissible to engage in the activity of establishing and operating schools for teaching vehicle driving or to practice the profession of driving instruction unless the necessary license has been obtained from the General Directorate of Traffic (Committee for Driving Schools and Driving Instruction Practitioners).

Article: 3

  • An application for a license to establish a driving school or practice the profession of driving instruction shall be submitted to the General Department of Traffic (the Committee for Driving Schools and Driving Instructors) in accordance with the mechanism determined by the Committee, after fulfilling the requirements necessary for the license.

Article 4

Article 5

  • The Committee for Driving Schools and Driving Instruction Practitioners shall perform its duties in accordance with the following mechanism:

    • 1- The Committee shall hold its meetings at the headquarters of the General Directorate of Traffic, chaired by the President—or his designee—and may, where necessary, hold them at another location within the Kingdom.
    • 2- The Committee shall meet—upon invitation by its President—once every three months and whenever necessary, as determined by the President. The President shall invite the Committee to convene if at least half of the members so request, provided that the invitation to the meeting is issued—in writing—at least (7) days before the meeting and includes the agenda of the meeting.
    • 3- A Committee meeting shall not be valid unless attended by at least the majority of its members, including the President or his designee.
    • 4- The Committee may hold its meetings remotely through the use of technological means.
    • 5- The Committee’s decisions shall be issued by a majority vote of the members present. In the event of an equality of votes, the side supported by the chair of the meeting shall prevail.
    • 6- The Committee’s deliberations and decisions shall be recorded in minutes signed by the chair of the meeting and the members present. A dissenting member may have his reasoned objection recorded in the minutes.
    • 7- No Committee member may abstain from voting or authorize another member to vote on his behalf in his absence.
    • 8- The Committee Secretariat shall prepare for the Committee’s meetings, notify its members of their dates, prepare its minutes and decisions, and perform such tasks as assigned to it by the Committee or the President.
    • 9- The Committee may invite any specialists and consultants it deems appropriate—whether from within or outside the Kingdom—to attend its meetings and seek their assistance, without granting them the right to vote on its decisions.
    • 10- Submit an annual report to His Excellency the Director of Public Security on the tasks and work completed by the Committee and the plans and projects proposed for developing the activity of driving instruction.
    • 11- The President may reconstitute the membership of the Committee if he deems it appropriate or if the need arises.

Article: 6

  • The authority concerned with traffic shall supervise schools and practitioners of the driving instruction profession in accordance with the following mechanism:

    • 1- Continuous monitoring of the activities of schools and practitioners of the driving instruction profession, ensuring compliance with the application of laws and instructions, in coordination with the Secretariat of the Committee for Schools and Practitioners of the Driving Instruction Profession.
    • 2- Recording violations committed by schools and practitioners of the driving instruction profession.
    • 3- Conducting or approving the examinations required to obtain a driving license in accordance with the mechanism approved by the General Department of Traffic (Committee for Schools and Practitioners of the Driving Instruction Profession).
    • 4- Referring all applications received from schools or practitioners of the driving instruction profession to the Secretariat of the Committee for Schools and Practitioners of the Driving Instruction Profession and carrying out the necessary coordination between them in all aspects.
    • 5- Ensuring the availability and effectiveness of the equipment and apparatus used for the purposes of instruction, training, examination, and identity verification.
    • 6- Receiving complaints falling within its jurisdiction and handling them through lawful procedures.
    • 7- Submitting an annual report to the General Department of Traffic (Committee for Schools and Practitioners of the Driving Instruction Profession) concerning schools and practitioners of the driving instruction profession, in accordance with the form approved by the Committee.
    • 8- Submitting to the General Department of Traffic (Committee for Schools and Practitioners of the Driving Instruction Profession) any observations or proposals related to the activities of schools and practitioners of the driving instruction profession.
    • 9- Reviewing applications submitted by the establishment owner to add activities unrelated to driving instruction activities within the establishment’s premises and approving them as it deems appropriate after obtaining the approval of the competent authorities.

Article 7

  • Licenses shall be issued according to the following classification:

    • 1- Category (A) driving school for teaching the driving of all vehicles.
    • 2- Category (B) driving school for teaching the driving of private vehicles, light and heavy transport vehicles, small and large buses, and motorcycles.
    • 3- Category (C) driving school for teaching the driving of public works vehicles.
    • 4- Category (D) driving school for teaching the driving of private vehicles, light transport vehicles, minibuses, and motorcycles.
    • 5- Category (E) driving school for teaching the driving of heavy transport vehicles and large buses.

Article 8

  • If the Licensee wishes to change the school category, it must obtain the approval of the General Directorate of Traffic (the Schools and Driving Instructors Committee), provided that the requirements applicable to the category for which the License is requested are fulfilled, taking into account the requirements applicable to each category.
