Implementing Regulation of the Penal Law on Dissemination and Disclosure of Classified Information and Documents

Article 1

  • Every public employee or equivalent to whom tasks related to classified documents have been assigned, and whose service has been transferred, or whose employment relationship with the entity he works for has ended, or whose relationship with those tasks has been severed; must hand over to the entity all classified documents in his possession according to a form that indicates this. The entity shall not release him until those documents have been received.

Article 2

Without prejudice to the provisions of disciplinary accountability, any public employee or equivalent who publishes a confidential document or is suspected of disclosing confidential information related to their work shall be suspended from performing any tasks related to confidential documents, until the disciplinary accountability procedures are completed.

Article 3

In the event of the loss or leakage of a confidential document or the disclosure of confidential information; the entity shall take the following procedures:
1- Prepare a report of the fact that includes clarification of the day of its discovery, its date, time, and information about it, as well as any other explanatory information.
2- Notify the competent investigation authority of the fact within (24) hours from the preparation of the report.

Article 4

In the event of finding the lost confidential document, a report shall be prepared, and it shall be returned - by means of a report - to the entity from which it was lost.

Article 5

  • This regulation shall be published in the Official Gazette and shall become effective from the date of its publication.
